During the interview Sergeant ‘Walling reported that she performed oral sex on Sergeant Vansteenburgh ‘on March 29, 2016, while he was on-duty as a Jupiter Police Department Sergeant, On November 10, 2016, Sergeant Walling was interviewed again as a witness/eomplainant. During this interview Sergeant Walling reported that she also performed oral sex on Sergeant Vansteenburgh while he was on on-duty as a Jupiter Police Sergeant on July 25, 2015, and Sergeant Vansteenburgh videotaped the incident on Sergeant Walling’s cellular telephone. Sergeant Walling produced a photograph that Sergeant Vansteenburgh took of himself while working an extra duty SWAT detail in April of 2015, In the photograph Sergeant Vansteenburgh is wearing an authorized Jupiter Police Department SWAT uniform with his penis exposed through the zipper area of his uniform pants. During the interview Sergeant Walling advised Major England end 1 that on Match 29, 2016, she performed oral sex on Sergeant Jason Vansteenburgh at his residence while he was on-duty as a Jupiter Police Depariment Sergeant, On June 23, 2016, Sergeant Walling reported that the only time she had sexual relations with Sergeant ‘Vensteenburgh while he was on-duty was on March 29, 2016. On November 10, 2016, Sergeant ‘Walling was interviewed again regarding the allegations she made on June 23, 2016, During the interview with Sergeant Walling on November 10, 2016, she now reported that she also performed oral sex on Sergeant Vansteenburgh on July 25, 2015, which would make 2 second time of performing oral sex on Sergeant Vansteenburgh while he was on-duty as a Jupiter Police Department Sergeant. On July 25, 2015, while Sergeant Walling was performing oral sex on Sergeant Vansteenburgh, he retrieved her cellular telephone and videotaped 23 seconds of Sergeant Walling performing oral sex on him. Sergeant Walling supplied Major England and La copy of the video fiom July 25, 2015, along with a text message conversation between Sergeant Walling and Sergeant Vansteenburgh. On November 10,2016, Sergeant Walling supplied Major England and I photograph of Sergeant ‘Vansteenburgh from April of 2015, On April 24, 2015, Sergeant Vansteenburgh was a team leader of the Jupiter Police Department SWAT Team and was working a special SWAT detail protecting a homicide suspect in room 343 at the Wyndham Hotel in Harbourside, On April 24, 2015, Amy Walling was a Jupiter Police Department Major assigned as the Commander of the Criminal Investigation Section and SWAT Team Commander. While working the SWAT detail Sergeant Vansteenburgh took a photograph of himself in the hotel room’s bathroom with his penis exposed while weating « Jupiter Police Department SWAT uniform, Sergeant ‘Vansteenburgh sent the photograph to then Major Amy Walling by text message, On December 14, 2016, Major England and I met with Sergeant Vansteenburgh to conduct @ subject officer interview of him regarding this internal affairs investigation. Prior to the interview beginning Sergeant Vansteenburgh’s attomey Suzanna Scarborough provided Major England and I three of the same photograph of Sergeant Walling, ‘The photograph was taken approximately two years ago when Amy Walling was a Police Major and Commander of the Criminal Investigations Section of the Jupiter Police Department. ‘The photograph shows Amy} Walling wearing Sergeant Vansteenburgh’s Cless “A” uniform shist with the front of the shirt wide open exposing her breasts. The photograph was taken at the Jupiter Police Department in Amy Walling’s office in the Criminal Investigation Seotion, Sergeant Amy Walling June 23, 2016 (Initial Com On Thursday, June 23, 2016, Major England and I met with Sergeant Amy Walling at the Jupiter Police Department regarding her subject officer interview for Internal Affairs Case Number 2016-002. During this interview Sergeant Welling was provided with and signed a Garrity ights form, and was provided a copy of the Law Enforcement Officers’ Bill of Rights, Mrs. Elizabeth Parker and Mr, Stuact Kaplan (attomeys from Kaplan, Soonzo, and Parker) accompanied Sergeant Walling during this interview. In summary, towanis the end of the interview Sergeant Walling reported that on March 29, 2016, she performed oral sex on Sergeant Vansteenburgh while he was on-duty as a Jupiter Police Department Sergeant. Sergeant Walling stated that the incident occurred at Serseant Vansteenburgh’s previous residence located at after 10:14PM. Mrs. Parker advised that Sergeant Walling located video evidence to support her allegations against Sergeant Vansteenburgh. On June 23, 2016, Sergeant Walling reported that she performed oral sex on Sergeant Vansteenburgh on March 29, 2016, while he was on duty as @ Jupiter Police Department Sergeant. During that interview on June 23, 2016, Sergeant Walling reported that the only time she had sexual relations with Sergeant Vansteenburgh while he was on-duty as « Jupiter law enforcement officer was on March 29, 2016, On'Thursday, November 10, 2016, Major England and I met with Sergeant Walling at the Jupiter Police Department regarding the allegations she made against Sergeant Vansteenburgh on June 23, 2016, A witness / complainant interview was conducted with Sergeant Walling, During the interview Sergeant Welling was represented by Mr, Stuart Kaplan and Mr, Joseph Scanzo (atiomeys from Kaplan, Sconzo, and Parker). In summary, Sergeant Walling reiterated ‘What she told us on June 23, 2016, and the sole purpose for meeting Sergeant Vansteenburgh at his residence on March 29, 2016, while he was on-duty, was to perform oral sex on him as they bad ¢ sexual conversation during dinner, During the interview I again asked Sergeant Walling if she ever had soxual relations with Sergeant Vansteenburgh on other occasions while he was on- duty, and she replied by saying “not that I recall.” Sergeant Walling then told me that on July 25, 2015, she performed oral sex on Sergeant Vansteenburgh a second tine while he was on- duty as a Jupiter Police Department Sergeant. On July 25, 2015, Sergeant Walling reported that she performed oral sex on Sergeant Vansteenburgh while he was on duty, and it occurred at her previous residence located at Sergeant Walling reported that on July 25, 2015, Sergeant Vansteenburgh picked up dinner for the both of them und brought it to her residence at the aforementioned address. SexgoantVansteenburgh arrived shorily after 8:30 PM and stayed with Sergeant Walling at her residence for approximately two hours without leaving. During that time, Sergeant Walling performed otal sex on Sergeant Vansteenburgh while he was on duty, Sergeant Walling advised us that while she was performing oral sex on Sergeant Vansteenburgh he intentionally picked up her cellular telephone and videotaped her performing oral sex on him. Sergeant Walling provided a copy of te video, which she located approximately ono week prior to November 9, 2016, The 23 second video was captured at 10:09 PM, and shows Sergeant Walling performing oral sex on who she states is Sergeant Vansteenburgh. ‘The video does not show Sergeant Vansteenburgh’s face, although his yoice is heard saying “oh shit am going to cum.” The video shows the bottom portion of a Jupiter Police Depariment uniform style shirt, and Sergeent Vansteenburgh’s left arm and hand. In the audio portion of the video a Jupiter Police Department radio is heard. Sergeant Walling confirmed that the two dates