I started to work in 2002 as service crew for Angels Burger

Company with salary of P400.00 pesos per day, from 7:00 a.m. to
7:00 p.m. The chief operating officer at that time was Joseph G.
Mojica and the Franchising Manager was Victoria DL Mojica.
Sometime in 2006, I gave birth to my child, due to that I stopped
working for the meantime but that is the last time. In 2007, I
returned to Angels Burger Company and was assigned to Rowena
Alagdon (franchisee) until June 09, 2016. I have been working for
Rowena from 2007 up to November 2014 as a service crew. In
December 2014, I was promoted from service crew to area
supervisor on Alagdons Angels Burger.
On May 22, 1016, Alagdon told Perla Baluyot her business partner
to demote Maricar E. Linga (herein affiant) to service crew without
any reason whatsoever or violation. Despite of demoralizing
action made by Alagdon, I still continue to perform my job but this
time as a service crew. Thereafter, Maria Miran (Office Staff)
informed me through text that there will be a meeting on June 09,
2016. Sad to say, when I got in the office where the meeting is
supposed to be held, no one is present. I made several texts and
calls but none of them tried to answer my texts and calls.
Disappointed that the meeting will no longer prosper, I conferred
with one Noel Bilbao (supervisor of Angels Burger Company)
instead, who was there in the office. Sir Noel Bilbao, forced me to
sign a contract allegedly ordered by Alagdon but I refused to sign
for the reason that I cannot accept what is written on that
contract. Bilbao, even threatened me. I did not acceded to the
contract because they lower my salary from P400.00 pesos to
P120.00 pesos as allowance plus commission that to my sound
wisdom is not adequate enough to sustain my daily expenses and
it is demoralizing.
There was also a time that, I even work for 36 hours a day without
any overtime pay. Feeling oppressed and demoralized, I decided
to go to NLRC to pursue what is due to me and to get back the
moral that has been taken to me.
