never mind my self-professed crummy English (as English is not my native language) as
15 what is important is what I am writing about and how to try to avoid any repeat of a carnage, let
alone a repeat that may affect thousands.
In view where I specifically warned politicians including Prime Minister Mr Malcolm Turnbull
and Premier Mr Daniel Andrews in my 15 July 2016 PRESS RELEASE (besides others about
20 the same) about my understanding Bourke Street Mall being a target for people wanting to
kill as many people as possible and even recommended buffers/bollard to be installed yet no
appropriate action was forthcoming which could have in my view avoided the carnage that
eventuated in Bourke Street now the subject of a coronial inquiry, then I view it appropriate to
make my submission.
25 Due to the extent of matters I covered this submission will be of some length to include relevant
details, albeit a long history of my writings will not be included as to similar Bourke Street
warnings, but could be provided on request.

crimes, etc in Iraq and well nothing was done to hold them legally accountable. Little
40 wonder that there are elements who then hold it they will pursue their reign of terror in
response. Politicians will tell people to go on normally, while they DONT because they
are hiding behind a curtain of security so that they are safe and let the innocent citizen
suffer the horrors inflicted upon them. Politicians are the cowards who claimed to make
the world a safer place while in fact making it far worse.

Australia, and regretfully this is possible. Take Bourke Street, Melbourne, where it is a
pedestrian mall but the trams are going through it and so delivery vans/trucks. Instead of
warmongering politicians hiding behind a security curtain the monies of this security
curtain would be better spend such as road buffers to be fitted into the ground. For
5 example to prevent a truck to enter a mall using the tram tracks a heavy duty buffer is
coming up after a tram has passed through preventing any vehicle to enter using the tram
tack. This steel buffer can be raised and lowered into the ground as to allow safe passage
for trams and emergency vehicles but not for other vehicles unless someone with security
clearance were to manually let the buffer to sink into the ground for any delivery vehicle to
10 enter. It means that in times of public celebrations those buffers can be raised above ground
and so become a security for those celeb rating in the area. Such kind of devices could be
fitted on any road where at times it requires to be closed of regarding sporting events,
parades, etc. A proper system would facilitate such buffers to prevent motorist to use tram
tracks while the tram can engage the buffer to be lowered when it comes nearby so the tram
15 can pass through. This is the kind of security system that should exist at the very least. To
expect a police officer facing a truck coming towards him to stop it is lunacy. There must
be a system of buffer that can be sufficient to stop a heavy truck in its tracks and prevent
what eventuated in Nice to eventuate in Australia. Instead of having bollard or other
material transported to and from the area, by building buffers that can drop down into the
20 ground when not needed or obstructing otherwise a tram from passing, this would be a far
better manner. I understand that in some countries they use massive kind of buffers to
redirect the sea flow to avoid floodings. The shape is like that of a sliced of an orange
hinging at the thinner edge. Also, we had this media report that some person allegedly
heavily involve in preaching jihad or at least promoting issue to it nevertheless continue
25 to do so. I view that any person doing so should be deemed to place national security of
citizens at risk and by this should be charged accordingly.

failing to make sure the area was protected. As I understand it Mayor Robert Doyle reportedly made known
that the driver was going to drive into Collin Street (to his observation) but faced with a bollard decided to

I have absolutely no doubt that lawyers for the victims will likely question why didnt the
Governments act to secure areas like Bourke Street with bollards, etc.

excuse for not providing security that could at a minimal cost have been provided! To the victims
is doesnt matter if the offender is mentally ill or just pursues terrorism for an alleged religious

Legal Aid while the victims have generally no such rights. Little wonder crime is getting out of

20 There are a number of European cities that as part of their urban security, use steel
and reinforced concrete bollards and barriers in front of, and around certain
government and public buildings. Melbourne's CBD uses steel bollards to prevent
vehicles entering numerous one-way streets, alleys and restricted parking and public
areas. I have observed many bank ATMs and certain small businesses (jewellery
25 shops, chemists, alcohol/liquor stores etc.) use steel bollards to deter criminals
performing ram-raids through their front entrances and display windows.
In view of the Nice event your idea to have security bollards and barriers installed
throughout Melbourne in strategic locations vulnerable to terrorist attacks, should be
30 taken seriously by the state government. Politicians are often complacent and are
forced to act in the public interest only after a major tragedy or catastrophe has
occurred.
I doubt a lawsuit would succeed against any state or federal government or individual
35 MP for complicity or liability in mass murder, crimes against humanity, war crimes,
etc. by the grieving families of victims. You know as well as I do the corrupt judiciary
will protect their corrupt political masters, not to mention the high degree of difficulty
in proving an individual MP was somehow involved or responsible for any particular act
of terrorism.