she alleged to have performed oral sex on Sergeant Vensteenburgh while he was on duty was July 25, 2015 and March 29, 2016. In the photograph, Sergeant Vansteenburgh is wearing a Jupiter Police Department external ballistic vest eattier, black shirt, green colored SWAT tactical pants, gun duty belt, and Jupiter Police Department SWAT ball cap, The picture shows Sergeant Vansteonburgh’s penis sticking out of the front zipper portion of his pants.In April 2015, Sergeant Vansteenburgh was a Team Leader of the Jupiter Police Department SWAT Team. Sergeant Walling was alleged to have violated Jupiter Police ‘Deparment General Orders relating to the following; Conduct Unbecoming an Officer / Employee, Neglect of Duty (Inattention to Duties/Procedures), and Duty to Report Misconduct, Sergeant Amy Walling Dece 2,2016 (Subject Officer Interview #1) On December 2, 2016, Major England and I met with Sergeant Walling at the Jupiter Police Department regarding this investigation, Sergeant Walling was provided with and signed a Garrity Rights Form, and provided with a copy of the Law Enforcement Officers’ Bill of Rights. Mrs, Elizabeth Parker (attorneys from Kaplan, Sconzo, and Parker) accompanied Sergeant Walling during this interview. Prior to being interviewed Sergeant Walling and Mrs. Parker \were provided with all ofthe statements and documentation regarding this internal affairs investigation. In summary, Sergeant Walling has worked for the Jupiter Police Department for twenty years, and has held the following ranks: officer, sergeant, captain, and major, In May of 2015, Amy Walling voluntarily requested to be demoted from the rank of Police Major to Police Sergeant, and the demotion was effective June 4, 2015. Sergeant Walling agceed that in her original interview on June 23, 2016, she stated that March 29, 2016, was the only time she performed oral on Sergeant Vansteenburgh while he was on duty sa Jupiter Police Department Sergeant. Sergeant Walling also agreed that on November 10, 2016, she also told us that she performed oral sex on Sergeant Vansteenburgh on July 25, 2015, while he was on duty as a Jupiter Police Department Sergeant, On July 25, 2015, Sergeant ‘Welling was assigned as a road patrol sergeant assigned to the Days 2 platoon, and her work hours were from 7:00 AM- 6:15 PM. I questioned Sergeant Walling about the text message conversation from July 25, 2015, between herself and Sergeant Vansteenburgh, reviewed the text message conversation with Sergeant Walling and she stated that the conversation related to food, worl and sexual activity.Sergeant Walling reported that on July 25, 2015, at 10:09 PM, she performed oral sex on Sergeant Vansteenburgh while he was on duty at her previous residence located at Sergeant Walling reported that on July 25, 2015, Sergeant Vanstecriburgh picked up dinner forthe both of them and brought it to her residence at the aforementioned address, Sergeant Vansteenburgh arrived shortly after 8:30 PM, and stayed with Sergeant Walling et her residence for approximately two honrs without leaving, Sergeant Walling reported that she was not planning on perforrning oral sex on Sergeant Vanstoenburgh since he wes on duty; although, she did perform oral sex on Sergeant Vansteenburgh while he was on duty, Sergeant Walling advised us that while she was performing oral sex on Sergeant ‘Vansteenburgh he intentionally picked up her cellular telephone and videotaped her performing oral sex on him, Sergeant Walling admitted that she knew that it wes a violation of Jupiter Department policy for ‘on duty personnel to having sexual relations, and could not provide an answer as to why she ‘performed oral sex to Sergeant Vansteenburgh while he was on duty. Sergeant Walling denied knowing at the time, that an officer could be decertified by the Flotida Department of Law Enforcement Criminal Justice Standards and Training Commission for having sexual relations while on duty, Sergeant Walling stated that she recently located the video on her cellular telephone, and that was the reason for the delay in bringing it forward. Sergeant Walling further explained that she reelized in her original statement that she stated that she only performed ore! sex on Sergeant Vansteenburgh on one occasion while he was on duty, and she wanted to “do the right thing.” Sergeant Walling further stated that “the truth is the truth, and honesty is honesty, and wanted to be honest.” Sergeant Walling advised us that she called her attorney and told her ‘that her “statement was inaccurate,” Sergeant Walling told us that on July 25, 2015, Sergeant Vansteenburgh did not perform any sexual acts on her while he was on duty; however, le may have touched her breasts or genital area as she was nude while performing oral sex on him, During the interview Sergeant Walling was questioned about the photograph of Sergeant Vanstecnbutgh that she provided to us on. November 10, 2016. Sergeant Welling stated that in April of 2015, she received a photograph by text message from Sergeant Vansteenburgh. ‘The photograph was taken in a hotel zoom bathroom at the Wyndham Harbourside Hotel located at 122 Soundings Avenue Jupiter, Florida 33477. The photograph shows Sergeant Vansteenburgh taking a picture of himself in his Jupiter Police Department SWAT uniform with his penis exposed. In the photograph, Sergeant Vansteenburgh is wearing a Jupiter Police Department extetnal ballistic vest carrier, black shirt, gieen colored SWAT teotical pants, gun duty belt, and a Jupiter Police Department SWAT ball cap. ‘The picture shows Sergeant Vansteenburgh’s penis sticking out of the front zipper portion of his pants. In April 2015, Sergeant Vansteenburgh was a road patrol sergeant and a member of the Jupiter Police Department SWAT Team, In April 2015, the Jupiter Police Department rented a hotel room at the Wyndham Hotel in Harbourside to provide protection for a homicide suspect, Asa SWAT Team momber Sergeant Vansteenburgh worked an extra duly SWAT detail to provide protection to the homicide suspect. When Sergeant Walling received this photograph from 10Sergeant Vansteenburgh in April of 2015, she was a Jupiter Police Department Major assigned as the Commander of the Criminal Investigations Section and as a collateral assignment was the ‘Commander of the Jupiter Police Department SWAT Team. ‘Asa Police Major, Sergeant Walling did not discipline Sergeant Vansteenburgh for taking a photograph of himself with his penis exposed while in a Jupiter Police Department SWAT ‘uniform, nor did she report the misconduct to Chief Kitzerow who was her immediate supervisor. Sergeant Walling stated that she did not do anything about the inappropriate conduct of Sergeant Vansteenburgh because she had a long work week of approximately 100 hours while ‘working e homicide case and was exhausted, Sergeant Walling further stated that “at the time they were in a personal relationship, and she saw it from being a personal relationship.” ‘Sergeant Walling explained that they were friends out of work and had a sexual relationship. Sergeant Walling further explained that as a supervisor it was not appropriate, and she should have come forward immediately and reported the photograph, Sergeant Walling admitted that she did not handle the situetion properly as « Police Mejor. Sergeant Walling acknowledged that it is not appropriate for a Police Sergeant and SWAT Team member to expose their genital