SUPERIOR COURT FOR THE DISTRICT OF COLUMBIA CRIMINAL DIVISION UNITED STATES ve DEVONE L FOOTE Apr. 05, 2017 Supplemental Gerstein: This event took place at the Smithsonian National Museum of Natural History, located at 1000 Constitution Avenue NW, Washington, DC. Smithsonian Corporal Peets and Sergeant Temeka Williams told Your Affiant stated that on April 4, 2017, they spoke over the telephone with a Smithsonian volunteer stationed at the butterfly exhibit (where the crimes occurred) and also a child victim. Thie volunteer stated saw she saw a man (description below) a few times in the middle of the crowd of young girls in her station. He was very close to them. She also noticed the he had his hips pressed forward with the front of him touching a girl with his mid-section. At that time she approached him and told him that he had to leave the museum. The man complied but circled around and came back into her area. She also noticed that the defendant had an erection while he was in the crowd of people, including the children. The students disclosed the sexual touchings to this volunteer. The volunteer and the children victims provided a description of the man who sexually touched the children. The description they provided of the man in the butterfly area who touched the children was a tall black guy, braids, white t-shirt, black shorts, tennis shoes, and white baseball cap. When the defendant was arrested, he was wearing a white t-shirt, black shorts with leggings underneath, and a black baseball cap. The defendant is African American, has long braids, and appeared to be tall in stature. The child victims told law enforcement that the defendant touched them in the following ways. CWi, a 14-year-old girl, said that the defendant made contact between his penis and her buttocks and he made contact between his hand and her buttocks. CW2, a 14-year-old girl, said that the defendant touched her on the arm and leg. CW3, a 14-year-old girl, said that the defendant's body touched her buttocks. CW4, a 14-year-old girl, said that the defendant’s hand touched her buttocks. CWS, a 13-year-old girl, said that the defendant’s body touched her back, CWS, a 14-year-old girl, said that a man touched her buttocks with his hand, and CW7, a 14-year-old girl, said that the defendant touched her arm and tapped her back.
