Attorneysays beating deaths
linked to love triangle gone bad

The trial of a 24-year-old D.C. man charged with
two counts of rst-degree murder for allegedly
bludgeoning to death two roommates with whom
he had sexual relations entered its third week on
Wednesday in D.C. Superior Court.
Prosecutors have so far presented to the jury close
to 40 witnesses including police, a deputy medical
examiner, former roommates, and relatives and
friends of the victims in an eort to support their
contention that Jerey Bernard Neal killed one of his
male roommates in a dispute over money and killed
the other male roommate because he witnessed the
rst murder.
Police have said the murders occurred in June of
2014 inside a house at 1846 8th St., N.W. that was
owned by Neals family and in which Neal resided and
charged the roommates rent.
The defense, led by attorney Kevin J. McCants, told
the jury in opening arguments that the three men
were involved in a gay love triangle and one of the
roommates killed the other in a jealous rage and
then attacked Neal with a knife, according to an
account by the Washington Post.
McCants told the jury that Neal fought back in
self-defense and struck 22-year-old Leon Young in
the head twice with a hammer as Young continued
to lunge at him while wielding the knife, the Post
reported.
Its a relationship where these young guys, very
young guys, were gay and, basically, lived together
and frequently had sex, the Post quoted McCants as
telling the jury.

Missing man found dead on
beach near Rehoboth
Police say foul play not suspected

A gay man who had been reported missing since July 8 from his home near the
boardwalk in Rehoboth Beach was found dead early on the morning of July 14 on
the beach in an area just north of Rehoboth, according to a statement released by
Rehoboth Beach police.
The statement, which was posted on the police website, says at around 5:45
a.m. July 14 members of the Rehoboth Beach Police, the Delaware State Police,
and the Rehoboth Beach re Department responded to a report of a body in
the surf.
Along with police and re personnel, Sussex County Paramedics arrived on the scene
and found the body of Todd J. McKee deceased on the beach, the statement says.
A forensic investigator from the Division of Forensic Science responded to the
scene and the body was removed, the statement says. A death investigation
is being conducted by the Delaware State Police and the Division of Forensic
Science, it says, adding, At this time no foul play is suspected.
The discovery of McKees body came six days after Rehoboth police issued a
Gold Alert missing person announcement for McKee, saying he had last been
seen about 10:15 p.m. Saturday, July 8, leaving his home in the 300 block of
South Boardwalk in Rehoboth.
Rehoboth Police Lt. Jaime Riddle told the Washington Blade that under a
Delaware policy for responding to a report of a missing person, a Gold Alert
pertains to missing persons who may fall into three categories a senior citizen,
a person with a disability, and a person who may be suicidal.
Rehoboth Police said Todd McKees family requested that this separate
statement be released:
We are devastated by the news that our beloved partner, son, and brother
Todds body was found on a beach this morning. As we mourn the loss of this
beautiful and kind man, we want to thank the Rehoboth Beach police, city and
state ocials and the community he so loved and adopted as his home, for