area and take photographs of themselves while wearing a Jupiter Police Department uniform, Sergeant Walling stated that she brought the photograph forward on November 10, 2016, because she wanted to be truthful when Major England asked her if she had any other photographs or videos of Sergeant Vansteenburgh having sexual activities while on duly. ‘Towards the conclusion of our interview, Mrs. Parker requested to ask a few clarifying questions regarding the two dates (July 25, 2015, and March 29, 2016) that Sergeant Walling performed oral sex on Sergeant Vansteenburgh while he was on duty. Mrs, Parker then stated “are there in fact two separate incidents where you had sex or performed oral sex on Jason Vansteenburgh?” Sergeant Walling then replied to the question by stating “I can unequivocally say 100% there was one time that we had sex on duty, and that was July 25, 2015,” Sergeant Walling further stated “that is the only time I can say unequivocally that is the one time.” Sergeant Walling went con further to say that on March 29, 2016; she was at Sergeant Vansteenburgh’s house before he ‘went to work and she performed oral sex on him. Sergeant Vansteenburgh then put on his police uniform to go fo work, although he was not on duty at thet time, Tthen explained to Sergeant Walling that in her original statement on June 23, 2016 and on November 10, 2016, she stated that on March 29, 2016, she performed oral sex on Sergeant ‘Vansteenburgh at his residence while he was on duty. Sergeant Walling replied by saying “I cid state thet.” J advised Sergeant Walling that this internal affairs investigation was started because she alleged that she had sex activity with Sergeant Vansteenburgh on March 29, 2016, while he ‘was on duty as a Jupiter Police Department Sergeant. Sergeant Walling replied by saying “that is cortect.” Sergeant Walling agreed that on November 10, 2016, we spoke about two different dates alleging sex on duty (March 29, 2016, and July 25, 2015). Sergeant Walling further explained that she was absolutely certain that she performed oral sex on Sergeant Vansteenburgh on July 25, 2015, while he was on duty. Sergeant Walling then stated that she believes that she ‘had sex with Sergeant Vansteenburgh on March 29, 2016, while he was on duty; although, she hhas no way to prove unequivocally that it occurred. ulSergeant Walling admitted that in her previous swomn testimony she testified that on Mareh 29, 2016, she went to Sergeant Vansteenburgh’s residence while he was on duty and performed oral sex on him, Sergeant Walling admitted that she told me that sho had no evidence to prove that she had sex with Sergeant Vansteenburgh on March 29, 2016, while he was on duty. Lasked Sergeant Walling if she was now changing her story to only having sex with Sergeant ‘Vansteenburgh on one occasion while he was on duty. Sergeant Walling replied by saying “the one time I can unequivocally say was on July 25, 2015, is the one time J can say for sure it happened on duty, The other one it may have been before he went to work, I remember him boeing in uniform, but I don’t know for sure he was on duty.” I reviewed the text message conversation with Sergeant Welling from March 29, 2016, and she told me that she met Sergeant Vansteenburgh for dinner at Dufly’s while he wes working, Sergeant Walling admitted to going to Sorgoant Vansteenburgh’s residence that night after Dufiy’s, while he was on duty, Sergeant Walling admitted that she previously testified that she met Sergeant Vansteenburgh at his residence after Duffy's to perform oral sex on hin. Mrs, Parker then asked an additional clarifying question regarding Sergeant Walling giving a different version during this testimony and what mede her think that she was mistaken about March 29, 2016. Sergeant Walling stated that while she wos reviewing all of the text messages in preparation for ber interview, she came across information sbout having sex before work, and did not believe that she performed oral sex bivice to Sergeant Vansteenburgh on March 29, 2016, Sergeant Walling further went on to say she believes she said she had sex with Sergeant ‘Vansteenburgh while he was on duty on March 29, 2016, because he was getting into his uniform to go to work; although, he was not on duty at the time, ‘Sergeant Walling told me that on March 29, 2016, she went to Sergeant Vansteenburgh’s residence to pick up blackberries which she forgot to get eatlier in the day. T explained to Sergeant Walling that during her previous statements she advised us that Sergeant ‘Vansteenburgh was with her at his residence for a quantity of time, and she replied by saying “we just sat and talked.” I asked Sergeant Welling if she knew what untruthfulness was. Sergeant Walling replied “yes, not telling the truth.” I then explained again to Sergeant Walling that on two separate interviews on June 23, 2016 and November 10, 2016, she was absolutely sure that on March 29, 2016, she performed oral sex on Sergeant Vansteenburgh while he was on duty as a Jupiter Police Sergeant. Sergeant Walling stated that she is not trying to be untruthfiel and trying to be honest about this, Sergeant Walling stated that her memory is not that great and ahe is going off her interpretation from the text message conversations, Sergeant Welling then stated “did I originally think we had sex on duty? Yes. Is it possible that we did? Yes itis. Do f have any evidence or 100% proof that we did? No.” I explained to Sergeant Walling that she vwas able to remember very clearly during the other interviews what oceutred on Match 29, 2016, ‘The complete audio recording of this internal affairs interview with Sergeant Welling is included vith this investigation. 2subject Officer Inter Se my Walling December On December {9, 2016, Major England and I met with Sergeant Walling at the Jupiter Police Department regarding a supplemental subject officer statement regarding this investigation, Sergeant Walling was previously provided with and signod a new Garrity Rights Form, and was reviously provided with a copy of the Law Enforcement Officers’ Bill of Rights, Mrs. beth Parker (attomey from Kaplan, Sconzo, and Parker) eccompanied Sergeant Walling during this interview. Prior to the interview Sergeant Walling and Mrs. Parker were provided the subject officer statement of Sergeant Vansteenburgh from December 14, 2016, along with photographs that Sergeant Vansteenburgh provided. In summary, on December 14, 2016, Sergeant Vansteenburgh provided a photograph from approximately two years ago. The photograph shows Amy Walling who was a Police Major at that time wearing a Jupiter Police Department Class “A” Sergeant's uniform shirt. ‘The front of the shirt was completely open and Amy Walling was posing for the camera exposing her breasts, Sergeant Walling admitted that she took that photograph of herself using her personal cellular telephone in her office while she was a Police Major assigned as the Commander of the Criminal Investigations Section, Sergeant Walling posed for the picture wearing Sergeant ‘Vansteenburgh’s Class “A” uniform shirt which he left in her office, Sergeant Walling stated that while she was getting changed in her office to go the gym, she put on Sergeant ‘Vansteenburgh’s shirt and took the photograph, Sergeant Walling eventually sent the photograph to Sergeant Vansteenburgh by text message, Sergeant Walling stated that it is not apptopriate for a law