Under and by virtue of the authority vested in me by Title 5, Subtitle A, Chapter 143 of the Local
Government Code, V.T.C.S., said chapter entitled "Municipal Civil Service", I do hereby suspend
Officer James V. Redus from paid duty with the San Antonio Police Department for a period of one
calendar day, commencing on March 27, 2017, and ending on March 27, 2017.

Officer Redus has violated Subsection C of Rule XIII of the City of San Antonio Fire Fighters' and
Police Officers' Civil Service Commission Rules, said rules having been adopted on February 23,
1998, and thereafter from time to time amended, by the Fire Fighters' and Police Officers' Civil
Service Commission as the Civil Service Rules for the Fire and Police Departments of the City of
San Antonio. The particular civil service rule violated by Officer Redus and ground for suspension
is as follows:

(12) Violation of an applicable fire or police department rule or


special order.

The Rules and Regulations of the San Antonio Police Department which Officer Redus has violated
are as follows:

RULE 3.18 - CITY EQUIPMENT/PROPERTY (A) IMPROPER OR


NEGLIGENT HANDLING: Improper or negligent handling of any
city property or willful damage to city property is prohibited.

The factual basis for the instant disciplinary suspension is as follows:

On or about December 13, 2016, at approximately 2:25 p.m., while on


duty and operating a city-owned vehicle in the 11700 block of
Huebner Road, Officer James V. Redus negligently struck a vehicle.

The level of this suspension is based upon Officer Redus' cumulative point total for this accident
and other chargeable accidents within the twenty-four month period prior to this accident as per
Pro9edure 303.17 of the San Antonio Police Department General Manual.

A copy of the instant disciplinary suspension order is being filed with the Fire Fighters' and Police
Officers' Civil Service Commission.

AGREED SUSPENSION

Commissioners and Detective Phillip Z. Wang:

WHEREAS, Detective Phillip Z. Wang, pursuant to Article XXVIII, Section 2 of the Collective
Bargaining Agreement by and between the City of San Antonio and the San Antonio Police
Officers' Association, was served on March 13, 2017, with a ten-day contemplated suspension;
and

WHEREAS, pursuant to said contract, Detective Wang was given an opportunity to rebut those
charges being brought against him to Police Chief William P. McManus; and

WHEREAS, said opportunity was exercised by Detective Wang; and

WHEREAS, Detective Wang and Chief McManus have agreed to reduce the discipline in this
matter to a three-day suspension without pay; NOW THEREFORE:

The undersigned parties hereby enter into this suspension agreement wherein it is provided that
Detective Wang shall be suspended without pay from the San Antonio Police Department for a
period of three days, commencing on April 9, 2017, and ending on April 11, 2017. Detective
Wang waives any rights to appeal this Agreed Suspension and agrees no administrative or
judicial body shall have power to review this Agreed Suspension or alter the terms of this
agreement.

PROCEDURE 501 - USE OF FORCE (.10) USE OF FORCE


REPORT RESPONSIBILITIES (A) Officers shall complete SAPD
Form #62-UOF, Use of Force Report, under the following
circumstances: (2) Any force used by an officer which causes an
individual to impact the ground/floor, object, or another person
(e.g. a push, leg sweep, hip throw, etc.). This does not include
those situations where a suspect is directed and voluntarily goes to
their knees or assumes a prone position on the floor, prior to being
handcuffed.

The factual basis for the instant disciplinary suspension is as follows:

On or about September 28, 2016, at approximately 6:30 p.m.,


Detective Phillip Z. Wang mistreated Mr. Raymond McKinney.
This mistreatment occurred while Mr. McKinney was a prisoner in
police custody.

Detective Wang choked Mr. McKinney, causing pain to Mr.


McKinney, a prisoner at the time of the incident. Pain occurred
while Mr. McKinney was standing and after Mr. McKinney was
taken to the ground.

It is further alleged Detective Wang failed to complete a Use of


Force Report following the incident.

A copy of the instant disciplinary suspension order is being filed with the Fire Fighters' and
Police Officers' Civil Service Commission.

suspension; and

WHEREAS, pursuant to said contract, Detective Cordero was given an opportunity to rebut

WHEREAS, said opportunity was exercised by Detective Cordero; and

WHEREAS, Detective Cordero and Chief McManus have agreed to reduce the discipline in this

CONDUCT AND BEHAVIOR: Members, on-or off-duty, shall be I: 48
governed by the ordinary and reasonable rules of good conduct and
behavior, and shall not commit any act tending to bring reproach or
discredit on themselves or the department.

The factual basis for the instant disciplinary suspension is as follows:

On or about August 26, 2016, Detective Xavier M. Cordero


became involved in a domestic disturbance with his
Law
enforcement personnel were called to the address but Detective
Cordero left the scene prior to their arrival. San Antonio Police
Officers made contact with Detective Cordero, who agreed to turn
himself in the following morning.

The following morning, August 27, 2016, Detective Xavier M.


Cordero turned himself in at the Bexar County Jail where he was
arrested. Formal criminal charges were never filed.

During the incident making the basis of his arrest, Detective


Cordero failed to abide by the ordinary and reasonable rules of
good conduct and behavior. His actions brought discredit both to
himself and the department.

A copy of the instant disciplinary suspension order is being filed with the Fire Fighters' and
Police Officers' Civil Service Commission.

Officer Juarez shall be suspended without pay from the San Antonio Police Department for a

Officer Juarez not be involved in a chargeable traffic accident in the year following the issuance
of this agreed suspension, upon application by Officer Juarez within two weeks of such date, and
approval by the Chief of Police, five days' pay and benefits will be returned to Officer Juarez.
Officer Juarez waives any rights to appeal this Agreed Suspension and agrees no administrative
or judicial body shall have power to review this Agreed Suspension or alter the terms of this
agreement.

accident and other chargeable accidents within the twenty-four month period prior to this
accident as per Procedure 303 .17 of the San Antonio Police Department General Manual.

Captain Ury has violated Subsection C of Rule XIII of the City of San Antonio Fire Fighters'
and Police Officers' Civil Service Commission Rules, said rules having been adopted on
February 23, 1998, and thereafter from time to time amended, by the Fire Fighters' and Police
Officers' Civil Service Commission as the Civil Service Rules for the Fire and Police
Departments of the City of San Antonio. The particular civil service rule violated by Captain
Ury and ground for suspension is as follows:

The Rules and Regulations of the San Antonio Police Department which Captain Ury has
violated are as follows:

RULE 3.03 - OBEY LAWFUL ORDERS: Members shall


promptly and willingly obey all lawful orders and directions given
by supervisory officers and shall comply with instructions given by
the police dispatcher. (A) INSUBORDINATION: Defying the
authority of any supervisory officer by obvious disrespect,
disputing orders, failure and/or deliberate refusal to obey any
lawful order given by them shall be deemed insubordination.

RULE 3.17 - OUTSIDE EMPLOYMENT (A) PERMISSION


REQUIRED: Members of the Department shall not engage in any
outside employment, nor own, operate, or have any financial
interest in any business activity without the approval of the Chief
of Police.

The factual basis for the instant disciplinary suspension is as follows:

On or about January 2, 2017, and continuing thereafter, Captain


Shawn R. Ury intentionally violated department policy when he
worked an off-duty job without an approved off-duty employment
permit - as is required.

Following separation from the Department, the training requirements to maintain an officer's
peace officer's license for the current training cycle and unit are that officer's responsibility. An
officer should refer to the TCOLE website http://www.tcole.texas.gov/content/training-
reguirements for further information and to establish a TCOLE account to review current
training records.
