MOTION TO DISMISS CHARGE

Now comes the Accused, Name of Accused, and for his Motion To Dismiss Charge, pursuant to
725 ILCS 5/114-1, states as follows:

1. The Accused is charged, by Complaint, with the offense of “Failure to Wear Seat Belt” under
(625 ILCS 5/12-603.1)

2. The said indictment does not state an offense as required by 725 ILCS 5/111-3(a), requiring
dismissal of the indictment pursuant to 725 ILCS 5/114-1(a)(8).

WHEREFORE, the Accused prays that this Court enter an Order dismissing the charge in the above-
entitled cause with prejudice.