Attorneys argued 19-year-old park
employee acted in self-defense

A Fairfax County Circuit Court judge on July 14 declared a mistrial for a former county parks
employee charged with second-degree murder in the August 2016 stabbing death of lesbian
chef and caterer Tyonne Johns during an altercation at an outdoor wedding reception.
Judge Daniel E. Ortiz declared the mistrial when a jury announced it was deadlocked and
could not reach a verdict after deliberating for more than six and a half hours. Prosecutors
with the Fairfax Commonwealths Attorneys Oce said they plan bring the case to trial again.
The announcement by the jurors followed a six-day trial in which the defense argued
that former Fairfax parks department worker Kempton A. Bonds, who was 19 at the
time of the incident, stabbed Johns in self defense.
In dramatic testimony on the witness stand, Bonds reiterated what he told police and
prosecutors at the time of his arrest that Johns allegedly placed him in a choke hold,
preventing him from breathing, after the two argued over the ownership of folding chairs
used at an Aug. 6, 2016 wedding that Johns catered at a county park in Chantilly, Va.
According to media reports, the lead prosecutor in the case, Assistant Commonwealths
Attorney Brandon Shapiro, argued that witnesses associated with the wedding party testied
that Bonds acted in a rude manner toward the wedding guests since the start of the outdoor
reception. He also noted that witnesses claimed not to have seen Johns touch Bonds in any way.
It was by far not an accident, the Washington Post quoted Shapiro saying in his closing
arguments at the trial. He antagonized, he baitedhe took that knife and he stuck it three
inches into her, and that Bonds was going for death, the Post quoted Shapiro as saying.
Defense attorney Peter Greenspun told the jury that Bonds was merely trying to carry
out his duties as a park employee when he followed the terms of an agreement that loud
music played at the wedding had to end by 9 p.m., according to an account of the trial by
Channel 7 News. When bonds pulled the plug for the sound system, Johns and some of
the wedding guests became foul, vile and disrespectful toward Bonds, the Post reported.
Greenspun argued that Bonds, feeling threatened, called his boss and Fairfax police
at least two times to say he worried about his safety.
At the time of Bonds arrest last August Fairfax police said witnesses reported that
an argument between Johns and Bonds over the ownership of folding chairs used at
the wedding led to the altercation that prompted Bonds to stab Johns. Bonds insisted
the chairs belonged to the Fairfax parks department when he saw Johns taking steps
to remove them, police said. Witnesses told police that Johns claimed the chairs were
owned by a company with which she was associated and she was responsible for
returning them to that company.
Greenspun argued that shortly before the stabbing Bonds was cornered, outnumbered
and verbally assaulted by members of the wedding party, the Post reported. The Post
quoted Bonds saying during his testimony at the trial, I was trying to get her o of me
so that I could breatheI was afraid for my life.
Friends and family members said Johns, a native of Hopewell, Va., was a highly
acclaimed chef and operated her own catering business in the D.C. area for several
years. Readers of the Washington Blade last fall voted to posthumously award Johns the
honor of Best Chef in the Blades 2016 Best of Gay D.C. competition.
Prosecutors and Bonds defense team were expected to confer with the judge early
next month set a date for a second trial.

LGBT rights organizations are expected
to gather at the Westin Alexandria
Hotel in Alexandria, Va., July 26-29 for
the Equality Federations 20th annual
Leadership Conference.
The Equality Federation serves as a
national association representing LGBT
advocacy groups in 42 states that have
such groups, according to a statement
released by Equality Federation.
Rebecca Isaacs, Equality Federations
executive director, called this years
conference especially important.
As our movement resists an
extraordinarily hostile administration
and continued attacks on our freedoms
at the state level it is crucial that we come
together to strategize and reinvigorate
our movement for equality, Isaacs said.
Weve come so far, she said in a
statement. A solid majority of Americans
now support the fairness for LGBTQ people
and our families, and the visibility of our
community is unprecedented, she said.
Madaleno formally announces run for Md. governor
Gay state senator asserts
hes going to win

Maryland state Sen. Rich Madaleno
(D-Montgomery County) on Monday formally
announced his candidacy for governor.
Im running for governor and Im going to
win, said Madaleno during his announcement
speech that he made at Universities at Shady
Grove in North Potomac.
Madaleno, 52, has represented the 18th
Senate District since 2007. He became
the rst openly gay person elected to the
Maryland General Assembly in 2002.
Madaleno is among the lawmakers
and advocates who led eorts to secure
passage of the states same-sex marriage
bill then-Gov. Martin OMalley signed
into law in 2012. The Montgomery
County Democrat in 2014 introduced a
transgender rights measure that took
eect later in the year.
Madaleno in 2014 defeated Gender

say anti-LGBT groups have joined state
legislators in pushing for single-issue
license to discriminate bills that would
exempt individual state agencies or
organizations such as child welfare
agencies from complying with non-
discrimination laws. Doing so could allow
them to refuse to provide child adoption
services to same-sex couples.
Other workshops cover such topics as program booklet welcoming the LGBT
ghting anti-transgender ballot measures
in states; eorts to repeal laws that
criminalize HIV transmission; the impact of
redistricting of electoral districts on LGBT
state Senate seat. Madaleno was among
those who considered running for then-
Congressman Chris Van Hollens seat in
the U.S. House of Representatives after
then-U.S. Sen. Barbara Mikulski (D-Md.)
announced her retirement in 2015.
Madaleno on Monday described himself
as a proud husband and a loving father.
Marriage rights for same-sex couples are
among the issues he highlighted during
his announcement speech.
I will never back down on civil rights,
on LGBTQ rights, on workers rights, on
womens rights, on voting rights, said
Madaleno. Our rights cannot and will not be
sacriced with Rich Madaleno as governor.

