SUPERINTENDENT'S CONTRACT.
STATE OF NORTH CAROLINA
COUNTY OF AVERY
‘THIS AGREEMENT is made and entre into a8 of 6 day of June, 2011, by and
between THE AVERY COUNTY BOARD OF EDUCATION, (hereinafter called the
Board") and DAVED CLAY BURLESON, (herenafer called the Superintendent"
“The Board andthe Superintendent, for and in consideration ofthe covenants and
agreements contained in this Contset and other good and valuable consideration, contract and
agree as follows:
1. Employment, Term, Residence and Oath of Office
“The Board hereby employs the Superintendent andthe Superintendent does hereby
accept employment as Superintendent ofthe Schools of the Avery County School
Administrative Unit for aterm beginning July 11,2011, and ending une 30,2015. The
Superintendent sal reside in Avery County, North Carolina, The Supetintendent shal take
the oath of ofice required by N.C, Gen Sat. § 11SC-272 before assuming the duties of|
Superintendent
2, Professional Certification
“The Superintendent shall quality for and obtain prior tothe beginaing ofthe term of his
employment and shall maintain throughout the term of his employment a valid and appropriate
certificate to act as Superintendent as prescribed by the aus ofthe State of North Caofina
andthe regulations ofthe North Carolina State Board of Education (hereinafter called the
state Board”
3. Duties
(cs-o9m60 RIF)‘The Superintendent shall perform such educational duties as may be prescribed bythe
Board fom time wo time, including, but not limited to, the dues of Superintendent of Schoots
in the Avery County School Administrative Unit and ex-officio secretary ofthe Board as
prescribed now and fom ime o time during the term ofthis Contact by sate and federal
laws, rules and regulations. Without limiting the generality of the foregoing the
Superintendent shall be the chief executive officer ofthe Board and shall be responsible forall
student afar, instructional and curriculum afar, employment afi, sal afirs, nd
‘business afr, subject o those powers which are reserved f the Board by law, board policy,
orboard decision. The Superintendent shall direct and assign teachers and ther employees of
the schools under his supervision; hall organize, re-rgonze, end arrange the administrative
and supervisory staf, including instucton and business afr, as he deems in he best
interest ofthe Avery County School System; shall select ll personnel subject to approval of
the Board of Education; shal ave the authority to accept resignations of personel, for and on
‘behalf ofthe Board of Education; and in general perform all utes incident woth office of
Superintendent as provided by law including but not limited to, those duties moce particularly
described by N.C. Gen, Stl § 115C-276, The Board individually and collectively shall
promptly refer ll rtcisms, complaints, and suggestions called to it attention io the
Superintendent for tudy and recommendation. Individual Board members shall fain from
interference with he administration of schoo! polices except through Board actin
4. Compensation
“The Board shall compensate the Superintendent for service by paying the
Superintendent an annual salary of One Hundred Twenty-Seven Thousand and No/LOO
($127,000.00) tobe paid from State and local funds, This amount shall include the advanced
