On behalf of the Consumer Technology Association (CTA) and our over 2,200 member companies, I ask
that you oppose SB 226. This bill began as a good faith negotiation between all parties regarding
transportation network company (TNC) business licenses. Unfortunately, a poison pill amendment was
inserted in the bill at the last minute, forcing us to strongly oppose SB 226. As currently written, the bill
threatens the future operation of TNC companies in Nevada.
As the owner and producer of CES held each year in Las Vegas, CTA is acutely aware of the benefits that
transportation choice has brought to Nevada. Over the past two years when Uber and Lyft have been
operational in Las Vegas during CES, our over 170,000 attendees have experienced significantly shorter wait
times for all forms of transit. Taxis, TNCs and other services all play a critical role in making sure our show
attendees can easily access locations across the city of Las Vegas and beyond.
The Carrillo amendment to SB 226, which was added to the bill at midnight on the Friday of Memorial Day
weekend, would upset the balance of transportation options available in Nevada. Specifically, it would
require TNCs to carry insurance far beyond what is required in any other state. It is indisputable that TNCs
should carry reasonable levels of insurance, but Nevada law already requires insurance coverage that meets
or exceeds the requirements of most other states.
Business license provisions in the Carrillo amendment to SB 226 are also very problematic. Nevada law
currently induces rigorous business licensing provisions. SB 226 unnecessarily complicates the process of
acquiring a business license for TNC drivers. It also puts drivers' personal information at risk by requiring
that sensitive data - including individual social security numbers be shared in a manner that is ultimately
insecure.
Testing of self-driving vehicles by TNC companies in any scenario where the car is transporting passengers
would be banned by SB 226. Nevada has worked hard to develop a reputation as one of the leading
destinations for innovative companies in the United States. Threatening existing innovations and
prohibiting testing that leads to cutting edge technologies would be a major step backward.
We look forward to working with the legislature to ensure that smart regulation allows innovation to thrive
and create jobs in Nevada. Unfortunately, SB 226 does exactly the opposite. CTA strongly encourages you
to oppose this last minute attempt to enact an anti-competitive law that could drive many TNC services out
of Nevada.