Rich is widely regarded as one of
the smartest people in Annapolis, said
DePuyt. Hes really bright and hes also
a hero to progressive voters and to
progressive activists.
DePuyt said one of Madalenos challenges
is he remains largely unknown outside of
Annapolis and Montgomery County.
Its going to take a lot of money and
a lot of work to get his name out there,
DePuyt told the Blade.

A D.C. police arrest adavit that
became public last week says District
resident Startwaune Anderson, 18,
allegedly struck a transgender woman
with a stolen car he was driving on July 5
while high on the drugs PCP and Xanax.
Police last week arrested Anderson
on a charge of aggravated assault while
armed for allegedly intentionally hitting
Boo Boo Washington, 26, with the stolen
vehicle along the 400 block of K Street,
N.E. shortly after 3 a.m.
Multiple witnesses at the scene told
police the driver of the car that hit
Washington drove away from the scene
without stopping.
Police said Washington remained
hospitalized in critical but stable condition
after suering from multiple serious
injuries sustained from being struck by
the car Anderson allegedly drove.
A D.C. Superior Court Judge on July 13
ordered Anderson held without bond.

Plaza on July 13 for a rally and march to

reporters at news conference last week on the arrest of a suspect charged with intentionally
hitting a trans woman with a car on July 5.

Hunter stated. They dont need [any]
more training. Its time for their jobs to be
held accountable. Its time for monitoring,
its time for adherence. When they fuck
up, they get red.

policing our existence, Hunter continued.

the suspects vehicle quickly revs to a
high level of revolutions per minute
(RPM), indicating that the driver is rapidly
accelerating, the adavit says.
As the vehicle nears the victims
last location, the driver appears to
intentionally move from the left lane
to the curb lane while continuing to
accelerate in the direction of the victim, it
says. Within seconds of going o camera,
the camera audio captures the loud crash
of the victim being struck.
The adavit says witnesses saw
Anderson entering and leaving the car
linked to the hit-and-run incident later in
the day on July 5. At least three witnesses
reported seeing Anderson crash the car
into a Gallaudet University fence in the
1200 block of West Virginia Avenue, N.E.
The adavit says that on July 7
detectives went to Andersons residence
and asked him if he would be willing to
talk to them about the incident in a non-
custodial interview and he agreed to the
request. During the interview, according
to the adavit, Anderson admitted
stealing the car, saying he found an
electronic ignition key on the street
where he lived and pointed it at nearby
parked cars until nding the car that the
key was able to start.

Hunter then demanded that
Metropolitan Police Department ocers
under investigation be suspended
without pay.
If your job is investigating you and
they are sending you home: no pay. No
pay, said Hunter. Some of the police
ocers are killing black bodies. They are
criminalizing us. They are snatching us
o the train and bus and being violent
to us for no reason. When there is an
investigation going on . . . o the job.
Dee Curry, a local activist who works
for the LGBT community center and
service provider Casa Ruby, then spoke.
Until we take our priorities to the
place that they have to be taken, in other
words, stand up for our rights and say
hell no, no more, were going to continue
to be oppressed, Curry said. Were going
to continue to be abused.
Following the speakers, the activists
held banners and signs as they marched
past the John A. Wilson local government
building down Pennsylvania Avenue while
chanting, Its our history, dont deny it:

