A constitution is a set of rules which governs an organization.

Every organizations, societies,


clubs or parties need a constitution in order to define the powers, rights, duties of the
members. Professor KC Wheare has defines the constitution of a state generally as: the
whole system of government of a country, the collection of rules which establish and regulate
or govern the government. It means that the constitution is a set of rules which govern the
governments internal and external regulation. However, Thomas Paine reveals a more
complex set of ideas, which he said that, a constitution is not the act of a government, but of a
people constituting a government, and a government without a constitution is power without
right. A constitution is a thing antecedent to a government; and a government is only the
creature of a constitution.

A constitution rule can be in written or unwritten form. A constitution rule will also reveal
differences in the manner in which they may be changed based on the circumstances. Under a
written constitution, the constitution will itself define the procedure for amendment and may
provide for varying degrees of ease or difficulty in amendment in relation to particular rules.
It is because a constitution cannot be easily changed, it must follow certain procedure or
states to get a unanimous consensus by all the members. In Malaysia, we have our own
Federal Constitution. Article 4 in the Federal Constitution stated that this Federal
Constitution is the supreme law and any law which against it might consider as void.

The constitution sets limits both to the powers which can be exercised and to the manner in
which they may be exercised. On the other hand, a constitution also defines the legality of
power. This idea is particularly appropriate for a particular situation in a country with the
written constitution and a Supreme Court which is conferred with jurisdiction to rule on the
legality of government action. Any actions of the government which against the Federal
Constitution will consider as unlawful refer to Article 4. The actions taken by the government
must look for the rights of the people and the needs of the people. Although an unwritten
constitution is less clear-cut, but it still been applied in Great Britain. Sir Ivor Jennings,
author of The law and the Constitution stated that, if a constitution means a written document,
then obviously Great Britain has no constitution. In countries where such a document exists,
the word has that meaning. But the document itself merely sets out rules determining the
creation and operation of governmental institutions, and obviously Great Britain has such
institutions and such rules. The phrase British constitution is used to describe those rules.
