COUNTER - AFFIDAVIT

That I, is Juan Dela Cruz, of legal age, with post address at xxxx, Cebu City,
after having been duly sworn to according to law hereby depose and say:

I have been connected with the Lugod Makers since July 2003, with a daily wage
of one hundred fifty pesos only

That on or about ten oclock in the morning of August 1, 2007 in Jones Avenue,
Cebu City, Philippines, I was asked to buy some items in the local hardware, shown in
Purchase Order Request and the Petty Cash Voucher. All of which summed up to P
3000.00 as evidenced of the receipt that complainant handed to respondent

That directly after buying the items, the receipt was handed to the complainant
immediately after been having been issued by the local hardware.

That no other place or person had custody of the receipt after been issued by the
hardware other than me and the complainant.

That no other form or acts including erasures, markings, tampering, deleting,

adding signs had been done except the handing of the receipt to the complainant Pedro
Pindoko

That upon checking the receipt and for no apparent reason, respondent asked
complainant about tampering of the receipt, as if the act was done by the complainant

That I am executing this affidavit under oath and having subscribed and sworn to
in accordance with law
