Art.6.Consummated,frustrated,andattemptedfelonies.

Consummatedfeloniesas
wellasthosewhicharefrustratedandattempted,arepunishable.Afelonyis
consummatedwhenalltheelementsnecessaryforitsexecutionandaccomplishmentare
present;anditisfrustratedwhentheoffenderperformsalltheactsofexecutionwhich
wouldproducethefelonyasaconsequencebutwhich,nevertheless,donotproduceitby
reasonofcausesindependentofthewilloftheperpetrator.Thereisanattemptwhenthe
offendercommencesthecommissionofafelonydirectlyoroveracts,anddoesnot
performalltheactsofexecutionwhichshouldproducethefelonybyreasonofsome
causeoraccidentotherthanthisownspontaneousdesistance.
Art.9.Gravefelonies,lessgravefeloniesandlightfelonies.Gravefeloniesarethose
towhichthelawattachesthecapitalpunishmentorpenaltieswhichinanyoftheir
periodsareafflictive,inaccordancewithArt.25ofthisCode.Lessgravefeloniesare
thosewhichthelawpunisheswithpenaltieswhichintheirmaximumperiodare
correctional,inaccordancewiththeabovementionedArt..Lightfeloniesarethose
infractionsoflawforthecommissionofwhichapenaltyofarrestmenororafinenot
exceeding200pesosorboth;isprovided.
Art.7.Whenlightfeloniesarepunishable.Lightfeloniesarepunishableonlywhen
theyhavebeenconsummated,withtheexceptionofthosecommittedagainstpersonor

Art.11.Justifyingcircumstances.Thefollowingdonotincuranycriminalliability:
1.Anyonewhoactsindefenseofhispersonorrights,providedthatthefollowing
circumstancesconcur;First.Unlawfulaggression.Second.Reasonablenecessityofthe
meansemployedtopreventorrepelit.Third.Lackofsufficientprovocationonthepart
ofthepersondefendinghimself.
2.Anyonewhoactsindefenseofthepersonorrightsofhisspouse,ascendants,
descendants,orlegitimate,naturaloradoptedbrothersorsisters,orhisrelativesby
affinityinthesamedegreesandthoseconsanguinitywithinthefourthcivildegree,
providedthatthefirstandsecondrequisitesprescribedinthenextpreceding
circumstancearepresent,andthefurtherrequisite,incasetherevocationwasgivenby
thepersonattacked,thattheonemakingdefensehadnoparttherein.
3.Anyonewhoactsindefenseofthepersonorrightsofastranger,providedthatthefirst
andsecondrequisitesmentionedinthefirstcircumstanceofthisArt.arepresentandthat
thepersondefendingbenotinducedbyrevenge,resentment,orotherevilmotive.
4.Anypersonwho,inordertoavoidanevilorinjury,doesnotactwhichcausesdamage
toanother,providedthatthefollowingrequisitesarepresent;First.Thattheevilsoughtto

beavoidedactuallyexists;Second.Thattheinjuryfearedbegreaterthanthatdoneto
avoidit;Third.Thattherebenootherpracticalandlessharmfulmeansofpreventingit.
5.Anypersonwhoactsinthefulfillmentofadutyorinthelawfulexerciseofarightor
office.
6.Anypersonwhoactsinobediencetoanorderissuedbyasuperiorforsomelawful
purpose.
Art.12.Circumstanceswhichexemptfromcriminalliability.thefollowingare
exemptfromcriminalliability:1.Animbecileoraninsaneperson,unlessthelatterhas
actedduringalucidinterval.Whentheimbecileoraninsanepersonhascommittedanact
whichthelawdefinesasafelony(delito),thecourtshallorderhisconfinementinoneof
thehospitalsorasylumsestablishedforpersonsthusafflicted,whichheshallnotbe
permittedtoleavewithoutfirstobtainingthepermissionofthesamecourt.2.Aperson
undernineyearsofage.3.Apersonovernineyearsofageandunderfifteen,unlesshe
hasactedwithdiscernment,inwhichcase,suchminorshallbeproceededagainstin
accordancewiththeprovisionsofArt.80ofthisCode.Whensuchminorisadjudgedto
becriminallyirresponsible,thecourt,inconformablywiththeprovisionsofthisandthe
precedingparagraph,shallcommithimtothecareandcustodyofhisfamilywhoshallbe
chargedwithhissurveillanceandeducationotherwise,heshallbecommittedtothecare
ofsomeinstitutionorpersonmentionedinsaidArt.80.4.Anypersonwho,while
performingalawfulactwithduecare,causesaninjurybymereaccidentwithoutfaultor
intentionofcausingit.5.Anypersonwhoactunderthecompulsionofirresistibleforce.
6.Anypersonwhoactsundertheimpulseofanuncontrollablefearofanequalorgreater
injury.7.Anypersonwhofailstoperformanactrequiredbylaw,whenpreventedby
somelawfulinsuperablecause.
