On the 18" day of December 2016, at approximately 10:39 pm, a 911 call was received from Pontrey O'neal Simon advising that his wife had been stabbed. Austin Police Department patrol Officers responded to a call of Shoot/Stab hot shot at 2713 $ Congress Ave. #1305, Austin, Travis County Texas, discovering Simon’s wife, Magdalena Ruiz H/F bor 12/09/1981, henceforth referred to as “victim”, suffering from multiple stab wounds inside the residence. The victim was transported to South Austin Hospital and pronounced deceased at 11:15 pm. Affiant learned that Patrol Officers located 911 caller Pontrey O'neal Simon inside the residence and learned that Simon and the victim were watching television this night along with Simon’s son, Pontrey O'neal Jones B/M DOB = According to Simon, Jones was seen pacing in front of him and the victim as both Tounged on their couch in the living room, According to Simon, for reasons unknown, Jones walked behind them positioning himself behind their seated position. Moments later, Simon advised Jones lunged over the victim’body, striking her several times in the chest. Immediately following, Simon learned that Jones had stabbed the victim multiple times with an unknown object and Simon physically struggled with Jones in the living room. Following the stabbing, Jones fled the residence on foot. Fire Department Engine 6 responded to this incident and staged in the 2400 block of S. Goris Ave. awaiting clearance from law enforcement. At approximately 10:48 pm members of Engine-6 observed .a Black male disrobing in the street and requesting law-enforcement to.--- respond. This incident is documented in Austin Police CAD report 163531591, ded to 2424 S. Congress Ave. and located a detained, mirandized and secured the male inside a patrol vehicle. Affiant learned that additional Patrol Officers respon Black male, nude and Lying in the grass. Patrol Officers Affiant learned that patrol personnel spoke Wi and learned he had disrobed after fleeing his apartment. The rea Jones was identified as the son of Pontrey O'neal Simon. scarded of any additional'items to lice ~~~Affiant leamed that Patrol Officers inquired if Jones had dis which Jones advised he was also in possession of a knife which was hidden prior to po arrival. Jones refused to disclose its location, Affiant spoke with patrol Officer Conner 7766 and learned Conner spoke with Jones and Jearned that Jones advised he left “the apartments ” and identified the found clothing as his own. Jones told Conner he was in possession of @ knife but would only state it was hidden. At one point, Jones told Conner “he left itn her chest” and concluded that the knife was thrown on top of a nearby Auto Zone business. Affiant interviewed Pontrey O'neal Simon at Austin Police Headquarters and learned that Jones was recently deemed homeless and took up residency with Simon and the victim several weeks prior. Simon and the victim are also the parents of three young children who reside in the home. Simon reiterated his prior account with on scene patrol by stating, for reasons unknown, Jones stood behind the victim and stabbed her multiple times in the chest and torso. Immediately following the assault, Simon grabbed Jones about the throat before Simon realized the victim was seriously injured, Simon then released Jones who fled the residence on foot while Simon notified Austin-Travis County 911 ‘Simon advised that Jones suffers from an unknown mental illness and has refused to take prescribed medications for a number of years. Pontrey O'neal Jones was transported to Austin Police Headquarters to be formally interviewed. Affiant mirandized Jones who advised he understood such rights and agreed to be questioned. Jones advised he planned on joining the military, yet the pressure was getting too high and his siblings were “disappointed”. Jones advised he has been diagnosed with Bipolar Disorder and ~— stopped taking his prescribed medications two years ago, Jones alleged the medications would _ “slow him down”. In regards to December 18" 2016, Jones advised earlier this date he made the decision to “break his little sister's neck”, yet changed his mind as the day progressed. Following, Jones advised he “developed a plan against the victim” and retrieved a black handled knife from the kitchen washing machine. Jones advised he placed the knife underneath the living room couch for later use. Jones confirmed prior accounts that Simon and the victim were seated on a couch that evening in the living room and watching the Dallas Cowboys football game ) Jones advised he observed Simon and the victim as they watched television and walked outside several times to-“get fresh air” before returning to the residence:~WUpon return; Jones advised he" ~~ noticed how the victim was “disrespecting his father and gloating about how the Cowboys won the game”. Shortly thereafter, Jones advised he obtained the hidden knife, positioned himself behind the ~“ictim and made several overhand strikes to the victim’ chest, stabbing her multiple times. Following the assault, Jones advised he dropped the knife on the living room floor near the Couch. Jones further described the knife as one commonly used to eat with When informed the victim was deceased, Jones appeared relieved and advised he stabbed the victim multiple times under the belief that a single stab wound would fail to render death. Jones concluded that he assaulted the victim with the sole intent of killing her. ~Affiant authored a search warrant for 2713 8. Congress Ave #1305 which was approved and executed. During processing, red stains consistent with blood were found on a couch cushion and throw pillow. Furthermore, a black handled steak knife was located on the living room floor beneath a strewn blanket. This knife matched the description of the murder weapon provided by Jones. ‘was conducted at the Travis County Medical The postmortem examination of the vict Examiner's Office by Deputy Medical Examiner Dr. Katherine Callahan, Evidence of injury included stab wounds and lacerations of the chest and rib cage. It is the opinion of Dr. Callahan, based upon the investigation of the circumstances and autopsy findings, that the manner of death was Homicide. Affiant believes that there is sufficient probable cause to support the charge of MURDER including, but not limited to, witness interviews, admissions by Pontrey O'neal Jones, evidence gathered at the crime scene as well as documents obtained from the Travis County Medical Examiner's Office.
