ANACTINCREASINGTHEPENALTIESFORILLEGALNUMBERSGAMES,AMENDING
CERTAINPROVISIONSOFPRESIDENTIALDECREENO.1602,ANDFOROTHER
PURPOSES

BeitenactedbytheSenateandHouseofRepresentativesofthePhilippinesinCongressassembled:

Section1.DeclarationofPolicy.ItisthepolicyoftheStatetopromoteajustanddynamic
socialorderthatwillensuretheprosperityandindependenceofthenationandfreethepeople
frompovertythroughpoliciesthatprovideadequatesocialservices,promotefullemployment,
arisingstandardofliving,andanimprovedqualityoflifeforall.Itislikewisethepolicyofthe
Statethatthepromotionofsocialjusticeshallincludethecommitmenttocreateeconomic
opportunitiesbasedonfreedomofinitiativeandselfreliance.

Hence,theStateherebycondemnstheexistenceofillegalgamblingactivitiessuchasillegal
numbersgamesasthishasbecomeaninfluentialfactorinanindividual'sdisregardforthe
valueofdignifiedwork,perseveranceandthriftsinceinstantmonetarygainsfromitarebeing
equatedtosuccess,therebybecomingawidespreadsocialmenaceandasourceofcorruption.

Towards this end, the State shall therefore adopt more stringent measures to stop and
eradicatetheexistenceofillegalnumbersgamesinanypartofthecountry.

Sec.2.DefinitionofTerms.AsusedinthisAct,thefollowingtermsshallmean:

a) IllegalNumbersGame.Anyformillegalgamblingactivitywhichusesnumbersor
combinationsthereofasfactorsingivingoutjackpots.

b)Jueteng.Anillegalnumbersgamethatinvolvesthecombinationofthirtyseven(37)
numbersagainstthirtyseven(37)numbersfromnumberone(1)tothirtyseven(37)or
thecombinationofthirtyeight(38)numbersinsomeareas,servingasaformoflocal
lotterywherebetsareplacedandacceptedpercombination,anditsvariants.

c) Masiao.Anillegalnumbersgamewherethewinningcombinationisderivedfrom
theresultsofthelastgameofJaiAlaiortheSpecialLlaveportionoranyresultthereof
basedonanyfictitiousJaiAlaigameconsistingoften(10)playerspittedagainstone
another,anditsvariants.

d)LastTwo.Anillegalnumbersgamewherethewinningcombinationisderivedfrom
thelasttwo(2)numbersofthefirstprizeofthewinningSweepstakesticketwhich
comesoutduringtheweeklydrawofthePhilippineCharitySweepstakesOffice(PCSO),
anditsvariants.
e)Bettor("Mananaya","Tayador"orvariantsthereof).Anypersonwhoplacesbetsfor
himself/herselforinbehalfofanotherperson,oranyperson,otherthanthepersonnel
orstaffofanyillegalnumbersgameoperation.

f) PersonnelorStaffofIllegalNumbersGameOperation.Anyperson,whoactsinthe
interest of the maintainer, manager or operator, such as, but not limited to, an
accountant, cashier, checker, guard, runner, table manager, usher, watcher, or any
other personnel performing such similar functions in a building structure, vessel,
vehicle,oranyotherplacewhereanillegalnumbersgameisoperatedorconducted.

g) CollectororAgent("Cabo","Cobrador","Coriador"orvariantsthereof).Anyperson
who collects, solicits or produces bets in behalf of his/her principal for any illegal
numbersgamewhoisusuallyinpossessionofgamblingparaphernalia.

h)Coordinator,ControllerorSupervisor("Encargado"orvariantsthereof).Anyperson
whoexercisescontrolandsupervisionoverthecollectororagent.

i)Maintainer,ManagerorOperator.Anypersonwhomaintains,managesoroperates
anyillegalnumbergameinaspecificareafromwhomthecoordinator,controlleror
supervisor,andcollectororagenttakeorders.

j) Financiers or Capitalist. Any person who finances the operations of any illegal
numbersgame.

k) Protector or Coddler. Any person who lends or provides protection, or receives


benefitsinanymannerintheoperationofanyillegalnumbersgame.

