M/s. Meenakshi Energy Pvt Ltd, are informed that i n reference cited above
Statutory Approval was accorded for Generator Set having Aggregate Generating
Capacity of 150 M W Turbo Generator thereby attracting the provisions of Andhra
Pradesh Electricity Duty Act & Rules, 1939 towards submission of rnonthly returns i n
every month and payment o f Electricity Duty accordingly.

As p e r Section 3 of Andhra Pradesh Electrlcity Duty Act, 1939, "?very licensee

in the state of Andhra Pradesh shall pay every month to the State Government
in the prescribed manner, a duty calculated at the rate of six paise per unit of
energy on and in respect of all sales of energy (except sales to the Central
Government for consumption by that Government or to the Federal Railway
Authority or a Railway Company operating a Federal Railway for consumption
and in the construction, maintenance or operation of a Fedrt6i Kii;:.;..,;
effected by the licensee during the previous month at a price of more than 12
paise per unit on and in respect of all energy which was consumed by the
licensee during the previous month for the purposes other than those
connected with the construction, maintenance and operation of his electrical
undertaking and which i f sold to a private consumer under like condition would
have fetched a price more than twelve paise per unit".

As p e r Section 38 of Andhra Pradesh Electricity Duty Act, 1939 "every person or

generating company who generates energy and uses for his own purpose shall
pay every month to. the State Government a duty calculated at the rate of
twenty five paise per unit of energy on and in respect of such energy consumed
during the previous month, excluding the energy consumed in the auxiliaries of
the generating plant".

And as per Section 4(1) "Every person or generating company or a

licensee liable to pay duty under Section 3 or Section 38 shall niaintain the
b o c k of zrrcrm?s ;;I the prescribed form and shall submit the returns showing
the units of energy generated and the units of energy consumed in auxiliaries
of a generating Plant and the energy consumed for their own purposes, energy
sold to the consumers and the amount payable in respect of such energy
consumed or sold as the case may be, to such officer, in such form and at such
time as may be prescribed".

Further as p e r Rule 3 of Andhra Pradesh Electricity Duty Rules, 1939 "every

person or Generating Company shall pay Electricity Duty payab!e in respect of a
month before the expiry of the following month in to Governrnerrf".
Treasury crediting to the following Head of Account and send the Ori
Treasury Challan receipt to the Chief Electrical Inspector to Government.

Head of Account:

Major Head : 0043 Taxes and Duties on Electricity.

Minor Head : 1 0 1 Taxes on consumption and sale of electricity.
Sub Head : 0 1 Taxes on consumption and sale of electricity.

Therefore, you are requested to submit the particulars of consumptio

Electricity for self or sold in form " A A in month-wise by the isth day of the month
after the following month and pay Electricity Duty accordingly with effect
24.12.2011 and when there is no self consumption or sale, a return to that effect
be furnished failing which action to recover the Electricity Duty arrears as arrears of
Revenue will be initiated under Revenue Recovery Act besides recommending
supplier of energy of your company to disconnect the supply of energy.

Further it is to inform that failure to submit the return, the amount of Electr
Duty so determined by the Chief Electrical Inspector to Government shall be deeme
be the duty payable under Section '3 6' of Andhra Pradesh Electricity Duty Act, 1939
