EventhoughIndustrialDisputesAct1947(IDAct)hasjust40sections,itsinterpretation
andunderstandingisquitecomplex.OfallthechaptersintheActtheinterpretationof
Chapter5Aand5B(mentionedintheActaschapterVAandVB)isthemost
challenging.

anynumberofworkersforanynumberofdays.
6)Factories,plantationsandminesemployinglessthan50workerscangivelayoffto
workerswithoutpayingcompensationtoanynumberofworkersforanynumberof
days.
7)Workerswhohavenotrenderedatleastoneyearcontinuousservicecanbegiven
layoffwithoutcompensationtoanynumberofworkersforanynumberofdays.
8)Workersinotherorganizations(otherthanfactory,mineorplantation)likeshops,
commercialestablishments,(retailmalls,IT,BPO)ortransportundertakingscanbe
givenlayoffwithoutcompensationtoanynumberofworkersforanynumberofdays
irrespectiveofthesizeofworkforce.

undertakingsandsoon.
10)Underthesesectionsretrenchmentofworkmen,andclosureofestablishments

chapter5B)canbedonewithoutgovernmentpermission.
11)Onlynoticeandcompensationistobegiventotheaffectedworkmen.
12)Onemonthadvancenoticeorpayinlieuofnoticeandcompensationattherateof
15dayspay(basicpayanddearnessallowance)foreverycompletedyearofserviceto
begiventoalltheeligibleworkersaffectedbyretrenchment/closure.
13)Incaseofclosuretheemployershouldalsogive60daysadvancenotice(andnot
applicationforpermission)tothegovernment.
14)Noticetogovernmentisnotrequirediftheestablishmenttobeclosedhaslessthan
50workersorisaconstructionindustry.

15)Inotherwordsprovisionsofthischapterrelatingtoretrenchmentandclosureare
applicabletoalltheestablishments,irrespectiveofthenatureofbusinessandsizeof
workforce(exceptthefactories,minesandplantationsemployingmorethan100
workmenwhoaregovernedbychapter5B).

Sir, a small correction is Chapter V-A (ref : Sec 25-A ) applicable to Industrial Establishments in which
less than Fiy workmen on an average per working day. But V-B is applicable( as per Sec 25-K) for an
industrail establishment in which not less than 100 workmen. There is no other provision in ID Act if 5199 Employees are there. However, in the Act it is there if any ambiguity Appropriate Govt. can take
decision on it. Request your opinion as well if procedure available for 51 -99 Employees Organization.

Dear Sir, I want to know one thing in ID Act that the serial number of workmen should not break in
muster roll in next month....for example.....10 workmen joined in my 2016 serial number accordingly 1
to 10.....now i am preparing june month muster and i don't know in june month who is going to be
present then how can i mention the name in sequence....yes new joinee shall be in sequence as they
join......so you are requested focus me on this point sir...although they are workers of construction
company...no one knows when they come and when they go.......