Sec.3.PunishableActs.Anypersonwhoparticipatesinanyillegalnumbersgameshallsuffer
thefollowingpenalties:

a) The penalty of imprisonment from thirty (30) days to ninety (90) days, if such
personactsasabettor;

b)Thepenaltyofimprisonmentfromsix(6)yearsandone(1)daytoeight(8)years,if
suchpersonactsasapersonnelorstaffofanillegalnumbersgameoperation;

The same penalty shall likewise be imposed to any person who allows his vehicle,
house,buildingorlandtobeusedintheoperationoftheillegalnumbersgames.

c)Thepenaltyofimprisonmentfromeight(8)yearsandone(1)daytoten(10)years,
ifsuchpersonactsasacollectororagent;

d)Thepenaltyofimprisonmentfromten(10)yearsandone(1)daytotwelve(12)
years,ifsuchpersonactsasacoordinator,controllerorsupervisor;

e)Thepenaltyofimprisonmentfromtwelve(12)yearsandone(1)daytoten(10)
fourteen(14)years,ifsuchpersonactsasamaintainer,manageroroperator;and

f)Thepenaltyofimprisonmentfromfourteen(14)yearsandone(1)daytosixteen
(16)years,ifsuchpersonactsasafinancierorcapitalist;

g)Thepenaltyofimprisonmentfromsixteen(16)yearsandone(1)daytotwenty(20)
years,ifsuchpersonactsasprotectororcoddler.

Sec.4. PossessionofGamblingParaphernaliaorMaterials.Thepossessionofanygambling
paraphernaliaandothermaterialsusedintheillegalnumbersgameoperationshallbedeemed
primafacieevidenceofanyoffensecoveredbythisAct.
Sec.5. LiabilityofGovernmentEmployeesand/orPublicOfficials.a)Ifthecollector,agent,
coordinator,controller,supervisor,maintainer,manager,operator,financierorcapitalistof
anyillegalnumbersgameisagovernmentemployeeand/orpublicofficial,whetherelectedor
appointedshallsufferthepenaltyoftwelve(12)yearsandone(1)daytotwenty(20)years
and a fine ranging from Three million pesos (P3,000,000.00) to Five million pesos
(P5,000,000.00)andperpetualabsolutedisqualificationfrompublicoffice.

Inadditiontothepenaltyprovidedintheimmediatelyprecedingsection,theaccessorypenalty
ofperpetualdisqualificationfrompublicofficeshallbeimposeduponanylocalgovernment
officialwho,havingknowledgeoftheexistenceoftheoperationofanyillegalnumbersgame
inhis/herjurisdiction,failstoabateortotakeaction,ortoleratesthesameinconnection
therewith.

b) In the case of failure to apprehend perpetrators of any illegal numbers game, any law
enforcershallsufferanadministrativepenaltyofsuspensionordismissal,asthecasemaybe,
tobeimposedbytheappropriateauthority.

Sec.6.LiabilityofParents/Guardians.Thepenaltyofimprisonmentfromsix(6)monthsand
one(1)daytoone(1)yearorfinerangingfromOnehundredthousandpesos(P100,000.00)
toFourhundredthousandpesos(P400,000.00)shallbeimposeduponanyparent,guardianor
personexercisingmoralauthorityorascendancyoveraminor,wardorincapacitatedperson,
andnototherwisefallingunderanyoftheforegoingsubsections,whoinducesorcausessuch
minor,wardorincapacitatedpersontocommitanyoftheoffensespunishableinthisAct.
Uponconviction,theparent,guardianorpersonexercisingmoralauthorityorascendancyover
the minor, ward or incapacitated person shall be deprived of his/her authority over such
personinadditiontothepenaltyimposed.

Sec.7.Recidivism.ThepenaltynexthigherindegreeasprovidedforunderSection3hereof
shallbeimposeduponarecidivistwhocommitsanyoftheoffensespunishableinthisAct.

