Furthermore,inSergeiMagnitsky'stestimonytoRussiasInvestigativeCommitteeon5June2008,heconfirmedhisprofession
asalawyer:BasedonmyprofessionalactivityIprovideadvisoryservicesonmattersofRussianlaw.

Finally,RussiasPresidentVladimirPutinsaidatapressconferenceonDecember20,2012:MisterMagnitsky,itisknown,
wasnotsomerightsdefender,hedidnotfightforhumanrights.HewasMisterBrowderslawyer.

Justtobeclear,Magnitskywasnotabarrister,andthereforecouldnotrepresentclientsincriminalcourt,butdidrepresent
clientsincivilcourt.

eveningofNovember16,2009thenighthedied.

InJuly2011,RussiasPresidentialHumanRightsCouncilreferredtothebeatingofMagnitskyandhisinjuriesintheirreport:
Asaresult,Magnitskywascompletelydeprivedofmedicalcarebeforehisdeath.Inaddition,thereisreasonable
suspiciontobelievethatthedeathwastriggeredbybeatingMagnitsky:laterhisrelativesrecordedsmashedknuckles
andbruisesonhisbody.

Magnitsky'sDeathCertificatereferstoacerebralcranialinjury.

TheforensicpostmortemconductedbyRussianstateexpertsreferstoinjuriesonMagnitsky'sbodyconsistentwiththeuseof

andtheRussianstate.

OnJune5,2008,MagnitskygaveaswornstatementtoRussiasInvestigativeCommitteeinwhichhespecificallynamed
RussianpoliceofficerArtemKuznetsovandRussianinvestigatorPavelKarpov.

OnOctober7,2008,SergeiMagnitskymadeanadditionalswornstatementtoRussiasInvestigativeCommitteeinwhichhe
describedthetheftof5.4billionrubles(~230millionU.S.dollars)ofRussiantaxrevenuebythesamegrouphehaddescribed
inhisinitialtestimonyofJune5,2008aboutthefraudagainsthisclient.

OnNovember21,2008,officerKuznetsovwasassignedtodetainMagnitsky.

OnNovember24,2008,KuznetsovssubordinatesarrestedMagnitsky.

OnOctober14,2009,MagnitskygavefurthertestimonytoRussiasInteriorMinistry,inwhichhereiteratedhisprevious
testimonynamingKuznetsovandotherpoliceofficersstatinghisbelieftheywerecomplicitinthefraudagainsthisclientandin
thetheftof5.4billionrublesofstatefunds.

HewasdetainedovertaxevasionbyBrowderscompanies

ThetaxevasionchargewasapretextusedfordetainingSergeiMagnitskyafterhistestimoniesimplicatinggovernment
officials.ThisisreferencedintheU.S.DepartmentofStates2009CountyReportsonHumanRightsPractices,whichstates,
AfterMagnitskygavetestimonyincourtin2008againstKuznetsovandKarpov,officialschargedandarrestedhimontax
evasionchargesthatmanyobserversbelievedwerefabricated.

Infact,therearecredibleallegationsincourtdocumentsthatBrowderandhisassociatesaresuspectsinthefraudand
thatBrowderconcoctedthewhistleblowerstorytocoverthatup.

TheU.S.DepartmentofJusticerejectsthispositioninthegovernment'sfilingwiththe2ndCircuitAppealsCourtaboutthis
case:

fortheavoidanceofdoubt,Baker&Hostetlersaccusationsarefalse.Hermitageisavictimnotaperpetrator
oftheRussianTreasuryFraudInanyevent,thereisnoquestionherethatthe[USGovernment]complaintalleges
HermitageisavictimoftheRussianTreasuryFraud.26Thatfraudresultedin,amongotherthings:alaw
enforcementraidontheofficesofHermitageanditslawfirm(A.312-13(Compl.24-25))thetheftofthree
HermitageFundcorporations(A.313-14(Compl.26-28))thefraudulentimpositionofhundredsofmillionsof
dollarsoffictitiousliabilitiesuponthem(A.314-17(Compl.29-37))theuseofthesestolencompaniesto
perpetrateatheftfromRussiantaxpayers(A.317-20(Compl.38-45))theneedforextensivelegalactionto
remediatethefraud(A.322-23(Compl.55-56,59))andtheinstitutionofretaliatorycriminalproceedingsagainst
Hermitageagentswhoreportedthefraud(A.323-25,327(Compl.58,61-68,72))Indeed,Baker&Hostetler
itself,inconnectionwithitspriorrepresentationofHermitage,hasexplicitlyrecognizedthatHermitageisavictimof
theRussianTreasuryFraud.Case16-132,Document118,02/16/2016.

Allthesupposedlyindependentreportsaboutthisinthemediaand,forexample,bytheCouncilofEurope,gottheirkey
informationfromBrowderorfrompeoplewhotracebacktoBrowder

Ofcourse,wehavecommunicatedwiththevictims,whichincludeSergeiMagnitskysfamily,BillBrowder,andother
representativesofHermitage.WealsocommunicatedwithrepresentativesoftheGovernmentofRussiaandtheEuropean
Union.

TheMagnitskyActistheculminationofexhaustiveinvestigationincludingopensourceandclassifiedmaterials,publicdebate,
andpoliticalnegotiationsspanningtwoCongresses.

AsfortheCouncilofEuropereport,theRapporteurdescribedtheirinformationgatheringinthefollowingmanner:

InordertoallowtheRussianauthoritiestogivemetheirofficialviewsonthedifferentaspectsofthecase,I
wenttoMoscowfirst,between13and16February2013.Next,from25to27April,ItravelledtoLondonin
ordertomeetboththecompetentBritishauthoritiesandSergeiMagnitskysformerclient,BillBrowder.
Alreadyon7January,ImetwiththeSwissProsecutorGeneralandhisDeputyand,on29and30April,withthe
competentCypriotauthorities.Finally,on20and21May2013,IreturnedtoMoscowinordertohearthe
Russianauthoritiesresponsetotheissuesraisedbyalltheotherinterlocutorssincemyfirstvisit.


AsfortheRussianfilmmakeryoumention,IassumeyoumeanAndreiNekrasov.Ifso,NekrasovmayhavebeenaPutincriticatone
time,buthisrecenttrackrecordsuggestsapossiblechangeofheart.Inorabout2010,NekrasovmadeafilmonBelarus,whichwas
pro-Lukashenko.WhileLukashenkoisntPutin,heiscertainlyakindredspiritanditsunusualforsomeoneassociatedwithRussias
democraticoppositiontoflatteranotherregionaldictator.

Ihopethisbackgroundishelpfuland,ifyoudecidetorunthestory,thefollowingquotemaybeattributedtoSenatorCardin,
