GENERAL TERMS AND CONDITIONS

1. SUBMISSION OF BID:

The sealed bid addressed to Manager Contracts shall be dropped in the Red strip Tender Box No.3
lying at ABC Reception.
The envelope shall indicate the name and address of the Bidder to enable the bids to be returned
unopened incase it is declared Late. ABC reserves the right to accept or reject any bid without
assigning any reason.

2. BID VALIDITY:

The bid shall remain valid for 60 calendar days after the date of bid opening, prescribed by ABC. A bid
valid for a shorter period may be rejected by ABC as non-responsive.

3. COMPLIANCE WITH TENDER DOCUMENTS:

The prospective Bidders should carefully study the tender documents and instructions and comply with
all requirements including for preparation of Bids. Failure to furnish any information required by the
tender documents or submission of Bid not responsive to the tender documents in any respect will be at
the Bidders risk and may result in the rejection of the Bid.

4. EARNEST MONEY: -

The bidder shall furnish, as part of its bid, a pay order in the amount of Rs.2 % in favour of Abc
Limited. The earnest money shall be returned to the unsuccessful bidders after issuance of work order
to successful bidder whereas the earnest money of successful bidder shall be returned after receiving
the first bill.

5. PAYMENT SCHEDULE:

The contractor shall be paid individual job bills, after completion of entire job. Payment will be made
after deducting income tax and the retention money. (as per clauses 7 & 8 of General Terms and
Conditions)

6. WARRANTY:

The contractor warrants that the work carried out under the Contract shall have no defects arising from
materials or workmanship that may develop under normal use. This warranty shall remain valid for 06
months after the work completion. The ABC shall promptly notify the Contractor in writing of any
claims arising under this warranty.

Upon receipt of such notice, the Contractor shall repair or replace the defective work or parts thereof,
with out any extra cost to ABC.
If the Contractor, having been notified, fails to arrange remedy the defect(s) within a reasonable
period, ABC shall get the defects rectified through other sources at the risk and cost of the contractor.

7. RETENTION MONEY:

10% of the bill amount will be deducted from the each individual bill as retention money, which will be
released after the successful completion of the warranty period.

8. TAXES & DUTIES:

The Contractor shall be entirely responsible for all taxes, stamp duties, license fees and other such
levies imposed inside Pakistan. The income tax will be deducted as per prevailing rules.

9. COMPLETION SCHEDULE OF WORKS:

The entire work shall be carried out and completed within the period mentioned on cover page of the
Bid Document.

10. CONTRACTORS OBLIGATIONS:

Contractor shall arrange security clearance by Police Verification for all its employees those
who will work at site.
The contractor must depute one competent supervisor having sufficient experience of similar
works to promptly set up the work and execute any instruction given, or remove and rectify any
defect pointed out by Job coordinator. The supervisor will also responsible to deal with the
requirements of work permits /gate passes and necessary approvals etc, from the concerned
departments.
Contractor shall arrange all kinds of manpower, tools, equipments, goods, machinery, and safety
gadgets, scaffolding for the successful and safe execution of the contract.
Contractor will take all cares while executing work. In case of any damage to the any property,
it will be rectified at his entire risk and cost.
The Contractor shall be responsible for making approach to the site of work as required for
delivery of all kinds of material, etc .No extra payment shall be payable on this account whether
seen or unforeseen.
Work force to be employed at job site shall be in possession of Original CNIC and valid driving
license for drivers, etc.
Contractor is also required to obtain prior approvals for all materials and accessories to be
supplied and other related work activities from the Job Coordinator.
The contractor shall be responsible for the disposal of all types of construction material and
debris etc, as per instruction of job coordinator.

11. PRICE ESCALATION:


It should be clearly understood by the contractor that no claim or demand for increase of rates already
quoted shall be entertained on the ground of market fluctuation or for any other reason during the
currency of this contract.

12. VARIATIONS:

All items included in the BOQ are estimated and ABC reserves the right to increase or decrease the
quantity of work or to change or modify any item of work, however the contractor will be paid on the
basis of actual work done at the site.
The contractor shall carry out no extra work or additional item of work without written instructions
from job coordinator and his decision shall be final and binding on the contractor regarding
clarification of items in the BOQ with respect to the other sections of the Work Order.

13. COMPLIANCE WITH SAFETY / SECURITY RULES / REGULATIONS:

The contractor shall comply with all laws, rules, notifications and standing instructions issued by the
ABC Safety/Operations departments and shall make all safety measures and appropriate arrangements
for safety of man and materials in carrying out the work.

The contractor should provide safety shoes, safety helmets, coveralls, industrial hand gloves and other
personnel protective equipments like goggles, dust masks etc, to their work force while working at the
Refinery.

The contractor while bringing their equipments / machines, vehicle for any job / purpose should ensure
that these are fit to use and free from any leakage, contractors vehicles moving inside refinery should
have proper spark / flame-arrestor at the exhaust silencer.
