ABUSE TREATMENT AND REHABILITATION CENTERS THROUGHOUT
THE PHILIPPINES

W H E R E A S , i n light o f t h e g o v e r n m e n t ' s u n r e l e n t i n g c a m p a i g n a g a i n s t illegal d r u g s ,


the number of drug dependents w h o have voluntarily surrendered to the authorities continues
to grow;
W H E R E A S , t h e S t a t e v a l u e s t h e dignity o f e v e r y h u m a n p e r s o n a n d g u a r a n t e e s full
respect for h u m a n rights;
W H E R E A S , it i s t h e p o l i c y o f t h e S t a t e t o p r o v i d e e f f e c t i v e m e c h a n i s m s o r m e a s u r e s
to re-integrate into society individuals, w h o h a v e fallen victim to drug a b u s e or dangerous drug
dependence, through sustainable programs of treatment and rehabilitation;
W H E R E A S , i n light o f s u c h policy, R e p u b l i c A c t ( R A ) N o . 9 1 6 5 , a s a m e n d e d ,
otherwise k n o w n as the "Dangerous Drugs Act o f2002," mandates the national government,
t h r o u g h its a p p r o p r i a t e a g e n c i e s , t o e s t a b l i s h a t l e a s t o n e d r u g rehabilitation c e n t e r i n e a c h
province, depending o n the availability of funds;
W H E R E A S , R A N o . 9 1 6 5 also m a n d a t e s local g o v e r n m e n t units ( L G U ) to appropriate
a substantial portion o ftheir annual budgets to assist inor e n h a n c e the enforcement of such
law, giving priority t o p r e v e n t i v e o r educational p r o g r a m s a n d t h e rehabilitation o r t r e a t m e n t
of drug dependents;

government drug rehabilitation centers operating in the country, and the increasing number
of patients is straining t h e capacity of s u c h facilities a n d their p e r s o n n e l b e y o n d their limits;
W H E R E A S . Section 17, Article VII o f the 1987 Philippine Constitution vests i n the
P r e s i d e n t p o w e r o f c o n t r o l o v e r all e x e c u t i v e d e p a r t m e n t s , b u r e a u s a n d offices;
N O W T H E R E F O R E , I, R O D R I G O R O A D U T E R T E , President o f the Philippines, b y
virtue of the p o w e r s vested i n m e by the Constitution and existing laws, d o hereby order:

i S E C T I O N 1. C r e a t i o n o f a n I n t e r - A g e n c y T a s k F o r c e f o r t h e E s t a b l i s h m e n t a n d
Support of Drug Abuse Treatment and Rehabilitation Centers (DATRCs) Throughout
t h e C o u n t r y . A n inter-agency t a s k force ( T a s k F o r c e ) is h e r e b y c r e a t e d for t h e
establishment and support of D A T R C s throughout the country. T h e T a s k Force shall be
c o m p o s e d of the following m e m b e r s , or their duly appointed representatives:

S E C T I O N 2. A u t h o r i t y a n d F u n c t i o n s o f t h e T a s k F o r c e . Subject to existing laws,


rules and regulations, the T a s k Force shall have the following p o w e r s and functions:
a) D e t e r m i n e the type, capacity and suitable locations of the D A T R C s , taking into
consideration the n e e d of the localities a n d the accessibility a n d manageability of
facilities, w i t h t h e l o n g - t e r m g o a l of h a v i n g at least o n e D A T R C in e v e r y province.
S u c h determination shall also take into consideration the presence of duly
accredited private D A T R C s a n d the availability of c o m m u n i t y - b a s e d rehabilitation
p r o g r a m s ( C B R P s ) in t h e c o n c e r n e d localities;
b) Establish t h e n e e d e d D A T R C s a n d provide support for their operations, with
authority to call u p o n a n y depari:ment, b u r e a u , office, a g e n c y , or instrumentality o f
the government, including g o v e r n m e n t - o w n e d or -controlled corporations ( G O C C s ) ,
for assistance as the circumstances and exigencies m a y require;
c) In a c c o r d a n c e w i t h t h e p e r t i n e n t p r o v i s i o n s o f R A N o . 9 1 6 5 , a s a m e n d e d , a n d R A
N o . 7 1 6 0 , as a m e n d e d , enjoin t h e cooperation of L G U s in t h e establishment and
s u p p o r t o f t h e D A T R C s a n d in t h e i m p l e m e n t a t i o n o f C B R P s ;
d) S u b m i t a report w i t h r e c o m m e n d a t i o n s to t h e Office o f t h e President, within thirty
(30) d a y s f r o m effectivity of this E x e c u t i v e O r d e r a n d e v e r y six m o n t h s thereafter, o n
the implementation of the provisions herein;
e) Issue relevant guidelines for the effective implementation of this Executive Order;
and