Sec.8.ImmunityfromProsecution.Anypersonwhoservesasawitnessforthegovernmentor
providesevidenceinacriminalcaseinvolvinganyviolationofthisAct,orwhovoluntarilyor
byvirtueofasubpoenatestificandumorducestecum,produces,identifies,orgivestestimony
shallbeimmunefromanycriminalprosecution,subjecttothecompliancewiththeprovisions
of Presidential Decree No. 1732, otherwise known as Decree Providing Immunity from
CriminalProsecutiontoGovernmentWitnessesandthepertinentprovisionsoftheRulesof
Court.

Sec.9.Prosecution,JudgmentandForfeitureofProperty.Anypersonmaybechargedwithor
convictedoftheoffensescoveredbythisActwithoutprejudicetotheprosecutionofanyactor
actspenalizedundertheRevisedPenalCodeorexistinglaws.

Duringthependencyofthecase,nopropertyorincomeusedorderivedtherefromwhichmay
beconfiscatedandforfeitedshallbedisposed,alienatedortransferredandthesameshallbein
custodialegisandnobondshallbeadmittedforthereleaseofthesame.

ThetrialprosecutorsshallavailofprovisionalremediesprovidedforundertheRevisedRules
onCriminalProcedure.

Upon conviction, allproceeds, gambling paraphernalia and otherinstruments of the crime


includinganyrealorpersonalpropertyusedinanyillegalnumbersgameoperationshallbe
confiscatedandforfeitedinfavoroftheState.Allassetsandpropertiesoftheaccusedeither
ownedorheldbyhim/herinhis/hernameorinthenameofanotherpersonfoundtobe
manifestlyoutofproportiontohis/herlawfulincomeshallbe primafacie presumedtobe
proceedsoftheoffenseandshalllikewisebeconfiscatedandforfeitedinfavoroftheState.

Sec. 10. Witness Protection. Any person who provides material information, whether
testimonial or documentary, necessary for the investigation or prosecution of individuals
committinganyoftheoffensesunderSections3,4,5and6hereinshallbeplacedunderthe
WitnessProtectionProgrampursuanttoRepublicAct.No.6981.

Sec.11.Informer'sReward.Anypersonwho,havingknowledgeorinformationofanyoffense
committedunderthisActandwhoshalldisclosethesamewhichmayleadtothearrestand
finalconvictionoftheoffender,mayberewardedacertainpercentageofthecashmoneyor
articlesofvalueconfiscatedorforfeitedinfavorofthegovernment,whichshallbedetermined
throughapolicyguidelinepromulgatedbytheDepartmentofJustice(DOJ)incoordination
with the Department of Interior and Local Government (DILG) and the National Police
Commission(NAPOLCOM).

TheDILG,theNAPOLCOMandtheDOJshallprovideforasystemofrewardsandincentives
forlawenforcementofficersandforlocalgovernmentofficialfortheeffectiveimplementation
ofthisAct.

Sec.12. ImplementingRulesandRegulations.Withinsixty(60)daysfromtheeffectivityof
thisAct,theDILG,DOJ,NAPOLCOM,andotherconcernedgovernmentagenciesshalljointly
promulgate the implementing rules and regulations, as may be necessary to ensure the
efficientandeffectiveimplementationoftheprovisionsofthisAct.

Sec.13. SeparabilityClause.IfforanyreasonanysectionorprovisionofthisAct,orany
portionthereof,ortheapplicationofsuchsection,provisionorportionthereoftoanyperson,
grouporcircumstanceisdeclaredinvalidorunconstitutional,theremainingprovisionsofthis
Actshallnotbeaffectedbysuchdeclarationandshallremaininforceandeffect.

Sec.14.AmendatoryClause.ThepertinentprovisionsofPresidentialDecreeNo.1602,inso
farastheyareinconsistentherewith,areherebyexpresslyamendedormodifiedaccordingly.

Sec.15.RepealingClause.Theprovisionsofotherlaws,decrees,executiveorders,rulesand
regulationsinconsistentwiththisActareherebyrepealed,amendedormodifiedaccordingly.

Sec.16.Effectivity.ThisActshalltakeeffectfifteen(15)daysafteritspublicationinatleast
two(2)nationalnewspapersofgeneralcirculation.
