Today's meeting with them was extremely positive. It was a breath of ftesh air to see how serious your office is taking these allegations in regards to the eleven missing firearms from the Miami Police Property Unit. After meeting with your team, it was brought to my attention that the agency in which I am employed by has not requested for FDLE to take over the missing firearms investigation. On behalf of the Fraternal Order of Police which is the exclusive bargaining unit for the Miami Police Department, we request the following: ‘© The missing firearms investigation is taken over by the Florida Department of Law Enforcement, preferably out of their Tallahassee office. The FOP does not want anyone to say that a retired Miami Police member that is now employed by FDLE locally affected the outcome of the case. ‘© We request for a full audit of the Miami Police Property room to be performed by the Florida Department of Law Enforcement. Miami, Florida 33130 Phone (305) 854-5019 Ortiz@fopmiami.com Javier Ortiz Max Valdes PRESIDENT SECRETARY December 13, 2016 City of Miami Commissioners 3500 Pan American Drive Miami, Florida 33133 Sent Via Email Re: Concems of the Fraternal Order of Police Regarding City Management Dear Honorable Commissioners: Last Friday, the FOP has requested for an internal affairs investigation that is being conducted regarding the eleven missing firearms from the Miami Police Property Unit to be taken over by the Miami-Dade State Attorneys Office. The following day, the Miami Herald apparently got a hold of our letter and wrote a story on it, Several hours later on that Saturday under the cover of darkness, a second incident occurred at the Miemi Police Department's Property Section. I was requested to respond and from headquarters, I drafted a second letter to the State Attorneys Office which was published today by a local blogger. | have never seen such disrespect in violation of our core values by members of the department, It is some of the most unethical behavior that I've ever seen. Sergeant Forbes who is African American was used as a scapegoat and was improperly transferred for saying the truth. The City Manager will now attempt to save face and state that they support an outside agency to investigate the missing firearms from the property unit by sending a CYA email Saturday night to the commission, as shown on a local blogger's website. As of this moment, the only request that has been made officially is by the Fraternal Order of Police. He states he has concems of the activities that occurred Saturday night. If he is s0 concemed, please answer these questions: © Why hasn't the City Manager taken any action? * Why hasn't the City Manager suspended or cancelled the "movie" contract between the City of Miami and Orestes Chavez, who is a suspect in the missing firearms investigation? ‘* Why hasn't the City Manager ordered for this individual to not have ANY access on City of Miami property during the investigation? If you're retired or active and eleven firearms go missing, why wouldn't the City Manager not take immediate action to protect the City of Miami? We aren't talking about eleven missing sheets of paper. We are talking about eleven firearms that no matter how old they are, can kill innocent people in our community. Besides the poor decisions of how this investigation is being handled regarding the missing firearms, he hhas no respect for due process of city employees. If you ask our counterpart that represents our civilian employees which is AFSCME, here are some of the employees that have been affected by his poor decisions (according to AFSCME): © Tammy Heard (African American female)- Won her job back and had a restoration of benefits after being unjustly disciplined by the City Manager. * Christopher Smith (African American female)- After being suspended for ten months, he finally got his job back after being unjustly disciplined by the City Manager. Tiewan Allison (African American female)- Terminated for cause that a video proves otherwise. Erika Cook (African American female)- Had her 45 day suspension reversed after going through the arbitration process. ‘© Shenna Cooley (African American female)» She was terminated unjustly and restored through arbitration. The abuse doesn't stop there. The Fratemal Order of Police is in the process of filing an unfair labor practice with the State of Florida, Public Employee Relations Commission for the unfair treatment of another African Ametican thet was wrongfully terminated by the City Manager. Two years after serving a 40 hour suspension, Officer Larry Hagan’s case went in front of the Civil Service Board. The City Manager didn't like the way the Officer spoke when he appealed his case (the officer didn't use profanities nor was he disrespectful) and fired him.,. He fired him two years after serving a 40 hour suspension, The FOP took his case to court and successfully won due to the abuse by the City Manager who doesn't believe in due process. The City Manager filed an emergency stay during the appeal in order to keep this police officer unemployed. Another African American employee, Officer Jean Phillipe was elso denied due process, The manager disregarded well established and long standing case law that says a tie vote by the civil service board is the same as not guilty because city failed to prove its case. The City Manager ignored the law and found Phillipe guilty and upheld his 80 hour suspension, Under our current police administration, the FOP has successfully overturned every single termination ‘case at arbitration. That should tell you something. We ask the City of Miami Commission to take note of the unjust actions that are affecting our sworn membership of the Fratemal Order of Police. Our executive board today has directed me to inform the commission that we are in full support of having a new City Manager.
