TIME PERIOD
From November 4, 2015 to April 22, 2016.
ALL MINISTERS
Organizations are required to provide a response regarding gifts received by ministers
and parliamentary secretaries.
All organizations must provide a response based on the information that is maintained
in the department or agency.
TEMPLATE
Organizations that have information are required to use the attached template to report
the information requested.
APPLICATION OF THE PRINCIPLES OF THE ACCESS TO INFORMATION ACT

AND THE PRIVACY ACT
Organizations should consult officials responsible for access to information and privacy
to ensure that the Privacy Act and the principles governing exclusions, exemptions and
prohibitions contained in the Access to Information Act are applied to the proposed
ministerial responsi:!. Because Parliamentary Returns are not formally processed under
these Acts, specific sections should not be quoted to justify non-disclosure.
If, after applying the Privacy Act and the principles found in the Access to Information .
Act, the organization determines that it is necessary to withhold certain information, then
the following statement should be included: ."In processing Parliamentary Returns, the
Government applies the Privacy Act and the prin'ciples set out in the Access to
Information Act, and certain information has been withheld on the grounds that [subject
of exemption]."
For example, the statement might read as follows:

"In processing Parliamentary Returns, the Government applies the Privacy Act and the
principles set out in the Access to Information Act, and certain information has been
withheld on the grounds that the information constitutes personal information."

APPLICATION DES PRINCIPES DE LA LOI SUR L'ACCES A L'INFORMAT/ON ET DE

LA LOI-SUR LA PROTECTION DES RENSEIGNEMENTS PERSONNELS
Les organisations doivent consulter les agents responsables de l'acces a !'.information
et de la protection des renseigne-rnents personnels pour veiller a ce que la Loi sur la
protection des renseignements personnels ainsi que I.es principes regissant les
exclusions, exceptions et interdictions prevues par la Loi sur l'acces a /'information
soient appliques aux reponses ministerielles proposees. Les documents parlementaires
ne sont pas officiellement vises par ces lois; les articles de ces dernieres ne doivent pas
etre cites pour justifier la non-divulgation.
Si, apres avoir applique la Loi sur la protection des renseignements personnels et les
principes de la Loi sur l'acces a /'information, le prepose aux documents parlementaires

Agency (CRAJ.

The receipt of gifts by reporting public office holders (including Ministers and Parliamentary Secretaries) is governed
by the Conflict of Interest Act and the Conflict of Interest Code for Members of the House of Commons.
Gifts valued at $.200 and more (where the giver is not a relative or a friend) must be disclosed to the Conflict of
Interest and Ethics Commissioner of Canada. In regard to gifts valued at less than $200, if the total value of all gifts or
other advantages accepted by a reporting public office holder or a member of his or her family exceeds $200 from
any one source other than relatives and friends in a 12-month period, it is required that the reporting public office
holder disclose the gifts or other advantages to the Commissioner within 30 days after the day on which the value
exceeds $200.