Constitutionally, the Prime Minister has no say, as it is the Governor-General who decides
matters to declare war or peace on behalf of the Crown, and the Minister of Defence then is the
responsible Minister who acts within the authority provided. It would therefore be utterly and
totally absurd that where I oppose such kind of mass murder upon innocent people I somehow
20 could nevertheless be forced to vote in a manner as to show a preferences that might in fact end
up having my vote counted for a war mongering person. It would be contrary to the very
POLITICAL FREEDOMS the Framers of the Constitution provided for. Members of Parliament
themselves maintain a right to abstain from voting or not even turn up for voting, and consider
this to be their right, and hardly could this right be any less for ordinary electors.

not heard his 3AW comments but I doubt he was honest about his own miserable failure to act

I have indicated to Melbournes Lord Mayor Mr Robert Doyle that I contemplate to provide a
submission to the coroner. It seems to me that Prime minister Malcolm Turnbull and Premier
Daniel Andrews would do better to at my convenience have a meeting (with me) and so also with
Melbournes Lord Mayor Mr Robert Doyle being present to discuss relevant issues.
I have absolutely no doubt that in time the victims lawyers will demand answers as to why
20 Prime Minister Malcolm Turnbull and Premier Daniel Andrews failed to act upon my specific
warnings about Bourke Street Mall lack of appropriate safety measures, and I doubt you desire to
be the next in line for criticism, etc. Just keep in mind that a next time an incident were to occur
the casualty rate could be if not in the thousands then hundreds. To some people collateral
damage is acceptable after all we hear politicians often referring to this to try to excuse their
25 warmongering causing the death of innocent people in foreign countries.
Considering I reside at Viewbank (Banyule City) it seems to me a Melbourne meeting would be
desirable. I prefer communication otherwise to be via email, this, as my mobile is only used for
text messages. As I am a senior citizen I am not restrained by work commitments to attend a
30 meeting, albeit prefers to avoid any early morning meetings due to family circumstances. Due to
the parking problems I am willing to accept alternative transport being offered to and from the
meeting place. So to say you reap what you sow!

Let us be clear about it so far 5 people have died and we cannot ignore this! Just wait till the lawyers
representing the victims and their families become aware about my 15 July 2016 PRESS RELEASE. I doubt

to try to excuse their warmongering causing the death of innocent people in foreign countries.
10 Considering I reside at Viewbank (Banyule City) it seems to me a Melbourne meeting would be desirable. I
prefer communication otherwise to be via email, this, as my mobile is only used for text messages. As I am a
senior citizen I am not restrained by work commitments to attend a meeting, albeit prefers to avoid any early
morning meetings due to family circumstances. Due to the parking problems I am willing to accept
alternative transport being offered to and from the meeting place. So to say you reap what you sow!

I share your concern and anger about what happened on that day. It is only human to ask how did this
happen? And why did this happen? These are questions that have to be answered. That's why the coroner
has been given extra support and assistance to conduct a coronial investigation that examines all matters
10 leading up to the tragedy including the conduct of police. This is the right and proper process to follow - to
get to the truth of the matter and make sure that any change that is needed is done properly. In addition
the Government has also set up an after hours bail and remand court and asked former Supreme Court
Judge and Director of Public Prosecutions, Justice the Honourable Paul Coghlan, to provide urgent advice to
Government about additional changes to Victorias bail system that will best manage risk and maximise

In terms of broader issues around community safety, we know that there is both pressure on our police, as
well as concern about the harm that violent offenders can cause in our communities. It is a challenge, and
one I have acknowledged from the start.

Police are doing an exceptional job but I know from my discussions with police officers and with victims of
crime that they need more help.
That's why the Government has responded with a comprehensive strategy to prevent, detect and disrupt
25 crime. The Community Safety Statement, released in December 2016, outlines the range of new
investments, powers, tools and capability that Victoria Police will be equipped with to stabilise the crime
rate and begin to reduce the level of harm being caused in the community. Central to the Community Safety
Statement is boosting of police numbers right across the state. In total, 3,135 additional frontline police,
including 415 specialist family violence officers, will be rolled out to respond to crime in our communities.
30 The first of the new police will be deployed shortly to respond to local crime issues and the increased
demand for police in growth areas. This is the biggest boost to front-line police in Victorias history, and its
crucial to dealing with the growing demand on police services.
The Community Safety Statement also outlines the changes the government has made to tackle youth
35 crime, violent offenders, high volume crime and recidivism. They include new penalties and sentencing, and
tougher bail conditions. These changes are part of the broader strategy which will stabilise and then turn
around the crime rate in Victoria

for the considerable amount of work they have provided to the community merely because they
could so to say be an easy target, merely because it may suit politicians.

this worker must seek the court to amend any orders to apply to a different worker. As such the
45 children Court shouldnt accept the nonsense no one is available and still place a child under
orders of DHS. As I did in about 1987 successfully complaining to the Ombudsman about the
inappropriate conditions that DHS itself had in caring for small children. Children who grow up
disregarded by DHS but so to say are generally merely a form of employment to the workers
then may likely learn to live a way of crime to survive. We need to pursue that politicians act
50 honourably and not abuse and misuse the system for their own personal financial gains, this as
children who hear about this likely grow up with a disrespect for law and order.

