Jefferson St. Rockville, MD 20850 Dated: April 3, 2017 Comment The defendant will enter a plea of guilty to the following counts of the indictment in case 129614-C: (1) murder in the first degree of Malcom Winffel, (3) attempted first degree murder of Bolormaa Baljinnyam, (5) attempted first degree murder of Carl Unger, (7) murder in the first degree of Claudina Molina. ‘The defendant will make a full admission of guilt and will not offer a nolo contendere or an Alford-type plea. Pursuant to the plea agreement, the defendant will waive his right to petition for a sentence review by a three-judge panel Pursuant to the plea agreement, the State will withdraw one notice of intention to seek a sentence of life imprisonment without the possibility of parole. The State retains sole discretion of which notice will be withdrawn. Pursuant to the plea agreement, after one notice is withdrawn, the maximum potential penalty for these crimes is one term of life imprisonment without the possibility of parole to be followed by three consecutive terms of life imprisonment. Both the State and defendant remain free to allocute for any legal sentence. This agreement has no impact on any other case, including the pending matter in Prince George's County.
