1. Directive
Children have different needs and requirements regarding clothing and hardware. As they sometimes do the
unexpected and their inability to consider and foresee the consequences. For example they will cross the streets
without looking. Global laws imply the manufacturers or importers have to make sure childrens goods under
normal and foreseeable conditions of use shouldnt pose any threat to the child or others in the near proximity
of the child.
Previously we have updated the norms according to current leading child safety regulations and tried to make
the document more accessible and user friendly. Therefore we have chosen to replace excessive text for clear
and easy to understand illustrations. We strive to make the complicated regulations more accessible in order to
create a single interpretation explanation.
In this version a mandatory zipper puller torque test requirement is added in order to cover international safety
standards at its fullest. Furthermore some Canada only requirements are added which can be found in
Chapter 6. Corrected typos are highlighted in yellow.
Mexx, as a brand, has to take the responsibility on product safety and product quality. To protect the child and
make sure the garment resists wear and care.
Mexx products are without prejudice subject to applicable regulations.

The Mexx Child Safety Manual is just one part of the Mexx product requirements. For a complete package of

2. Flammability regulations for children garments.


For children garments there are specific laws and regulations to guard the safety of the child. Any unsafe aspect of
the garment will immediately result in recalls. For example: buttons that are not secured well.

2.1 Flammability rules in The Netherlands


In May 2008 an agreement between VWA and the branch organizations became effective that specifies the
requirements on flammability of daywear.
Particular fabrics which are used as outer fabric must be tested according to ASTM test method D1230.
The fabrics which are subject for mandatory testing are:

Raised or brushed fabrics


Fabrics 88 gr/m

Exempt for testing are fabrics which contain Acrylic, Olefin, Modacrylic, Polyester, Polyamide and/or Wool or a
blend of these fibers.
Requirements and test condition

The test specimen is mounted in the specimen holder and placed in the test cabinet at an angle of 45.
Flame contact time 1 second, 19 mm above the edge of the specimen.
The time of flame spread over a distance of 127 mm must be less than 4 seconds.

2.2 Flammability rules for the UK


In the United Kingdom there are rules regarding the labeling of the level of flammability in childrens nightwear.
The following information is a summary from Nightwear and fire, a guide to nightwear safety regulations.
Childrens nightwear; i.e. garments for children over 3 months und under 13 years of age and not exceeding any
of the following maximum measurements.
Nightdresses. Chest 91cm, Length 122 cm
Dressing gowns, bath robes and similar garments: Chest 97 cm, Sleeve length 69 cm
Nightdresses, dressing gowns and similar garments commonly worn as nightwear must satisfy the flammability
performance requirements and dont need to carry a label showing whether they or not meet the flammability
standard.
Pyjamas and terry cloth toweling bathrobes dont have to comply with the flammability standard but must carry
a permanent label showing whether or not they meet the flammability standard.
Babies garments; i.e. garments exclusively for babies under 3 months and having a chest measurement not
exceeding 53 cm must carry a permanent label showing whether or not they meet the flammability standard.

NOTE
One-piece garments with legs should be treated as childrens pyjamas, from age group 3 months until 13
years. Therefore they dont have to meet the flammability standard but must carry a label whether or not
meet the standard.
Stretch garments, which can be worn by an infant above 3 months until 13 years of age should be
treated as childrens nightwear, hence they do have to meet the standard but are exempt from having a
permanent label. If the garment has legs it should be treated as pyjamas and therefore must have a
permanent label stating whether or not meet the standard.
Garments doubling as sleeping bags and dressing gowns, which can be worn by an infant above 3
months until 13 years of age should be treated as childrens dressing gowns. Dressing gowns must meet
the standard and therefore do not have to carry a permanent label.
The performance requirements relate to the whole garment including threads, trimmings, decorations and labels.
Elastic and elastic threads used for making gathers in materials are exempt.
When nightwear is trimmed or made of synthetic fabric that melts without decomposing when ignided, can be
taken to meet flammability performance requirements. When nightwear has been treated with flame retardant
chemicals a label must appear with a warning about care taking.
Pyjamas and cotton terry toweling bathrobes, which do not meet the requirements, must carry a label with the
following words: KEEP AWAY FROM FIRE; in red letters.
Nightwear that does meet the requirements must carry a label with the following words: LOW FLAMMABILITY
TO BS5722; in black letters. Another option is LOW FLAMMABILITY TO BS 5722; in black letters followed
by the words KEEP AWAY FROM FIRE; in red letters.
All wordings must be printed in medium letters of point 10 in uppercase.
Labels showing the flammability performance must be permanent and securely sewn into the garment; this may be
on a separate label or together with other information.
Nightwear that must meet the flammability performance requirements do not need to carry a label, this is up to the
supplier.
The requirements of BS 5722
The test specimen is mounted in the specimen holder and placed in the testing device at an angle of 90.
40 mm flame
10 sec contact between flame and fabric
Over a length of 300 mm the time of the flame spread should be at least 25 sec
Over a length of 600 mm the flame should spread not faster than 50 sec
When the flame reaches the 300 or 600 mm line faster than the requirement, the garment should contain the label
KEEP AWAY FROM FIRE; in red letters.

