Judge Bob Wortham , 58 District Court, Jefferson County, Texas issued a Judgement on February 4,
2010commandingthatDr.CarrolThomas,BeaumontIndependentSchoolDistrict,WoodrowReeceand
ParsonsCommercialTechnologyGroup,Incorporateddesistandrefrainfromusinganyfunds,directlyor
indirectly, from the November 6, 2007 school board bond election, for the demolition, teardown,
destruction,ordismantlingoftheformerSouthParkHighSchoolandcurrentlyknownastheSouthPark
MiddleSchool(Exhibit1).JudgeWorthamhadissuedaTemporaryInjunctiontothedemolitionofSouth
ParkonAugust3,2009(Exhibit2).

The2007BondProjecthadapprovedtheconstructionofanewSouthParkMiddleSchoolwithoutthe
demolitionoftheexistingschool.OnApril22,2009,ParsonshadprovidedBISDwithaCostModelfor
thisdemolitionandconstructionoftheexistingSouthParkMiddleSchool.TheCostModelincludeda
line item for Site Demolition and Removal of Existing Building in the amount of $500,000. This
documentcontainstheundatedsignatureofCarrolThomas(Exhibit3).

On November 9, 2009, Parsons provided BISD with a Recommendation for Acceptance for the
DemolitionofOldSouthParkMiddleSchool.ThisRecommendedofAcceptancewastoapproveabidby
Allco Construction in the amount of $135,555 for the demolition. The document was approved by
CarrolThomasonDecember7,2009(Exhibit4).

On November 12, 2009, Terry Ingram, BISD Assistant Superintendent for Administrative Operations,
submitted a recommendation to Dr. Carrol A. Thomas that the Parsons recommendation to use the
Allco bid in the amount of $135,555 be approved and that the cost would be paid by bond
appropriatedfunds(Exhibit5).ThedocumentstatedthatParsonsandPBKArchitectsevaluatedthebid
packages submitted for the demolition. The Board approved the recommendation on November 12,
2009(Exhibit6).

OnMarch15,2010,Dr.CarrolA.ThomasrecommendedtotheBISDBoardofTrusteesthattheBoard
approvethedemolitionofSouthParkMiddleSchoolbyAllcointheamountof$135,555withtheproject
beingpaidforfromcapitalprojectfunds(Exhibit7).Thebodyofthismemoappearstobeconsistent
withIngramsmemoexceptforthesourceofthefundstobeexpendedinthatitalsostatesthatParsons
andPBKArchitectsevaluatedthebidpackagessubmittedforthedemolition.

OnMarch18,2010,theBISDBoardofTrusteesapprovedthedemolitionofSouthParkMiddleSchool
withNonBondFunds(Exhibit8).

AContractorsNoticetoProceed,datedFebruary6,2010,addressedtoAllcoadvisedthatyourNotice
to Proceed with the demolition of South Park Middle School is effective April 1, 2010 (Exhibit 9). It
furtherstatesthatKeithSchedelofParsonswillbetheProjectManager.

TerryIngramretiredfromBISDonApril1,2010.

SouthParkMiddleSchoolwasdemolishedonApril2,2010undertheoversightofParsons.

Investigation

JoePing,ProjectManagerofAllco,advisedthatheoversawthedemolitionofSouthParkMiddleSchool.
He advised that he was well aware of the Judgement issued by Judge Wortham to prevent the
demolitionofSouthParkMiddleSchoolandassuchhadcalledBISDcounselMelodyChappellonApril1,
2010todiscusstheissue.PingstatedthatChappelltoldhimthattheJudgementhadbeensetasideand
thattherewerenoprohibitionsagainstBISDfromconductingthedemolitionoftheschool.

TerryIngramadvisedthathewasawareofJudgeWorthamsordertonotdemolishSouthParkMiddle
Schoolbutwastoldbysomeonethathecouldnotrememberthattheorderhadbeenrescinded.Hedid
recallthatCarrolThomastoldhimtoteardowntheschool.

AfinancialanalysisrevealedthatAllcowaspaidthe$135,555outofnonbondfundstodemolishSouth
Park Middle School. There was no evidence of Parsons or PBK Architects submitting any bills for the
demolitionoftheschool.ParsonswaspaidanagreeduponfeefortheoversightoftheBondProject.
PBKwaspaidarchitecturalfeesunderthebondprojectonly.

Conclusion

BISDsBoardofTrusteesanditsAdministratorsdidnothonortherepresentationsmadebytheBoard
that the South Park Middle School would not be demolished should the 2007 Bond be approved.
Further, the Board and Administration did use Bond Funds, after the Temporary Restraining Order
issuedbyJudgeWortham,toplanandoverseethedemolitionofSouthParkMiddleSchoolwhenthey
used Parsons and PB Architects for the planning and oversight of the demolition. The amount of the
bond funds expended are contentious since Parsons was paid an agreed upon fee for the total bond
project.ItisremindedthatParsonsdidneedextensionstotheiroriginalagreementtofinishtheBond
Project.