enforcement officer to take a photograph of themselves with their breasts exposed while wearing a police uniform, Sergeant Walling admitted that this photograph of herself with her breasts exposed in a Jupiter Police Department uniform shirt brings diseredit to the Jupiter Police Department and the Town of Jupiter. ‘During Sergeant Vansteenburgh’s statement on December 14, 2016, he stated that on April 24, 2015, while he was working the SWAT detail at the Wyndham Hotel in Harbourside, then Major Amy Walling delivered him and another SWAT Officer coffee, Sergeant Vansteenburgh alleged ‘that Amy Walling requested that he send her a photograph of himself. Sergeant Vansteenburgh told us that he took a photograph of himself not exposing his penis and sent it vo Major Walling, Sergeant Vansteenburgh stated that Major Walling sent him back a text message stating “it is not good enough. ‘You know what I want.” At this time, Sergeant Vansteenburgh sent Major ‘Walling a photograph of himself exposing his penis while weating a Jupiter Police Department SWAT uniform. Sergeant Walling acknowledged that she did bring Sergeant Vansteenburgh and another unknown SWAT Officer coffee on April 24, 2015, Sergeant Walling reported that the only photograph she received from Sergeant Vansteenburgh was the one with his ponis exposed, and denied receiving the photograph without his penis exposed, Sergeant Walling further denied requesting or pressuring Sergeant Vansteenburgh to ever send her any photographs of himself exposing his penis, I further explained to Sergeant Walling that Sergeant Vansteenburgh denied being the person in the video receiving oral sex from her on July 25, 2015. [asked Sergeant 3Walling what in the video shows thet it is Sergeant Vanstoenburgh receiving the oral sex? Sergeant Walling stated that you can see Sergeant Vansteenburgh’s arm, hear his voice, and his boots are also visible, ‘At the conclusion of the interview, Sergeant Walling denied ever sexually harassing Sergeant Vansteenburgh. Sergeant Walling stated that their reletionship was mutual and at no time did she ever pressure or threaten Sergeant Vansteenburgh in anyway do anything. ‘Tho complete audio recording of this internal affairs interviow with Sergeant Walling is included with this investigation, Assistant Town Manager Lori Bonino On November 2, 2016, I met with the Town of Jupiter Assistent Town Manager Loti Bonino regarding this incident. In summary, Mrs, Bonino advised me that neither Sergeant Walling nor Sergeant Vansteenburgh told her about the allegation made about Sergeant Walling performing oral sex on Sergeant Vansteenburgh on March 29, 2016, while he was on duty. ‘The complete audio recording of this intémal affairs interview with Mrs, Bonino is included with this investigation, Officer Elizabeth Raleigh On November 7, 2016, I met with Officer Elizabeth Raleigh regarding this ineident, In summary, Officer Raleigh advised me that neither Sergeant Walling nor Sergeant Vansteenburg, told her about the allegation made about Sergeant Walling performing oral sex on Sergeant ‘Vansteenburgh on Match 29, 2016, while he was on duty, The complete audio recording of this internal affurs interview with Officer Raleigh is included with this investigation. Jennifer Lunsford On November 2, 2016, I met with Communications Officer Jennifer Lunsford regarding this incident, In summary, Mrs, Lunsford advised me that Sergeant Walling fas told her that she has performed oral sex on Sergeant Vansteenburgh in the past; however, she did not know if he was ‘on duty at the time, nor did she know if occurred on March 29, 2016, The comptete audio recording of this intemal affairs interview with Mrs. Lunsford is included with this investigation, After the interview was concluded, Mrs, Lunsford explained to me about a text message conversation she had with Sergeant Vansteenburgh a few months back. During tho text message conversation Mrs, Lunsford alleged that Sergeant Vansteenburgh stated that he should came to the Jupiter Police Department and “shoot the place up.” Mrs, Lunsford volunteered to meet with Agent Paul Harrington of the Jupiter Police Department in an effort to have hier cellular telephone examined in an attempt to retrieve the alleged text message conversation, 4On November 7, 2016, Agent Harrington met with Mrs. Lunsford at the Jupiter Police Department and obtained her Samsung S5 cellular telephone, Agent Harrington utilized Cellebrite mobile device forensic hardware and software to perform a physical extraction of the cellular telephones data, Agent Harrington was unable to locate the text message conversation a3 it was likely overwritten with new data, For further information regarding the cellular telephone examinations please refer to Agent Harrington's memorancumn which is attached to this internal affairs investigation. On November 16, 2016, { met with Communications Officer Jennifer Lunsford regarding a supplemental interview regarding this incident, In summary, I spoke with Mrs. Lunsford about the allegation she made against Sergeant Vansteenburgh at the conclusion of the interview on November 2, 2016. Mrs, Lunsford reiterated that Sergeant Vansteenburgh stated to her in a text message that “he sometimes wishes he could go in and shoot the place up LOL.” Mrs. Lunsford told me that the message was regarding the Jupiter Police Department. Mrs. Lamsford stated that the message was not directed at anyone specific, and was possibly stated because he did not want +o go into work, Mrs, Lunsford told me that she did not know if Sergeant Vansteenburgh was joking when he made the aforementioned statement as she does not know him very well. Mis Lunsford spoke about having her collutar telephone anelyzed by Agent Harrington and being tunsuecessfil with locating the above text message conversation, Mrs, Lunsford told me that Sergeant Vansteenburgh only made the above statement once and it occurred approximately four months prior to the interview date, The complete audio recording of this internal affairs interview with Mrs, Lunsford is included with this investigation. (Subject Officer Intervi On December 14, 2016, Major England and I met with Sergeant Jason Vansteenburgh at the Jupiter Police Department regarding this investigation. Sergeant Vansteenburgh was provided ‘with and signed a Garrity Rights Form, aud was provided with a copy of the Law Enforcement Officers’ Bill of Rights. Mrs. Suzanna Scarborough (attomey from Rosenthal, Levy, Sitnon, and Ryles) accompanied Sergeant Vansteenburgh during this interview. Prior to being interviewed Sergeent Vensteenburgh and Mrs, Scarborough were provided with all of the statements and documentation regarding this internal affairs investigation. Prior to the interview beginning, Mrs, Scarborough provided Major England and me with three of the same printed photographs. ‘The photograph shows Amay Walling when she was a Police Major for the Jupiter Police Department posing for a photograph wearing a Jupiter Police Department Class “A” Sergeant's uniform shirt with her breasts exposed. Sergeant Vansteenburgh located the photograph a couple ‘of weeks prior to this interview on his personal computer and turned it over to Mir, Scarborough to be presented during his interview, In summary, Sergeant Vansteenburgh has been employed with the Jupiter Police Department since August 16, 1999, and is currently assigned as a road patrol