P e r f o r m s u c h other functions provided in this E x e c u t i v e O r d e r a n d a s m a y


authorized or directed by t h e President.

S E C T I O N 3. E s t a b l i s h m e n t o f D A T R C s in Military R e s e r v a t i o n s . T o begin
a d d r e s s i n g t h e c o n g e s t i o n in existing D A T R C s , t h e T a s k F o r c e shall establish D A T R C s in
military reservations available for the purpose. T h e S e c r e t a r y of the D e p a r t m e n t of National
D e f e n s e a n d t h e C h i e f o f S t a f f of t h e A r m e d F o r c e s o f t h e Philippines shall sit a s additional

m e m b e r s o f t h e T a s k F o r c e w h e n e v e r t h e s a m e will t a k e u p a n y m a t t e r involving D A T R C s
within military reservations.
S E C T I O N 4 . M e m o r a n d a o f A g r e e m e n t ( M O A ) . W h e n e v e r n e c e s s a r y t o facilitate t h e
establishment o f D A T R C s including t h o s e i n military reservations, t h e T a s k Force shall
oversee t h eexecution o f appropriate M O A s between o r a m o n g concerned agencies. T h e s e
M O A s shall delineate t h e respective duties a n d obligations o f such agencies in accordance
with pertinent laws, rules a n d regulations.
S E C T I O N 5 . O p e r a t i o n o f D A T R C s . T h e D O H shall operate, maintain a n d m a n a g e the
D A T R C s t o b e established pursuant t o this Executive Order, including t h o s e i n military
reservations. In t h e performance o f such functions, t h e D O H shall coordinate with other
concerned agencies a n d e n c o u r a g e t h e participation o f t h e private sector, n o n - g o v e r n m e n t
o r g a n i z a t i o n s a n d faith c o m m u n i t i e s . T h e T a s k F o r c e shall provide full support t o D O H f o r t h e
effective performance o f such mandate.
S E C T I O N 6. S u p p o r t o f G o v e r n m e n t Agencies. All departments, agencies a n d
instrumentalities o f t h e government, including G O C C s , a r e encouraged t o provide t h e support
a n d assistance required i n t h e implementation o f this Order.
S E C T I O N 7 . F u n d i n g . T h e initial a m o u n t n e c e s s a r y f o r t h e i m p l e m e n t a t i o n o f this
Executive Order shall b e sourced from t h e appropriations o f the m e m b e r s o f the T a s k Force
and other applicable funding sources, subject t o pertinent laws, rules a n d regulations. F o r t h e
succeeding fiscal years, t h e budgetary requirement f o r t h e implementation o f this Executive
Order shall b e incorporated in the budget proposals o f t h e concerned agencies.
Each department a n d agency represented in t h e T a s k Force m a y receive donations
and other forms of assistance in accordance with applicable laws a n d issuances, for
purposes relevant t o t h e i m p l e m e n t a t i o n o f this Executive Order, provided that t h e utilization
thereof shall b e coordinated through the T a s k Force.
S E C T I O N 8 . S e p a r a b i l i t y . If a n y p r o v i s i o n o f this E x e c u t i v e O r d e r i s d e c l a r e d invalid
or unconstitutional, t h e other provisions n o t affected thereby shall remain valid a n d
subsisting.
S E C T I O N 9 . R e p e a l . A l l orders, rules a n d regulations, issuances o r a n y part thereof
inconsistent with t h e provisions o f this Executive Order a r e hereby repealed, a m e n d e d o r
modified accordingly.
S E C T I O N 10. E f f e c t i v i t y . T h i s O r d e r s h a l l t a k e e f f e c t i m m e d i a t e l y u p o n p u b l i c a t i o n i n
a n e w s p a p e r o f general circulation.
