In Question and Answer Form Pursuant to A.M. No. 12-8-8-SC otherwise known as
Judicial Affidavit Rule, taken before ATTY. FAITH CHAREEN D. ROLLAN, in her office at UNIT
5, AVIDA BLDG., SOUTH ROAD PROPRETY, CEBU.

I, JERRY LATORRE, 45 years old, married, Filipino and a resident of Colon, Toledo
City, Philippines, after having been duly sworn to in accordance with law, do hereby depose
and state:

Q 1: Are you fully conscious that you execute this Judicial Affidavit under oath, and that you
may face criminal liability for false testimony or perjury if you commit falsehood.
A 1: Yes.

Q 2: Why are you in my office today?

A 2: To file a case against Jerry Latorre for estafa.

Q 3: In what capacity are you suing Jerry Latorre?

A 3: I am given the authority by ABC Corporation to represent them.

Q 4: Do you have any proof to prove the authority given to you by ABC Corporation?
A 4: Yes, Atty., here is a copy of the Secretarys Certificate authorizing me to represent ABC
Corporation. (The Secretarys Certificate is herein attached as Annex A)

Q 5: Who is Jerrry Latorre?

A 5: He was the manager of the motorcycle store owned by ABC Corporation in Toledo City.

Q6: Do you have any proof to show that indeed Jerry Latorre was a manager of ABC
Corporation?
A 6: Yes, Atty., here is a copy of the employment contract signed by Mr. Latorre accepting the
position as manager of ABC Corporation. (The employment contract is herein attached
as Annex B)

Q 7: Why would you file this case for estafa against him?
A 7: Because he failed to remit to ABC Corporation the Fifty Thousand Pesos (P 50, 000.00)
for the sales of motorcycles from January 2001 to December 2003.

Q 8: Do you have any proof to show that Mr. Latorre failed to remit the said amount you
mentioned?
A 8: Yes, Atty., here is the accounting records for year 2001, 2002 and 2003. (The
accounting records for 2001, 2002 and 2003 are herein attached as Annexes C D
E, respectively)

Q 9: Do you have any more to add?

A 9: None, Atty.