Sergeant, Sergeant ‘Vansteenburgh holds a Bachelor’s Degree. While employed with the Jupiter Police Department Sergeant Vansteenburgh has worked in the following assignments; Road Patrol Officer, Field 15‘Training Officer, Street Crimes Agent, and Detective assigned to the Criminal Investigations Section, Sergeant Vansteenburgh was promoted to the rank of sorgeant on February 2, 2015, As a collateral assignment Sergeant Vansteenburgh was previously assigned to the Jupiter Police Department SWAT Team as an operator and team leader until being removed from the team in February of 2016, Sergeant Vanstcenburgh has also assistod with in service trainings and currently oversees the physical fitness and Taser programs for the Jupiter Police Department, Sergeant Vansteenburgh admits that he had a scxval relationship with Sergeant Walling which started approximately four yeers ago, Sergeant Vansteenburgh acknowledged that the sexual relationship was occuring while Amy Walling was in his direct chain of command as « Police Major and Commander of the SWAT Team. Sergeant Vansteenburgh does not exactly recall ‘when the sexual relationship ended, On March 29, 2016, Sergeant Vansteenburgh reported that fhe was working as a Jupiter Police Department Sergeant and his work hours were from 6:45 pm = 6:00 am, Sergeant Vansteenburgh admitted thet he had a text message conversation with Sergeant Walling on March 29, 2016. I reviowod the text message conversation that Sergeant Walling provided. Sergeant Vansteenburgh stated he was concemns that text message conversation may not be accurate as Sergeant Walling has provided fictitious items to his wife, him, and me, [asked Sergeant Vanstcenburgh since he was concerned with the accuracy of the text messages provided by Sergeant Walling would he voluntarily submit his cellular telephone to be examined by Agent Harrington in our Computer Forensics Unit. Sergeant Vansteenburgh told me that his cellular telephone would not have anything in it as he deleted all of his messages and has a brand new phone. Sergeant Vansteenburgh stated that the majority of text messages we hhaye are “probably legitimate,” Sergeant Vansteenburgh further told me that text message names in conversations can be altered, After reviewing the text messages from March 29, 2016, Sergoant Vansteenburgh advised me that it appears accurate, Sergeant Vansteenburgh stated that he does not believe that he met Sergeant Walling at his residence om the night of March 29, 2016, and believes that his fiancé was at his house that night, Sergeant Vanstoenburgh denied that Sergeant Walling gave him oral sex on March 29, 2016, while he was on duty as a Jupiter Potice Department Sergeant, Sergeant Vansteenburgh further stated that during his entire career with the Jupiter Police Department he has never had any sexual relations while on duty. Sergeant ‘Vansteenburgh was unsure if he had sexual relations with Sergeant Walling on March 29, 2016, at his residence priot to going to work on that day. On July 25, 2015, Sergeant Vansteenburgh reported that he was working as a Jupiter Police Department Sergeant and his work hours were from 6:45 pm —6:00 am, I reviewed the text ‘message conversation with Sergeant Vansteenburgh that was supplied by Sergeant Welling from July 25, 2015. Sergeant Vanstecnburgh advised me that according to Sergeant Walling’s records he did have a text message conversation with Sergeant Walling on July 25, 2015, Sergeant ‘Vansteenburgh admitted that portions of the text message conversation were sexual in nature. ‘The complete text message conversation was documented under Sergeant Welling’s section of this report. Sergeant Vansteenburgh advised me that according to the text message conversation from July 25, 2015, he bought dinner for the two of them at Burrito Brothers, and brought the food to 16Sergeant Walling’s residence, Sergeant Vansteenburgh further told me that he went to Burrito Brothers often with Sergeant Walling and would meet her at the restaurant to eat the food, Sergeant Vansteenburgh also stated that he went to Sergeant Walling’s residence only a couple of times while on duty as itis not in our jurisdiction. Sergeant Vansteenbburgh advised me that on July 25, 2015, while he was on duty ihe may have possibly brought Sergeant Walling food to hor previous residence located at Sergeant Vansteenburgh then stated tat the majority of time when he met Sergeant Walling for dinner while he was working they met at a restaurant in the Town of Jupiter, reviewed the oral sex video with Sergeant Vansteenburgh from July 25, 2015, at 10:09 PM, that ‘was supplied by Sergeant Welling. Sergeant Vansteenburgh told me that he did not utilize Sergeant Walling’s cellular telephone to take the video, and adamantly told me that he was not the person in the video receiving oral sex from Sergeant Welling, Sergeant Vanstecnburgh denied receiving oral sex from Sergeant Welling while he was on duty as a Jupiter Police Department Sergeant. I advised Sergeant Vansteenburgh that the voice in the video sounded exactly like his voice and the arm in the video appeated to be his am. Sergeant Vansteenburgh again denied being the person in the video receiving the oral sex from Sergeant Walling, Sergeant Vensteenburgh explained that Sergeant Walling also has a police radio and the radio in the background could be hers, Sergeent Vensteenburgh told me that he does not know who Sergeant Walling was performing oral sex on in the video, Sergeant Vansteenburgh agreed that it is improper for a law enforcement officer to have sexual relations while on duty. ‘On December 14, 2016, I accidently supplied Sergeant Vansteenburgh with his activity report from the date of July 25, 2016, Sergeant Vanstocnburgh reviewed that activity report prior to the interview and made statements based upon that activity report regarding the times of the incident ‘on July 25, 2015, The correct activity report was supplied to Setgeant Vansteenburgh for the actual date of the incident of July 25, 2015, A second interview was conducted with Sergeant ‘Vansteenburgh on December 14, 2016, and that interview will be discussed later in this report. Tspoke with Sergeant Vansteenburgh about the photograph that Sergoant Walling supplied of him exposing his penis while wearing his Jupiter Police Department SWAT uniform, On April 24, 2015, Jason Vansteenburgh was a Sergeant with the Jupiter Police Department, Sergeant Vansteenburgh advised me that he was working a SWAT detail on April 24, 2015, ftom 12:00 - 6:00 PM, at the Wyndham Hotel in Harbourside protecting a subject involved in a homicide investigation, Sergeant Vensteenburgh was accompanied by another SWAT Team member, although he was unable to remember who the officer was. While working the SWAT detail on April 24, 2015, Sergeant Vansteenburgh told me that the uniform he was wearing was not a complete Jupiter SWAT uniform, He further stated that the pants, hat, and some of the equipment was issued by the Jupiter Police Department; however, some of the equipment was his own. Underneath the exterior ballistic vest which says “Police” on the front left chest area, Vansteenburgh” on the right front chest area, and “Police” on the back of the vest was a plain black Under Armour shirt, Sergeant Vansteenburgh admitted that while he was wearing the aforementioned uniform he was representing the Jupiter Police Department and wore that uniform while being