Caitlyn Jenner on July 13 met with U.S. Ambassador to the U.N. Nikki Haley to discuss
global LGBT issues.
A spokesperson for the U.S. Mission to the U.N. told the Washington Blade the
meeting took place in Haleys oce in New York.
The spokesperson noted Jenner and Haley discussed LGBTI rights, especially their
concerns about violence and discrimination against LGBTI persons. The spokesperson
told the Blade it was the rst time they had met.
It remains unclear what Jenner and Haley specically discussed, but Log Cabin
Republicans on Monday tweeted a picture of them together.
I have a meeting with her about LGBT issues worldwide, said Jenner on July 13
during an appearance on The View.
We have our problems here and our issues here, she added. But if you look on an
international basis . . . theyd chop my head o in some countries.
Haley in January said during her conrmation hearing that American values do not allow
for discrimination of any kind to anyone, without specically mentioning LGBT people.
The former governor of South Carolina in April issued a statement in which she said
the U.S. remains disturbed by the arrests of more than 100 gay men in Chechnya.
Neither President Trump nor Secretary of State Rex Tillerson have publicly condemned
the ongoing crackdown in the semi-autonomous Russian republic that is located in the
North Caucuses.
Jenner, a Republican, told The View co-hosts that she spoke with Trump about
LGBT-specic issues during the campaign and has met with ocials at the Department
of Education and other federal government agencies.
The Republicans need help and Im there to help, said Jenner on July 13.

Civil rights workers labeled homos in 1964 report
A recently discovered document showing that a Mississippi State commission sought
to discredit black civil rights workers in 1964 by labeling them homos and oddballs
was the subject of a D.C. panel discussion on Monday.
The panel, which convened at the citys African American Civil War Museum, was one
of a series of events associated with the March on Washington Film Festival, an annual
event that chronicles the impact of the 1964 civil rights March on Washington organized
by Martin Luther King Jr.
The document discussed by the panel was a ve-page condential report prepared
by the Mississippi State Sovereignty Commission, an ocial state entity created in 1956
to preserve racial segregation and help resist eorts by the black civil rights movement
to end racial discrimination.
The report says it was written by a commission investigator in July 1964. It was
discovered by the Mattachine Society of Washington, an LGBT rights group that
specializes in searching for documents showing how government agencies and ocials
in the U.S. persecuted LGBT people in past years.
Charles Francis, the groups president who played a lead role in unearthing the
commission report, served as moderator of the July 17 panel session called Civil Rights
and College Activism.
Francis opened the session by explaining that the report in question outlined how

one of the commissions investigators targeted Dr. Earnest A. Smith, president of the
historically black Rust College in the small town of Holly Springs, Miss., for allegedly
being sympathetic to homos.
The investigator claimed to have found evidence from a network of informants that
Smith allowed civil rights workers to use the college campus as their base of operations
for a voter registration drive for African-American residents of the state.
Most of the civil rights workers were black college students along with white student
supporters who were members of the Student Non-Violent Coordinating Committee,
known as SNCC. SNCC was among several civil rights groups that took part in a series
of protests and voter registration drives in deance of state authorities that became
known as Freedom Summer of 1964.

Rep. King compares trans troops
to castrated slaves
In the aftermath of the failed amendment on the U.S. House oor that would
have barred transition-related care for transgender troops, Rep. Steve King
(R-Iowa) delivered a speech Friday railing against their service and comparing
them to castrated slaves in the now defunct Ottoman Empire.
King said on the House oor transgender military service isnt a civilization
killer, but it is an indication of a civilization killer.
I think of the circumstances in a little bit older history, back in the 16th
century and the 17th century when the Ottoman Empire and the Muslim armies
were sweeping across the
countryside, and whoever
they captured, they pressed
into slavery. King said. And
when they pressed them
into slavery, they wanted to
have their crack troops
they were called Janissaries,
and there were other troops
too, as well. But what they
did in order to keep them
from reproducing was that
they did reassignment
surgery on those slaves
that they captured, that
they had put into their
Janissary troops, and that

In the end, King said, the

Kings remarks were a double-whammy of denigration directed at both
transgender people and Muslims but entirely consistent with Kings long record
of hateful comments against members of the Islamic faith and LGBT people.
The Iowa Republican also suggested transgender people enter military service
solely to submit to sexual reassignment surgery and go from a man to a woman.
This policy clearly enacted, clearly advertised, is a neon sign for people who want
to have sexual reassignment surgery, King said. They will line up at their recruiters
oce and they will go into the military, and the military will be saying: You know, we
had to turn this person away because they were too heavy, and this one had at
feet, and this one had a bad eye, and this one had a congenital defect of one kind
or another, but if they dont have those and they want sexual reassignment surgery,
we will cut them up and remake them into something dierent.