Most people may lack the knowledge to detect this and well while holding to have been
railroaded/shafted by the judiciary they cannot express this in a way people would
understand it, and so some then decide they desire to make a considerable statement when
committing suicide by murdering as many innocent people as they can as to ensure that the

making donuts?
Let is be clear about it, bollards/buffers can be placed without being very obvious. the
must however be able to stop say a 40 ton truck.

underneath it is strengthened, and no one would be the wiser. Likewise, small buildings
like a kiosk may hide buffers/bollards. As such visually it may not appear there are
bollards/buffers as they can be made to blend into the environment.

The moment a President can dictate a subsequent President what he can or cannot do would nullify any
election for a new President, this as a President could engage in agreements well aware that the President-
elect would not agree with this. In my view, the moment an election is held and a for a President then
referred to as President elect then in real terms the sitting president must act as a care-taking president in that
10 he must not engage in any agreements that he reasonably knows will conflict with his President-elect
intentions. As such, I view the President should consult and involve the President-elect in any matters
regarding which is to take place (wholly or partly) after the President-elect has taken office.
Where the government of the Day was well aware of the way candidate Donald Trump was expressing
15 himself during the election campaigns then it pushing ahead with an agreement with the Obama
Administration in disregard to the President-Elect Mr Donald J Trump must be deemed to have been a
deliberate disgraceful conduct to undermine the Trump presidency.
In my view President Trump therefore is entitled to disregard the entire agreement made knowingly against
20 his intentions.
The same with any State that seek to undermine President Trumps Administration to secure the Union for
legitimate citizens then President Trump in my view is permitted to use all lawful available means to seek
compliance by the states to Presidential executive orders.

As I understand it both in the USA and in Australia people are forced to have their children immunized or
faced denial of certain services. Including in Australia certain tax rebates, etc.
As such the Commonwealth (Union and/or Australia) proved to use means to force people to comply, this
30 even so the issue of immunization is not at all a federal issue.
I nearly lost my firstborn child due to immunization but uninformed at the time what the cause was I had my
other children immunized. I am not against immunization but hold the view that parents should be able to
make an informed decision and not be forced to do so by backdoor tactics to deny them certain entitled
35 funding.
As such the same ought to be considered with the states. I doubt however that lawyers considered it in this
manner.
40 While the Congress decides the laws that are to be enacted ultimately Congress is not going about governing
the Union but leaves it up to the President and his Administration to do so.
The congress being limited to grant any monies other than for federal purposes within the charter of the US
constitution and its Amendments then the President facing obstructive States must then seek to invoke lawful
45 means which will cause the States to honor (honour) the federal compact.
I understand that in Collector v. Day the courts held that federal police powers could be exercised to enforce
federal laws. (In Australia however the Framers of the Constitution held that federal laws should be enforced
through State local police, however this is generally ignored by the Commonwealth and federal police invade
50 homes, etc.
The District of Columbia is in a sense a quasi state when it comes to Article IV Section 2, and as such the
60 President is entitled to have any unlawful person to be extradited to him and/or held in detention by the
relevant state awaiting his further directions.
Amendment XVIII provides in part 2 concurrent powers for the Union and the states. In Australia s51 does
not specifically state concurrent powers but they exist only until the Commonwealth commences to legislate!
15 This however is ignored by the states. The Commonwealth fails to understand the severity of this.
What I therefore conclude is the question if any grant of monies to a state (for Federal Purposes) is left within
the Day to Day governance of the Government of the Day, being the Trump Administration and so if the
President then by executive order can prevent any further payments to any State which harbors against his
20 directions any person who should be or might be deported!
It cannot in my view be a constitutional issue if the President decides that future payments are to be made if a
particular States complies with federal directives that are within the powers of the Government of the Day.
25 It is clear that when it comes to aliens (undocumented persons, etc) then the Trump Administration has the
sole powers to enforce laws. If any grants to a State regarding federal issues are made subject to the State
cooperating with the legitimate power exercise of the Union then I view the courts may hold that this is a
legitimate federal exercise. I read some statements where lawyers argued that President Trump cannot apply
conditions as to the grants of monies to a State as this would violate Article X and would be to take over the
30 powers of Congress. In my view this would be an ill-conceived argument, where the congress merely set
rules within which the Administration is to operate and it may have left open for the Administration to apply
its own rules and guidelines.
While the constitution (as In Australia) demands that taxation shall be uniform, the Section 101 Inter-State
35 Commission in the Australian constitution however is not bound by this as to uniformly provide funding but
can do so considering expert reports what is in the interest of each state, etc.
If therefore the Congress provided this liberty to the Government of the Day then it may very well exercise its
powers to seek compliance by obstructive States rather than to use federal enforcement agencies such as
federal police to force compliance.

Considering Ex Parte Young - 209 U.S. 123 (1908) the better option might be for President Trump to
institute proceedings against the relevant State Attorney-Generals to comply with the requirement to reveal
details and provide the persons who are aliens in their states. And where a State fails to do so then the
relevant Attorney-General is placed before the courts to answer upon what lawful excuse the State fails to
45 comply and if not accepted the court then issue a directive against the Attorney-General to comply within a
certain period and failing to do so may result in his/her imprisonment for CONTEMPT OF COURT.
