RECOMMENDED LIST OF REGULATIONS TO REMOVE

 Executive Order - Waive Requirements
of Davis Bacon Act
The DavisBacon Act of 1931 is
a United States federal law that
establishes the requirement for
paying the local prevailing wages on
public works projects for laborers and
mechanics. It applies to "contractors
and subcontractors performing on
federally funded or assisted contracts
in excess of $2,000 for the construction,
alteration, or repair (including painting
and decorating) of public buildings
or public works". The act has been
s spended fi e times
residents

Significant changes in
economic conditions, and
the economic character
of the construction
industry since 1931, plus
the passage of other
wage laws, make the act
unnecessary. After nearly
50 years, the Department
of Labor has not developed
an effective program
to issue and maintain
current and accurate wage
determinations; it may
be impractical to ever
do so. The act results in
unnecessary construction
and administrative costs
of several hundred million
dollars annually (if the
construction projects
reviewed by GAO are
representative) and has
an in ationar effect on
the areas covered by
inaccurate wage rates and
the economy as a whole.

requiring the registration of all small
unmanned aircraft systems (UAS),

more than 0.55 lbs (CEI comments

volume of small UAS in the U.S.
posed an imminent safety hazard.
Never mind that many of the small
UAS covered by the IFR are harmless
toys. Never mind that most have
battery lives of less than 20 minutes.
Never mind that most are made with
lightweight materials such as plastic
and foam that pose few hazards even
in catastrophic failure. And never mind
that most cannot

Treatment of Certain Interests in

10/21/2016

IRS estimates a
compliance cost increase
of approximately $56
million or an average of
00 per firm in 2016
dollars.

The IRS is aware that many domestic

corporations take advantage of the
so-called earnings stripping rule
to minimize U.S. taxes by paying
deductible interest to a related
foreign affiliate located in a low
tax jurisdiction. This is a scheme
commonly used to strip a U.S. entity
of its taxable base and siphon off
profit o tside the co ntr
wa of
interest deduction (rather than as a
nondeductible dividend payment).
The 385 Regulations intend to close
this loophole. The 385 Regulations
restrict the ability of a corporate
entity to erode earnings by treating
financial instr ments which look to e
debt at face-value as equity if certain
conditions are not met Specificall
the regulations now require that
corporations claiming interest
deductions on related-party loans
provide documentation regarding the
loan transaction similar to what is
commonly required in an unrelated
loan transaction.

The proposed regulations concern the

valuation of interests in corporations
and partnerships for estate, gift, and
generation-skipping transfer (GST) tax
purposes. The estate tax is not just
immoral and economically harmful, it
fails to raise a significant mone for
the government, or at most it raises a
trivial amount.

All regulations carry

costs, which are inevitably
passed on to consumers
in one form or another.

One of the most controversial rules

an agency has promulgated during the
Obama administration arguably ran
afoul of the APAs notice-and-comment
process: the Federal Communications
Commissions network neutrality
regulation, which the FCC proposed
in Ma 2014 and finali ed in March
2015. When the agency proposed
this rule, it indicated that it planned
to rely on rely on section 706 of the
Telecommunications Act of 1996in
accordance with what FCC Chairman
Tom Wheeler described as the
roadmap offered by the D.C. Circuits
2014 opinion in Verizon v. FCC, which
invalidated a 2010 rule issued by the
agency in the name of net neutrality.
At 400 pages and over 2,500 citations,
the network neutrality regulations
packs in a lot The reg lations re ect
the lack of economic rigor, and will
thus have an impact far greater than
envisioned in the current plan.