2.3 Mexx flammability requirements for childrens and babies garments


The Mexx flammability requirements for childrens and babies garments are a combination of applicable global
regulations. Below table indicates the flammability requirements for daywear and specific garments that can be
both used as day or nightwear. Mexx products are without prejudice subject to applicable regulations.

3. EU Cord and drawstrings regulation for childrens garments


There have been an alarming number of injuries and fatalities amongst children from accidents involving trailing
and protruding cords, strings, ties and such like from their clothing.
In response, the European Union published a standard in December 2004; EN 14682 to specify the requirements for
cords and drawstrings in childrens clothing. Reducing the risk of entrapment and strangulation is fundamental for
our company and therefore Mexx adopted this norm.
The cords and drawstrings regulation does not apply to:
Childcare items; e.g. nappies
Shoes, boots and similar footwear
Gloves, hats and shawls
Ties designed to wear with shirts and blouses
Belts and suspenders
Religious and ceremonial clothing
Specialized sports clothing; e.g. rugby, dancing, horse riding
Theatrical costumes

3.1 Definitions
Find in below list the definitions as used in the EN 14682 regulation explained by illustration and text.
Childrens clothing

All clothing that due to its design, production method or sales method is
intended to be worn by children up to 14 years of age, including all clothing
intended to be worn by boys up to 182 cm tall and girls up to 176 cm tall.

Baby

Up to 6 months max 92 cm tall

Young child

Up to 7 years max 134 cm tall

Older child or young person

From 7 to 14 years
Boys: 134 182 cm tall
Girls: 134 176 cm tall

Drawstring

A cord, chain, band, lacing or ribbon


that is threaded through tunnels,
loops, shoelace openings, etc.
Intended to adjust the dimensions of
the opening (or part) of a piece of
clothing, or to close a piece of
clothing.
The sewn-in cord can be a loop with
a stopper.

illustration and text in the following paragraphs.

4. EN 71 Safety of toys
In 1974, the EEC Commission agreed to progress a proposal to introduce a community-wide directive to cover the
safety of toys. This would have set out all the technical specifications to achieve this. However in 1985, the
commission decided on a new approach to technical harmonization and standards (set out in council directive
85/c 136/01) with the aim of setting out the essential safety requirements and calling up harmonized standards,
compliance which should ensure that these requirements were met. Accordingly, a mandate was given to the
European Committee for Standardization CEN to publish standards to cover mechanical and physical hazards,
flammability and chemical and electrical properties. Subsequently, the first of these standards was published in
1988 but these have been (and are) regularly updated and as at January 2002, the following are the current
standards:

Additional: EN50088:1996. Electrical properties
The standard applies to all toys for children up to the age of 14 years, but have special requirements for warnings
for children of various ages within this category, and in particular, warnings for toys that are deemed to be
unsuitable for children under 36 months. EN 71-6 gives an alternative symbol for such warnings in the place of
text.

4.1 Mexx requirements for small parts in childrens products


Mexx requirements on small parts are based on British Standard 7907 Code of practice for the design and
manufacture of childrens clothing to promote mechanical safety and Liz Claiborne requirements on stonewash for
baby and childrens garments. Some requirements are listed as recommendation in the BS 7909 which Mexx have
adopted as mandatory requirement.