compensated at his SWAT detail on April 24, 2015, 7Sergeant Vansteenburgh told me that he took the photograph himself while in the bathroom of a hhotel room at ihe Wyndham Hotel and sent it then Major Walling by text message. On April 24, 2015, Amy Walling was a Police Major and SWAT commander for the Jupiter Police Department. Major Walling met Sergeant Vansteenburgh and another unknown SWAT officer at the hotel and delivered them coffees. Sergeant Vansteenburgh stated that Walling is attracted to men wearing SWAT uniforms and advised Sergeant Vansteenburgh “make sure you send mea picture before you leave.” Sergeant Vansteenburgh advised me when the detail ended he went {nto the bathroom of the hotel room and first took a photograph of himself from his waist level up not exposing his penis, and sent the photograph to Major Walling by text message, Sergeant Vansteenburgh advised that Major Walling sent him a text message back stating “it’s not good enough, you know what I want.” Sergeant Vansteenbuegh told me he knew what Major Welling wanted, he was off duty, and was in fear that ifhe did not comply he would have issues with her. Sergeant Vansteonburgh stated “T know it was not a good idea”, but admitted to taking the photograph of himself exposing his penis while in uniform and sent it Major Walling by text message. Sergeant Vansteenburgh advised me that he felt compelled to send the photograph as Major Walling was his SWAT Commander, Scrgeant Vanstecnburgh was unable to provide the text message conversation with Major Walling from April 24, 2015, and he was unable to prove or disprove his allegations made against Major Walling, Sergeant Vansteenburgh told me that he did not notify his direot supervisor, the Chief of Police, or Human Resoutces that Major Walling requested the photograph of him exposing his penis while in uniform, Sergeant Vanstsenburgh felt that he could not report the incident as he was in fear of his position on the SWAT Team. Sergeant “Vansteenburgh further stated that he probably should have reported this incident to the Chief of Police, Sergeant Vansteenburgh admitted that itis not appropriate for a law enforcement officer +0 take photographs exposing their genital area while weating a police uniform. Sergeant Vansteenburgh stated that nothing on the photograph shows that Sergeant Vansteenburgh is affiliated with the Jupiter Police Department, Sergeant Vansleenburgh admitted thet if this photograph was released and people knew he was wearing # Jupiter Police Department uniform it would bring discredit to the Jupiter Police Department and the Town of Jupiter. Sergeant ‘Vansteenburgh told me that if one of his subordinates sent him a photograph of themselves exposing their genital area while wearing « police uniform, he would “address it with them and report it” Sergeant Vansteenburgh told me thet this was the only photograph that he ever sent Sergeant Walling of him exposing his genital arca while wearing a police uniform, Sergeant ‘Vanisteenburgh stated that he hes probably sent Sergeant Walling other photographs of his genital area throughout the years; although he was off duty and not wearing a police uniform, 1 spoke with Sergeant Vansteenburgh regarding the allegation made by Communications Officer Jonnifer Lunsford. Mrs, Lunsford made an allegetion that while speaking with Sergeant ‘Vanstcenburgh by text message he stated that he should come to the Jupiter Police Department and “shoot the place up.” Sergeant Vansteenburgh told me that he is familiar with Mrs, Lunsford ‘and has spoken with her in the past by text messaging, Sergeant Vansteenburgh denied making the statement that Mrs. Lunsford alleges and told me that he would never make those statements, 18Tnext spoke with Sergeant Vansteenburgh about the photograph of Sergeant Walling that he provided on December 14, 2016, Sergeant Vanstoenburgh told me that he located the photograph on his computer a couple of weeks prior to December 14, 2016, ‘The photograph shows Amy Walling whea she was a Police Major for the Jupiter Police Department posing for a photograph wearing a Jupiter Police Department Class “A” Sergeant's uniform shirt with her breasts exposed. Walling took the photograph herself using a self-timer a couple of years ago inside of her office in the Criminal Investigation Section of the Jupiter Police Department, Sergeant Vansteenburgh told me that Walling sent him the photograph by text message. Sergeant Vansteenburgh told me that he deleted the photograph from his phone; however, it backed up to his personal laptop computer. Afer locating the photograph on his computer he supplied it (0 his attorney. At the time, Sergeant Vansteenburgh received the photograph he was not yet promoted to the rank of Sergeant, Sergeant VanSteenburgh further advised me that the Class “A” uniform shirt that Walling was wearing was possibly his, as the photograph wins taken just prior to hira being promoted and he left his Class “A” Sergeant uniform shirt in his cubicle ‘area inside of the Criminal Investigation Section, Towards the end of the interview Ms, Scarborough and Sergeant Vansteenburgh spoke about how text message conversations can be manipulated along with the dates and times of text messages, Mrs, Scarborough further stated that some of the text message conversations provided by Sergeant Walling appear to have been manipulated as some of the conversations did not make sense and portions appear to have been left out. ‘The complete audio recording of this intemal affairs interview with Sergeant Vansteenburgh is included with this investigation. On December 14, 2016, Major England and I conducted a second interview with Sergeant Jason YVansteenburgh af the Jupiter Potice Department regarding this investigation, Sergeant Vansteenburgh wes provided with and previously signed a Garrity Rights Form, and was provided with a copy of the Law Enforcement Officers’ Bill of Rights. Mrs, Suzanna Scarborough (ettorney from Rosenthal, Levy, Simon, and Ryles) accompanied Sergeant ‘Vansteenburgh during this interview, Prior to being interviewed Sergeant Vansteenburgh and Mars. Scarborough were provided with a copy of Sergeant Vansteenburgh’s work activity report for July 25, 2015, for review. In the prior interview Sergeant ‘Vansteenburgh made some statements rogarding the night of July 25, 2015, based upon an activity report that was provided to him for the date of Fuly 25, 2016. Sergeant Vensteenburgh again told me that he on July 25, 2015, he working as a Jupiter Police Department Sergeant on the Nights 2 platoon, I reviewed Sergeant Vansteenburgh’s activity report with him from Jaly 25, 2015, and the only call for service that he was on.for that date was a backup for a drug ease from 10:27 PM-11:59 PM, at 601 West Indiantown Road, Jupiter. Sergeant Vansteenburgh was not any calls prior 10:27 PM, on that date. Sergeant ‘Vansteenburgh acknowledged that according to the activity report he was not on any calls for service at 10:09 PM, It must be noted that the video supplied by Sergeant Walling was recorded on July 25, 2015, at 10:09 PM, Sergeant Vanstecnburgh told me he does not always notify Communications when he artives on officer’s calls for service or theit traffic stops, Sergeant Vanstoenburgh did acknowledge that it is protocol of the Jupiter Police Department to notify 19(Communications when you atrive on a call for service or conduct a backup for an