16 The Court has reviewed Defendants Motion to Dismiss, or in the Alternative,
17 Motion for Trial by Jury (Doc. 130). The motion will be denied for two reasons. First,
18 the motion was filed after the deadline set by the Court for pre-trial motions. Second, the
19 Court has already considered and ruled on the issues raised in Defendants motion. See,
20 Docs. 60 and 83.
21 IT IS ORDERED denying Defendants Motion to Dismiss or in the Alternative
22 Motion for Trial by Jury (Doc. 130).
