Cedillo #3014, Fort Worth Police Department, and I have good reason to believe and do believe that on or about the 23" Day of October, 2016 in Tarrant County, Texas, Carey Joseph Heath, White Male, Date of Birth 09-26-1981 did then and there commit the offense of CAPITAL MURDER jn that he did then and there intentionally cause the death of an individual, Daniel Derek Haros, by shooting him with an assault rifle and striking him with an assault rifle and did then and thate intentionally cause the death of individual, Phillip Michael Evans, by shooting hin ‘with an assault rifle and striking him with an assault rifle and both murders were committed during the same criminal transaction, My belief is based upon the following facts and information: 1 On October 23, 2016 at approximately 3:59 a.m, your affiant Detective J. Cedilto 43014 and Homizide Detective EC Pate #3023 assigned to the Fort Worth Homicide Unit were notified of a double homicide at 828 Buffalo Springs Drive in Fort Worth, Tarrant County, Texas, ‘Your affiant along with Detective EC Pate later arrived on the scene and met with responding officers, Your affiant learned that upon their arvival they found two adult males shot to death. One male identified as Daniel Derek Haros was found in the driveway at 900 Buffalo Springs Drive. The second male identified as Phillip Michael Evans was found in the front yard of 828 Buffalo Springs Drive. Your affiant met with the 911 caller» > heard multiple guns shots outside of their residence. Affer the gunshots stopped, opened the door and saw a white male standing over Daniel and was striking him with the butt of the rifle, s yelled for the suspect to stop and the suspect pointed the weapon at and asked © if had a problem, During the course of this investigation, your affiant identified the suspect as being Carey Joseph Heath who lives a few houses down from the victims. The suspect was identified after interviewing Carey's neighbor stated he had a small Halloween gathering at his house on the night of October 22"! and the early moming hours on October 23%, stated Carey Heath and his wife Tiffany Heath attended the party. While everyone siood in the front yard, his neighbors (Daniel Haros, Phillip Evans and two others) came over to visit for Jess than five minutes. According to the conversation was friendly and cordial, After his neighbors walked back home, and Tiffany Heath went back into his house as Carey walked next door to his house. A few minutes later, heard multiple gunshots, Minutes later, Carey Heath ran into his house and handed his one year baby and stated, ‘this is the last time | will see the baby. I killed two people.” Carey then ran out of his house. 7. Cavey’s wife, Tiffany Heath then ran outside and a short time later came back to Andtes’s house and told them that she saw a dead person in the driveway across the street. On October 24, 2016° at approximately 2:45 p.m, your affiant spoke to Tarrant County Medical Examiner M. Krouse who stated Daniel Haros and Phillip Evans died due to multiple gunshot wounds and blunt force trauma to thelr face and head, ° . At approximately 3:30 pm, Homicide Detective K, Sullivan #2912 interviewed ‘Tiffany Heath, Tiffany admitted that after hearing the gunshots her husband, Carey told her that someone was dead actoss the street. Tiffany walked across the street and saw a person dead in the driveway across the street. 10. Tiffany stated the following morning, Carey admitted to her that he was responsible for the two murders, Carey asked her to clean the blood in the gun safe where he kept his firearms. That based upon the above facts and information being related to bim and as a result of his investigation, your affiant does have reason to believe and does believe that Carey Joseph Heath, White Male, Date of Birth 09-26-1981 did there commit the offense of CAPITAL MURDER against the laws of the State of Texas as set forth in the Penal Code.