officer, The complete audio recording of this internal affairs interview with Sergeant Vansteenburgh is, included with this investigation, Findings TA 2016-003 On June 23, 2016, Sergeant Amy Walling was interviewed as a subject officer for Internal Afftins Case # 2016-002. During the interview Sergeant Walling advised Major England and 1 that on March 29, 2016, she performed oral sex on Sergeant Jason Vansteenburgh at his residence while he was on-duty as « Jupiter Police Department Sergeant, On June 23, 2016, Sergeant Walling reported that March 29, 2016, was the only time she had sexual relations with Sergeant Vansteenburgh while he was on-duty. Sergeant Walling reported that she did not have ‘any evidence to prove that she performed oral sex on Sergeant Vansteenburgh on March 29, 2016, attempted to locate GPS data for Sergeant Vansteenburgh’s police vehicle for March 29, 2016, ‘through our Communications Division; however, due to Sergeant Walling’s delay in reporting the incident the retention petiod had expired, Major England and I met with vwho is the ‘whore Sergeant Vansteenburgh previously resided in an ettempt to obtain video surveillance or entry data from the security gates ‘of the community, ‘was unable to locate video surveillance ot vehicle entry data for Sergeant Vansteenburgh’s police vehicle for March 29, 2016. On November 10, 2016, Mejor England end I met with Sergeant Walling at the Jupiter Police Department regarding the allegations she made against Sergeant Vansteenburgh on June 23, 2016. A witness / complainant interview wes conducted with Sergeant Walling, During the interview, Sergeant Walling was represented by Mr, Stuart Kaplan and Mr. Joseph Scanzo (altomeys from Kaplan, Sconzo, and Parker). Sergeant Walling again explained to us that on ‘March 39, 2016, the sole purpose for meeting Sergeant Vansteenburgh at his residence while he ‘was on-duty was to perform oral sex on him as they had a sexual conversation during their dinner at Dufiy's, During this interview, Sergeant Walling also stated that on July 25, 2015, she also performed oral sex on Sergeant Vansteenburgh a second time, while he was on-duty as a Jupiter Police Department Sergeant. On July 25, 2015, the incident occurred at her previous residence located at According to the text message conversation supplied by Sergeant Walling from July 25, 2015, Sergeant ‘Vansteenburgh and Sergeant Walling had a text message conversation earlier in the day which ‘was sexual in nature and involved Sergeant Walling performing otal sex on Sergeant Vansteenburgh. On July 25, 2015, while Sergeant Vansteenburgh was on duty as a Jupiter Police Department Sergeant he arrived at her residence shortly after 8:30 PM. Sergeant ‘Vansteenburgh brought over food for the both of them, ‘While at Sergeant Walling’s residence she reported that she performed oral sex on Sergeant Vansteenburgh. 20On November 10, 2016, Sergeant Walling provided e video which Sergeant Vansteenburgh captured on her cellular telephone of her providing oral sex to him on the night of Fuly 25, 2015. The video was captured at 10:09 PM, and it is 23 seconds in length. ‘The video was reviewed by ‘Agent Paul Harrington who conducted a forensic analysis of the video. Agent Harrington utilized X-Ways Forensics digital foronsie software to examine the video. ‘The video was captured utilizing an Apple IPhone 6, and was made on July 25, 2015, at 10:09:01 PM. Agent Hazrington obtained the following GPS coordinates: Agent Harrington inputted the coordinates into Google Maps, and the location was shown to be on. which is the location of where Sergeant Walling previously resided. For further information regarding the analysis please refer to Agent Harrington's Forensic Analysis Report which is attached to this investigation. Upon viewing the video provided by Sergeant Walling it shows her performing oral sex on a male subject. Sergeant Walling’s face is observed along with her breasts, The male individual's penis, left hand end arm, legs, and the bottom portion of what resembles a Jupiter Police Depariment uniform shirt is observed in the video. In the video the male individual states “Oh, shit ’'m going to cum” and you can also hear the male malcing moaning sounds. The male subject is observed ejaculating on Sergeant Walling’s face, ‘The voice in the video exactly matches the voice of Sergeant Vansteenburgh. In the background of the video a Jupiter Police Department radio is heard with Communications checking on the status of Jupiter Alpha 42. ‘The video is attached to this investigative file, Agent Harrington was able to capture five still photographs of the arm and hand of the male individual from the video supplied by Sergeant Walling, On December 21, 2016, I spoke with Sergoant Vansteenburgh’s attomey Mrs. Scarborough and informed her that I would be taking photographs of Sergeant Vansteenburgh’s arms and hands, On December 21, 2016, Major England and I met with Sergeant Vansteenburgh at the Jupiter Police Department. Major England captured ten photographs of Sergeant Vansteenburgh’s left arm and left hand, The veins on Sergeant Vansteenburgh’s left arm and hand match what is in the video along with the lines in the middle of Sergeant Vanstcenburgh’s left thumb, The photographs were included in the investigative file, On July 25, 2015, Sergeant Vanstcenburgh was on duty assigned to the Nights 2 platoon, His shift on that date started at either 4:45 PM or 6:45 PM and ended at 6:00 AM on July 26, 2015. Sergeant Vansteenburgh's time card was obtained and it showed that he did work 11.25 hours on July 25, 2015, and obtained his shift differential pay for that day. Sergeant Vansteenburgh's work ectivity report was also reviewed and the only call for service on July 25, 2015, occurred at 10:27PM. Sergeant Walling reported that Setgeant Vansteenburgh was at her residence for approximately @ couple of hours on July 25, 2015, and there is no evidence to contradict her statement based upon the activity report for Sergeant Vansteenburgh, ‘On November 10, 2016, Sergeant Welling provided a photograph of Sergeant Vansteenburgh ‘wearing a Jupiter Police Department SWAT uniform with his penis exposed, Sergeant Walling 24reported that in April of 2015, she was a Police Major assigned as the Commander of the ‘Criminal Investigations Section and SWAT ‘Team, Sergeant Welling reported that she reveived the aforementioned photograph from Sergeant Vansteenburgh by text message. ‘The photograph vas taken in & hotel room bathroom at the Wyndham Harbourside Hotel located at 122 Soundings Avenue Jupiter, Florida 33477, while Sergeant Vansteenburgh was working a SWAT coxtra duty detail to provide protection to a homicide suspect, In the photograph, Sergeant ‘Vansteenburgh is wearing a Jupiter Police Department external ballistic vest carrier, black shirt, green colored SWAT tactical pants, gun duty belt, and Jupiter Police Department SWAT ball ‘ap, ‘The ballistic vest shows Sergeant Vansteenburgh’s name on the right side of his chest, the ‘word “Police” on the left side of his chest. ‘The photograph shows Sergeant Vanisteenburgh’s penis sticking out of the front zipper portion of his pants, ‘The Jupiter Police Department did rent @ hotel room at the Wyndham Hotel in Harbourside from April 23-25, 2015, relating to the homicide investigation. The hotel room rented according the hotel receipt was room #343. On April 24,2015, Sorgeant