why Secretary of State Rex Tillerson has
yet to publicly condemn the ongoing
crackdown against gay men in Chechnya.
Nauert noted to the Washington
Blade during a press brieng the State
Department has urged the Russian
government to conduct an investigation
into the crackdown.
Novaya Gazeta, an independent
Russian newspaper, in April reported
authorities in the semi-autonomous
Russian republic in the North Caucuses
have arrested more than 100 men
because of their sexual orientation
or perceived sexual orientation since
the beginning of the year. At least three
of these men reportedly died after their
arrest, while others have been beaten

A prominent Honduran LGBTI rights
advocate was brutally attacked inside his
home last week.
Criterio, a Honduran newspaper,
reported a man rang the doorbell of
David Valles home in the Honduran
capital of Tegucigalpa at around 10 p.m.
local time on July 10.
Valle, who is with the Center for LGBTI
Development and Cooperation, an
advocacy group known by the acronym
SOMOS-CDC, opened the door and the
man immediately smashed his head
against a wall.
Criterio reported Valle tried to use his
feet to shut the door.
The man who attacked Valle chased
him through his home with a knife-like
weapon. Criterio reported the man beat
Valle for more than 10 minutes before he
left with his cell phone and the keys to his
home and car.
Valles roommate found him roughly
three hours later when he arrived home.
Personnel at the Honduran Institute of
Social Security a government agency that
provides health care treated Valle before
and tortured and sent to secret prisons.
We have called on Russia to hold a
federal investigation into that matter,
Nauert told the Blade.
We have those conversations at
the highest levels, she added, without
providing specic details. Human rights
is something thats very important to us.
We continue to speak about that from
this position here at the podium and
part of my job is speaking on behalf of
Secretary Tillerson and speaking on
behalf of this department.
U.S. Ambassador to the U.N. Nikki Haley
in April said the U.S. is disturbed by the
crackdown. U.S. Reps. David Cicilline
(D-R.I.) and Ileana Ros-Lehtinen (R-Fla.)
are among the dozens of members of
Congress who, along with the Human
Rights Campaign and other advocacy
groups, have specically urged Tillerson
to publicly condemn it.
Tillerson who met with Russian
President Vladimir Putin, Russian
Foreign Minister Sergey Lavrov and other
Kremlin ocials in Moscow in April

Honduran advocates with whom the
Washington Blade spoke this week said
Valle suered serious injuries to his head
and other parts of his body and required
dozens of stitches. They said he was
brought to a safe house after the hospital
discharged him.
He fought for his life, SOMOS-CDC
Executive Director Alex Sorto told the
Blade on Thursday during a WhatsApp
interview from Tegucigalpa.
Valle was expected to attend a meeting
of Honduran LGBTI advocacy groups in
he has not discussed the crackdown with
Russian ocials. A spokesperson for the
National Security Council told the Blade
he was not told that Chechnya came
up during President Trumps meeting
with Putin earlier this month at the G-20
summit in Germany.
The State Department last week
expressed concern over reports Chechen
authorities killed more than two dozen
people who were arrested without charge
earlier this year.
Tillerson in January said during his
conrmation hearing that U.S. values
dont accommodate violence or
discrimination against anyone. The
former ExxonMobil CEO declined to
specically say whether gay rights are
human rights.
Tillerson in June issued a Pride month
statement that, among other things,
noted LGBTI persons continue to face
the threat of violence and discrimination
around the world. Embassies and
consulates also received guidance that
allowed them to recognize Pride month.

Valle, who ran for oce in 2011, has
participated in Gay and Lesbian Victory
Institute-sponsored meetings and
conferences in Honduras, the U.S. and
the Dominican Republic. SOMOS-CDC has
also received funding from a European
Union program that seeks to bolster
Honduras judicial system and improve
access to it.
The Blade has reached out to U.S. ocials
for comment on the attack against Valle.

