SUPERIOR COURT FOR THE DISTRICT OF COLUMBIA CRIMINAL DIVISION UNITED STATES ve BRANDON L FIRGUES-MORMON gun. 10, 2017 on Thursday, June 8, 2017, uniformed members of the Third Police District were on routine patrol in the 2400 block of 18th Street, N.W., in Washington, D.C., located in the Adams Morgan section of the city, an area known for dining and nightlife. The officers were clad in their full uniform of the day. The officers were routinely monitoring both pedestrian and vehicular traffic. Lighting in the area included numerous street lamps and lights from businesses and other buildings located in the block. Shortly before 9:00 pm, witnesses observed a Washington Metropolitan Area Transit Authority (“WMATA”) Metro bus come to a complete stop in the northbound roadway alongside 2453 18th Street, N.W. A car stopped in front of the bus so that eccupants could exit the car. This caused the bus to come to a complete stop. Suddenly, a white Dodge pick-up truck bearing Virginia Tag VRA 9593, rushed around the stationary bus at a high rate of speed striking a uniformed police officer, hereinafter referred to as C-1. The truck continued northbound striking a second uniformed police officer, hereinafter referred to as C-2, without stopping and then struck a uniformed DC Department of Transportation (*DDOT") employee, hereinafter referred to as C-3. The truck fled the block at a high speed and continued to travel into the nearby 1800 block of Adams Mill Road, where the pick-up truck collided with a large unoccupied sanitation truck that was parked in the block. The force of impact jarred a portion of the sanitation truck onto the sidewalk. Additional uniformed police officers who were in the area immediately removed the driver (hereinafter referred to as 8-1), from the heavily damaged pick-up truck and arrested both S-1 and the passenger (hereinafter referred to as W-1). Observed in plain view in the rear left passenger area was a Romarm 7.62 x 39 mm, AK-47 assault rifle, and a sealed box that appeared new, with a label listing a ‘cz Scorpion EVO pistol CAL 9 MM Luger” - which likely contains a 9 millimeter firearm. Observed in the rear right passenger area was a circular metal “Drun* magazine. The victims were rushed to local hospitals via ambulance. C-2 was rushed to the hospital in critical condition. C-1 was rushed to the hospital in etable condition and found to be suffering from injuries to his ankle, and C-3 was rushed to the hospital in stable condition. $-1 and W-1 were rushed to a local hospital via ambulance. A concomitant investigation into the facts of the case was initiated by the MPD Major Crash Unit and the MPD Major Case Unit. The initial scenes were processed by Forensic Scientists of the DC Department of Forensic Science (“DFS”). The white Dodge pick-up truck was transported to the DFS storage facility located at 401 5 Street, S.W., pending the application and issuance of a DC Superior Court Search Warrant. Prior to being transported from the scene, the AK-47 assault rifle was removed from the vehicle for precautionary reasons and is now in the possession of the DFS. All other evidentiary items were kept inside the vehicle. on Friday, June 9, 2017, W-1 was interviewed by Detectives of the Major Case Squad. W-1 stated that IT knows 8-1 (Brandon Figures-Mormon). W-1 stated that, on June 8, 2017, S-1 picked up W-1 in Virginia a white pick-up truck, and S-1 and W-1 traveled together in the white pick-up truck to the 2400 block of lath Street, N.W., in Washington, D.C., where S-1 parked. W-1 said that they remained parked in the block for around 30 minutes and that during that time they both smoked a quantity of “Dab.” (Dab or Dabs are concentrated doses of cannabis that are made by extracting THC and other cannabinoids using a solvent like butane of carbon dioxide, resulting in sticky oils commonly referred to as ‘wax, “shatter,” “budder,” and butane hash oil ("BHO").) According to Wi-1, while parked in the block, $-1 began to view his cell phone (as if he were viewing text messages or something) when he suddenly put the vehicle in drive and sped northbound on 18th Street N.W. W-1 said that he beckoned to S-1, frantically asking him what he was doing, and that S-1 continued to drive directly towards the uniformed officer, striking him with the vehicle. W-1 said that after S-1 struck the police officer he continued to drive the vehicle striking other objects. W-1 said he could not tell if those objects were other people. W-1 said that S-1 continued to drive the vehicle at a high speed until they struck a fixed object. W-1 was in custody when he provided this account; W-1 was advised of his Miranda rights and waived them. W-1 was asked about the firearms observed inside the white pick-up truck. W-2 stated that IT never saw the firearms and did not know that they were in the pick-up truck. The detectives encouraged W-1 to be truthful, and no promises were made to W-1 by law enforcement or offers of any type of assistance with his pending case. W-1 made no indication that by talking with police he was making an attempt to curry favor with the police or the government. An additional witness, hereinafter referred to as W-2, was interviewed by law enforcement. W-2 stated that IT and S-1 (who W-2 referred to as “Brandon") came to the Chantilly, Virginia area on June 8, 2017, to participate in a local firearms expo. W-2 said that he placed the AK-47 rifle under the rear seat of the white pick-up truck because he could not store the weapon in their hotel room. W-2 said that $-1 was present when the rifle was placed in the vehicle on ‘Thursday and that S-1 also knew about the boxed firearm. W-2 said that he had forgotten to remove the boxed firearm from the vehicle. W-2 said that 8-1 borrowed the truck to go to a local store on Thursday evening and that was the last he saw S-1 or the truck. W-2 said that late Thursday night he saw news coverage about the police officers being injured in the Adams Morgan area and recognized the white pick-up truck on television. An individual who was at the scene, hereinafter referred to as W-3, provided a handwritten statement to police regarding the incident. W-2 stated that IT saw the Dodge Ram hit the sanitation truck. According to W-3, the passenger said the driver had taken two dabs about one hour prior to the impact. According to W-3, approximately 3-4 minutes after W-3 arrived, the driver was still non- responsive. W-3 said that the passenger appeared dazed. W-3 said that the passenger said they didn’t drink but that his friend took two dabs about one hour ago at a club. W-3 asked the passenger if the passenger took it as well, and the passenger said no. Another individual, hereinafter referred to as W-4, spoke to law enforcement personnel on June 9, 2017. W-4 stated that IT knows S-1 (who W-4 referred to by name), and that IT has known $-1 for several years. W-4 stated that approximately two and a half years ago, S-1 began making negative comments about police officers to the effect of “all police need to die.” As recently as Wednesday, June 7, 2017, S-1 sent an electronic message via the electronic platform, “Snapchat,” that W-4 received. In that message, S-1 advocated killing police officers. Multiple witnesses who were at or near the scene of the incident described observing the truck driving at a high rate of speed and in the median as it approached the two uniformed officers (C-1 and C-2) and reported that the truck did not stop as it approached and hit the third victim C-3. The witnesses also reported that the truck did not stop after hitting the third victim c-3 and instead continued driving through a red stop light and down the street until crashing into a sanitation truck. According to video obtained from the Metro bus which captured a portion of the incident by the white pick-up, at the time that they were hit, C-1 and C-2 were standing a considerable distance apart from each other in the median and C-3 did not appear to be standing next to either C-1 or C-2. According to medical professionals, C-2 suffered multiple injuries, including trauma to his head and a punctured heart due to fractured ribs. C-2 is currently in the Intensive care Unit and is in serious but stable condition. He is expected to be in the hospital for one week. C-1 suffered a fractured nose, a sprained right ankle, injuries to his right hand and second degree burns on various parts of his body as a result of road abrasion. C-1 was discharged from the hospital after one day. C-3 was treated at the hospital the same day and released.