4.1.1 Attached components on finished garments


4.1.1.1 Buttons and snapfasteners
Referring to BS 7907 below guidelines must be followed when using buttons and snapfasteners on baby and
childrens garments.
Detachment of small parts attached to

4.1.1.2 Beads, bows, sequins and similar components


Referring to BS 7907 below guidelines must be followed when using beads, bows, sequins and similar components
for decoration on baby and childrens garments.

To keep the sequin flat to the fabric the sequin must be
attached with a minimum of 3 stitches in opposite direction.

Rubber balls > 32 mm + enzymes can be used to achieve


similar stone wash effects. Other alternatives e.g. stones,
balls or else must be > 32 mm.

4.1.1.3 Zipper pullers


Since the BS7907 is not providing a test method for puller torque resistance Mexx adopted the ASTM D2061.
The ASTM D2160 Torque test is mandatory for all Youth styles from March 2011 onwards.

5. Technical document for the CE mark for toys


The European Union (consisting of Austria, Belgium, Denmark, Cyprus, Czech Republic, Estonia, Finland,
France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland,
Portugal, Slovakia, Slovenia, Spain, Sweden and the United Kingdom) has set up rules for selling certain types of
products within the EU. For example, there are rules for medical devices, machines with moving parts, electronic
devices, etc. If you want to sell a product in one of these categories anywhere in the European Union, your product
must meet the standards set by the rules. If your product meets the standards, it can bear a CE marking and be sold
in the EU.
CE stands for Conformit Europenne, which is French for "European Conformity." A product in one of the
controlled product categories cannot legally be sold in the EU unless it has passed the tests to receive the CE
marking.
For a company trying to sell a product, getting a CE marking makes things much easier because it means you can
sell the product anywhere in the EU. In the United States, electronic device manufacturers need to meet the same
sort of requirements to get FCC approval.
A technical file must be compiled by the manufacturer or his authorised representative established in the
Community for all PPE (personal protective equipment) prior to its being placed on the market. The format and
content of the file will vary according to the type of PPE; level of risk being protected against; method of
manufacture of the PPE to which it relates (i.e. against specified harmonised standards or against other technical
specifications), etc. Schedule 3 of the Regulations lists the technical documentation, which must be supplied by the

documentation.
Information to be supplied in Technical Documentation for all PPE
The documentation referred to in regulation 11 of the Regulations must comprise all relevant data on the means
used by the manufacturer to ensure that the PPE complies with the basic health & safety requirements relating to it.
It may therefore contain the following:
description of and/or sample of the PPE to which the file relates;
list of the basic health and safety requirements relating to the PPE in question and the means used to satisfy
these requirements, including:
o details of any harmonised European standards employed, in full or in part, in the PPEs
manufacture;
o details of any other national or other standards, or recognized specifications, employed in full or in
part in the PPEs manufacture;
o any other technical specifications taken into account;
performance characteristics and details of intended use.
In case of PPE of other than of simple design, this documentation must also contain :
1.
the manufacturers technical file comprising of
(a) overall and detailed plans of the PPE in question, together with, where appropriate particulars
of the calculations employed in the design of the PPE; and the results of the tests of any
prototype of the PPE in question, which are necessary to verify its compliance with the
relevant basic health and safety requirements;
(b) a complete list of the basic health and safety requirements, national standards (if any) and other
technical specifications taken into account in its design;
2.
a description of the control and test facilities used in the manufacturers plant to check compliance
of PPE units with the relevant national standards, or other relevant technical specifications and to
maintain the quality of production; and
3.
a copy of the information notice referred to in paragraph 1.4 of Annex II of the Directive as applied
by Schedule 2 of the Regulations.

6. Canada Child Safety regulations


6.1 Mexx Canada belt safety requirements
Health Canada recommend that tied belts (functional or non functional) on children's clothing should be tacked at
the back or on the 2 sides. This way will not allow the child to remove the belts and play with it.

banned the hanger loop in all childrens wear. Hanger loops are used to prevent the garment for falling off the
