REGULATION ORDINANCE N.0. 2012-180


AN ORDINANCE ON "LIQUOR BAN FOR MINORS"
IN THE CITY OF ILOILO

Sponsored by Councilor Plaridel C. Nava II, duly seconded by


Councilors Sheen Marie S. Mabilog, Jason R. Gonzales, Ely A.
Estante, Jr. and Lyndon V. Acap

WHEREAS, the Sangguniang Panlungsod has properly enacted Ordinance No. 59, Series
of 1956 on November 2, 1956 regarding banning liquors for minors;

WHEREAS, in Ordinance No. 59, Series of 1956 the minority age is 20 years;

WHEREAS, Ordinance No. 59, Series of 1956 necessitates amendment in order to be


effectively implemented.

NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of the City of


Iloilo, by virtue of the powers vested in it by law, in session assembled, that:

Section 1. - Title . This ordinance shall be known as "The Ordinance on 'Liquor Ban
for Minors' in the City of Iloilo".

Section 2. - Definition of Terms.

a) Minor- a person under the age of 18 years old.


b) Child in Conflict with the Law - a child who is alleged as, accused of, or adjudged as,
having committed an offense under Philippine Laws.
c) Parent/Guardian - those who is either the father or the mother and/or both, who
exercise parental authority over the minor or in their absence, those who can exercise
substituted parental authority pursuant to the Civil Code of the Philippines, as
amended.
d) Liquor - any liquid substance distilled or fermented such as beer, whisky, gin, rum,
brandy "tinto", wine or any similar drink with at least 9% alcohol content.
e) Alcoholic beverage - any distilled or undistilled, fermented, brewed liquid substance
with at least 4% alcohol content including beer, wine may be native wine (i.e.
coconut wine-tuba, lambanog, rice wine - basi) and the likes

Section 3. -Prohibited Acts.

a) It shall be unlawful for the permitee, owner, manager, operator or any person in-
charge of any nightclubs, motels, dancehalls, music lounges, amusement places such
as internet cafes, video arcades, karaoke/disco bars, billiard halls, beach resorts,
refreshment parlor, sari-sari store, halls, kiosks set up during public
festivals/festivities or special occasion/celebration authorized by the City Mayor, or
any similar public or private establishments in the City of Iloilo, to serve, sell, or
dispense with whether for value or for free, any alcoholic drink and/or liquor, such as
beer, whisky, rum, gin, brandy ''tinto", tuba/lambanog (coconut wine), "basi' (rice
wine) and the like to any minor under 18 years of age of both sexes;
b) It shall be unlawful for any minor under 18 years of age of both sexes to drink, take,
possess, purchase or even attempt to purchase any liquor or alcoholic beverages
specified in Section 3 (a) hereof, and in any other public places;
c) It shall be unlawful for any minor under 18 years of both sexes to engage in vending
or selling as well as to serve any liquor or alcoholic beverages in any establishments;
d) It shall be unlawful for a liquor selling establishment from allowing a minor to loiter
in a permit premises where liquor is kept for sale or be in a room where liquor is
served at a bar, unless the minor is in the company of his parent or guardian.

Section 4. - Any business establishment mentioned in Section 3 (a) shall be required to


post notices at the entrance door or any conspicuous places in their establishments such as

Section 5. - Penalties.

Any establishments found violating this ordinance shall be meted the following
sanctions:

First violation - closure of the place of business for three (3) days
Second violation - closure of the place of business for five (5) days
Third violation - closure of the place of business for ten (10) days
Fourth violation - revocation of business permit

PROVIDED, however, that during a certain festival/festivity/special occasion/celebration


authorized by the City Mayor, there will be a corresponding immediate closure of the kiosk,
restaurant and bars in violation of this ordinance.

Section 6. - The City Mayor shall be authorized to form a task force to implement the
provisions of this ordinance. The Punong Barangays, Sangguniang Kabataan (SK Officials and
the Civilian Voluntary Officer are also mandated to enforce this ordinance within their
respective jurisdiction and to conduct inspection on establishments situated in their respective
barangays for the purpose of enforcing and implementing this ordinance.

Section 7. - The minor found violating this ordinance shall be immediately committed or
remitted to the nearest office of the Department of Social Welfare and Development (DSWD) or
to the City Social Welfare and Development Office (CSWDO) for care, custody and proper
disposition in accordance with the provision of Republic Act 9344 (Juvenile Justice and Welfare
Act of 2006). From the moment a minor found violating this ordinance is taken into custody, the
law enforcement officer shall carefully observe the procedure laid down in Section 21 of
Republic Act 9344.

Section 8. - The parent/s or guardian of the child in conflict with . , this "Liquor Ban
for Minor Ordinance" shall also be criminally liable, if found guilty by appropriate court of
consenting to or allowing their minor to drink, take, possess, purchase or even attempt to
purchase any liquor or alcoholic beverages specified in Section 3 (a) hereof, and in any other
public places, and shall suffer the penalty of imprisonment of not less than thirty (30) days and
not more than six (6) months.

Section 9. -Any person of legal age found in the company of the minor violating this
liquor ban ordinance shall also be criminally liable, if found guilty by appropriate court of
consenting to or allowing the minor to drink, take, possess, purchase or even attempt to purchase
any liquor or alcoholic beverages specified in Section 3 (a) hereof, and in any other public
places, and shall suffer the penalty of imprisonment of not less than thirty (30) days and not more
than six (6) months.

Section 10. - All heads of private and public schools within the city shall be directed to
properly disseminate the "Liquor Ban for Minor Ordinance" to their minor students, as well as
their parents and guardians, and to enjoin them to strictly observe the provisions of said
ordinance.

Section 11. - The Office of the City Secretariat shall be required to provide copies of this
ordinance to all one hundred eighty 09'0) barangays, public and private educational institutions in
the City of Iloilo for proper information and dissemination.

Section 12. - This ordinance hereby repeals Ordinance No. 59, Series of 1956 and
Ordinance No. 284, Series of 1981 and all other ordinances inconsistent with the provisions
herewith.

Section 13. - This ordinance shall take effect after ten (10) days from publication in a
local newspaper of general circulation in Westem Visayas.
