Bellarmine Nerf Wars Assumption of Liability and

Acknowledgement of Rules

This agreement dated ________, is entered into by ____________________________,


(Participant) and is effective at the signing of this agreement for the duration of Nerf Wars
(April 10, 2017-May 13, 2017).
In consideration of the terms and conditions contained herein and attached and made part of this
agreement, the parties hereto covenant and agree as follows:
1. I remain legally responsible for any personal actions taken by the named participant.
2. I understand that this event is in no way associated with Bellarmine Preparatory School,
nor is it organized by any of its officers, directors, or agents.
3. I agree on behalf of myself, or heirs, successors and assigns, to defend Bellarmine
Preparatory School, its officers, directors, and agents, from any and all actions, claims,
demands, damages, costs, expenses, and all consequential damage arising from or in
connection with my participation in Nerf Wars or in connection with any illness or injury
or cost of medical treatment in connection therewith, and I agree to compensate the
school, its officers, directors, and agents, or representative associated with Nerf Wars for
reasonable attorneys fees and expenses arising therewith.
The official rules for Nerf Wars are as follows:
1. It is the responsibility of all of the players on your team to know the rules stated herein, if
any player on your team violates the rules, your entire team is in jeopardy.
2. Teams will consist of a minimum of 3 players with a maximum of 5 players. If you have
a less than 5 players, you will not receive any special treatment or rules; you will just
have less players. There will be no exceptions for having more than 5 players on a team.
3. A kill is defined when a member of one team is hit by a Nerf Bullet fired from the gun
of a member of an opposing team.
4. All kills must be reported to bpsnerfwars2017@gmail.com within 12 hours after the
kill, including the following information: Name of who made the kill (including team
name), location of the kill, and time of the kill. You must also CC the person who
was killed. Kills not reported within 12 hours will not be counted.
5. Nerf Wars begins at 2:25 p.m. on Monday April 10th, 2017 and will continue for 5 weeks
ending at 12:00 a.m. on Saturday May 13th, 2017.
6. Every week, Nerf Wars will conclude for the week at 12:01 a.m. on Sunday and resume
at 12:01 a.m. on Monday.
7. Nerf Guns cannot be seen on the campus of Bellarmine Preparatory School. If they are
seen, security will confiscate them and you may be subject to a discussion and further
discipline from the Dean of Students.
8. Bellarmine and any Bellarmine related events (on or off campus) are Nerf Free zones (No
exceptions; this incudes away games, events where Bellarmine has chaperones, coaches,
teachers (representing Bellarmine), and any sporting event).
9. Athletic activities, including school-related sports, club activities, select activities, etc.
are all Nerf Free Zones. While a participant is on their field or place of play, they are
unable to be killed or to kill.
10. While someone is on the clock at their place of work, they are unable to kill or be
killed.
11. Participants leaving their place of work or the aforementioned activities will have a 15
minute grace period following the event where they are unable to kill or be killed. After
these 15 minutes have expired they are fair game. For athletes participating in a practice
or event, this grace period does not begin until their role in the event or practice comes to
a close (including the stowing away of equipment and post-game/practice showers).
12. Churches, holy places, and places of worship are Nerf Free Zones (Including but not
limited to the following: Churches, Synagogues, Cemeteries, etc.).
13. In the event of a disputed kill, it is the responsibility of those involved to sort out the
issue. If the teams cannot come to an understanding, each team is expected to submit a
formal explanation of the occurrence to bpsnerfwars2017@gmail.com. After a formal
review, both teams will be notified of the decision. If your team has more than three
disputed kills over the course of Nerf Wars that require formal review, your team will be
disqualified.
14. Once youve been shot, you are allowed 15 seconds to strip down to nothing but
underwear (underwear meaning bras, socks, boxers, etc.). If you successfully strip down
within the allotted time the kill is nullified and neither team is allowed to kill for 5
minutes. (Known herein as The Naked Rule).
15. The Naked Rule can only be used once per week per person.
16. Each kill is worth a set number of points based on the size of the team that the killed
participant belongs to. Killing a member of a team of five players will be worth 300
points. Killing a member of a team of four players will be worth 375 points. Killing a
member of a team of three players will be worth 500 points. Each surviving member on a
team will earn their team 100 points.
17. In the event of a tie, each team has the Sunday following the week of play to make one
final kill as a tiebreaker. This tiebreaker is sudden death; the first team to have one of
its members shot loses.
18. There is no Naked Rule in sudden death tiebreakers.
19. Unless you are explicitly welcomed into someones house, car, garage, or other place
which is of their or their familys ownership, you may not enter. Just because you are not
told that you cannot enter does not mean that you are welcome.
20. Nerf Guns, PVC guns, and modified Nerf Guns are all acceptable, however modified
guns that are paintball guns, BB guns, or propelled by anything that is not a spring or air
is NOT allowed. Additionally, Nerf Rival guns are NOT allowed. The only requirement is
that your gun fires Nerf Darts (or off-brand foam darts), must not be a paintball or BB
gun, or a gun with a propulsion mechanism besides spring or air, nor can the gun be
painted black (resemblance of an actual gun). Nerf swords, axes, shields, etc. are NOT
allowed.
21. If you are in a car accident, detained by the police, or in any other trouble as a result of
Nerf Wars, your team automatically loses for that week. If it happens more than once you
will be disqualified. Please be safe.
This agreement merges and supersedes all prior negotiations, representations, and agreements
between the parties relating to the subject matter hereof and constitutes the entire agreement
between parties.
