Subject: Wakpamni Bond - Attorney Client Privilege - Confidential Summary

Board Members: As we discussed last Thursday, Attorney Clay Ragsdale provided an executive
summary report on the Wakpamni Bonds. We are requesting that each board member stop by the
board offices before Thursday to sign the confidentiality statement and review the report. I am
out of the office at a Water Policy Conference; therefore, Darryl Jones has the report. He will
allow you to sign the confidentiality statement and review the report. (You will not be allowed
to copy the report).

I will be in the office early Thursday morning around 7:30; therefore, you can come to BWWB
offices early Thursday morning to sign the confidentiality statement and review the report prior
to Thursday's board meeting.

We plan to have an executive session on this issue during Thursday's board meeting.