Vansteenburgh did work the overtime SWAT detail from £2:00- 6:00 PM, which was confirmed by bis timecard, Major England and I ‘went to the Wyndham Harbourside Hlotel and photographed the bathroom of room #343, The bathroom area matches the same bathroom where Sergeant Vansteenburgh took the photograph of himself exposing his penis while weating a Jupiter Police Department SWAT uniform. The photographs of the hotel and Sergeant Vansteenburgh exposing his penis are attached to this investigation. On November 18, 2016, Sergeant Walling was supplied written notice that she was now a subject officer in this investigation, On December 2, 2016, a subject officer interview was ‘conducted with Sergeant Walling who was accompanied by her attorney Elizabeth Parker, ‘During this interview Sergeant Walling changed her original testimony that she provided on both June 23, 2016, and November 10, 2016. Sergeant Walling now oxplained that she was unsure if ‘on March 29, 2016, she performed oral sex on Sergeant Vansteenburgh while he was on duty. Sergeant Walling further stated that she remembered having sexual relations with Sergeant “Vansteenburgh on March 29, 2016, at his residence, but believed it occurred before he went to work, Sergeant Walling further stated that she was absolutely certain that she performed oral sex on Sergeant Vansteenburgh on July 25, 2015, while he was on duty, and provided the video evidence to prove it, Sergeant Walling know that itis a violation of Jupiter Police Department General Orders for on duty petsonnel to engage in sexual activity while on duty. Sergeant Walling performed oral sex con Sergeant Vansteenburgh on July 25, 2015, knowing Sergeant Vansteenburgh was on duty ‘which violated Jupiter Police Department General Orders, Sergeant Walling futher admitted to receiving the photograph of Sergeant Vansteenburgh with his penis exposed while she was a Police Major for the Jupiter Police Department, As a Police Major, Amy Walling di discipline Sergeant Vansteenburgh for taking a photograph of himself with his penis exposed in a Jupiter Police Department SWAT uniform, nor did she report the misconduct to Chief Kitzerow who was her immediate supervisor, 2‘On December 14, 2016, while conducting the interview with Sergeant Vansteenburgh he adamantly denied ever having sex while on duty. Sergeant Vansteenburgh further denied using Sergeant Walling’s cellular telephone to capture the video or being the person in the video receiving orel sex fiom Sergeant Walling. Sergeant Vanstecaburgh admitted to taking the photograph of him exposing his penis while wearing a police uniform, Sergeant Vansteenburgh claimed that on April 24, 2015, Major Walling came to the Wyndham Hotel to deliver him and another unknown SWAT officer coffee. Sergeant Vansteenburgh reported that Major Walling requested that he send a photograph of himsolf to her in uniform, Sergeant Vansteenburgh provided me with three copies of a photograph that he took of himself in uniform in the bathroom at the Wyndham Srom the waist up not exposing his penis. Sergeant Vanstecnburgh slated that he frst sent that photograph to then Major Walling, and she sent him a text message stating “it’s not good enough, you know what I want.” Sergeant Vansteenburgh told me that he knew what she wanted so he sent her another photograph exposing his penis while in uniform. Sergeant Vansteenburgh did take the photograph while in the bathroom in a room at the Wyndham Hotel. Sergeant Vensteenburgh claimed that he took the photogrsph of himself exposing his penis and sent it to Major Walling ‘because he folt as though his position on the SWAT Team and agency would be compromised if he did not comply. Sergeant Vansteenburgh was unable to provide any text message documentation regarding their conversation from April 24, 2015. Sergeant Vensteenburgh did not report this incident to his immediate supervisor, Chief Kitzerow, the Office of Professional Standards, or Human Resources. On December 14, 2016, Sergeant Vansteenburgh through his attomey Mrs. Scarborough provided a photograph of then Major Walling posing for a photograph wearing a Jupiter Police Department Class “A” Sergeant's uniform shirt with her breasts exposed. Sergeant Vansteenburgh told me that he located the photograph on his computer a couple of weeks prior to the December 14, 2016, interview date, Walling took the photograph herself using a self timer a couple of years ago inside of her office in the Criminal Investigation Section of the Jupiter Police Department. Sergeant Vansteenburgh told me that Walling sent him the photograph by text message, Sergeant Vansteenburgh told me that he deleted the photograph from his phone; however, it backed up to his personal laptop computer. After locating the photograph on his computer he supplied it to his attorney. At the time, when Sergeant ‘Vansteenburgh received the inappropriate photograph of Major Walling exposing her breasts while wearing a Jupiter Police Department Class “A” Sergeant uniform shitt he did not report the misconduct to his immediate supervisor, Chief Kitzerow, or the Office of Professional Standards, ‘The photograph of Major Welling is attached to this investigative report, ‘Sergeent Vansteenburgh denied making the statement to Jennifer Lunsford that he should come to the Jupiter Police Department and “shoot the place up.” Agent Harrington conducted a forensic examination of Mrs, Lunsford’s cellular telephone in an attempt to locate the text message conversation between herself and Sergeant Vansteenburgh where he allegedly made the aforementioned statement, Agent Harrington was unable to retrieve that text message 23conversation, Agent Harrington's memorandum regarding the forensic examination of Mrs. Lunsford’s cellular telephone is attached to this investigation. (On December 21, 2016, Major England and I conducted a follow-up interview with Sergeant Walling, Sergeant Walling admitted that she took that photograph of herself exposing her breasts using her personal cellular telephone in her office while she was a Police Major assigned as the Commander of the Criminal Investigations Section. Sergeant Walling posed for the picture wearing Sergeant Vansteenburgh’s Class “A” Sergeant’s uniform shirt. Sergeant Walling sent the photograph to Sergeant Vansteenburgh by text message. Sergeant Walling stated that it is not appropriate for a Jupiter Police Department law enforcement officer to take a photograph of themselves with their breasts exposed while weating a police uniform, Sergeant Walling admitted that the photograph of her exposing her breasts while weating a Jupiter Police Department uniform shirt brings discredit to tho Jupiter Police Department and the Town of Jupiter. Sergeant Walling acknowledgod thet she did bring Sergeant Vansteenburgh and another unknown SWAT officer coffee on April 24, 2015. Sergeant Walling reported that the only photograph she received from Sergeant Vansteenburgh was the one with his penis exposed, and denied receiving the photograph without his penis exposed. Sergeant Vansteenburgh went out of the Town of Jupiter's jurisdiction and went to Sergeant Walling's residence in Sergeant Vanstoenburch was at Sergeant Walling’s residence for approximately two ‘hours, Sergeant Vansteenburgh did not adhere to Jupiter Police Department General Orders and did not faithfully execute all of the responsibilities of supervising his assigned personnel.
