ORDER DENYING MOTION FOR SUMMARY JUDGMENT.
‘The Respondent's Motion for Summary Judgment came on to be heard before the duly
designated panel of District Committee members on October 31, 2016, and based on the panel's
review of the pleadings, the stipulation entered into by the parties, the record as a whole, and in
consideration of the statements of counsel at the hearing, the panel finds that, although no facts
germane to the Motion are in dispute, no information was presented that the alleged ethical
misconduct was considered and detetmined previously and, therefore, the Motion should be
denied.