We dont have these kinds of people
here, said Kadyrov during an interview
with Real Sports with Bryant Gumbel
that HBO is scheduled to broadcast on
Tuesday. We dont have any gays. If there
are any take them to Canada.
Kadyrov also described those who have
made allegations against his government
as devils who are for sale.
They are not people, he told Real
Sports with Bryant Gumbel.
Nauert condemned Kadyrovs comments.
[They] were very concerning and
upsetting to us, Nauert told the Blade.
Kadyrov is a close ally of Putin. Trump
continues to face allegations that his
campaign colluded with the Russian
government to interfere with the 2016
presidential election.
Violence against LGBTI and human
rights advocates remains commonplace
in Honduras, which has one of the worlds
highest per capita murder rates.
Ren Martnez, a prominent activist
from San Pedro Sula who was a member
of Honduran President Juan Orlando
Hernndezs ruling National Party, was
strangled to death in June 2016.
The body of Sherlyn Montoya,
a volunteer for Grupo de Mujeres
Transexuales (Muecas Arcoris), a
transgender advocacy group, was found
in an alley in a Tegucigalpa neighborhood
on April 4.
Paola Barraza, Erick Martnez vila
and Walter Trchez are among the other
LGBT and intersex rights advocates who
have been killed since the 2009 coup that
toppled then-President Manuel Zelaya.
The 2016 murder of Berta Ccares, a
prominent environmental and indigenous
rights advocate, sparked outrage across
Honduras and around the world.
The motive behind the attack against
Valle remains unclear, but he and Sorto on
April 27 petitioned Honduran authorities
to provide them with protection because
their advocacy eorts had prompted
threats. Sorto told the Blade on Thursday
that he and Valle only received some
response in order to keep our mouths
shut or to satisfy us.

Trumpcare appears defeated, but LGBT critics remain wary

of President Obamas signature legislative
achievement and because the measure
would deny Medicaid reimbursements to
Planned Parenthood, which touts its health
services for LGBT people.
McConnell has pledged to bring to the
oor legislation in the coming days that
would repeal Obamacare without oering
any replacement a move that in addition
to eliminating health care for millions of
people would explode the decit.
Even though the same bill passed the
chamber in 2015, its unlikely to pass
this time around without assurance of a
presidential veto. Key Republicans Sens.
Lisa Murkowski (R-Alaska) and Shelly Moore
Capito (R-W.Va.) have said theyd vote
no. Collins voted no in 2015 and said
shed do so again.
Mara Keisling, executive director of the
National Center for Transgender Equality,
nonetheless cautioned cynical eorts
to hurt Americans for political purposes
may still be on the way despite projections
Trumpcare is dead.
We are not condent that eorts to
defund Planned Parenthood are dead,
Keisling said. We are not condent that
eorts to take healthcare away from trans
service members and veterans are dead.
We will continue to ght side-by-side with
so many allies to make sure our healthcare
system is improved and not dismantled and
made accessible only to the wealthy. We
are extremely condent that our side will
ght harder and with solidarity to protect
peoples lives than the powers that be will
ght to hurt us.
After the loss of GOP support for the
Better Care Reconciliation Act, President
Trump took to Twitter to lambast lawmakers,
blaming the failure on all of the Democrats
and a few Republicans.
Most Republicans were loyal, terric &
worked really hard, Trump tweeted. We
will return!
The White House has maintained Trump
made phone calls to lawmakers and met
with them to encourage their support for
the Senate health care bill. On Wednesday,
Trump was set to hold a working lunch at
the White House State Dining Room with
Republican members of Congress to discuss
health care.
Nonetheless, the general perception is
Trump has been disengaged fromeorts
to repeal Obamacare a signature
promise during Trumps presidential
campaign. On Monday, the same day GOP
support for Trumpcare crumbled, Trump
posed for a photo-op in the cab of a
retruck parked on the White House lawn
for Made in America week.
White House Deputy Principal Press
Secretary Sarah Huckabee Sanders
blamed Democrats on Tuesday for
the failure of Trumpcare, even though
theyre in the minority in Congress and
werent responsible for GOP withdrawal
from the bill.
Theyre responsible for passing
Obamacare, Sanders said. Theyre
responsible for creating the mess that were
in. Theyre responsible for being unwilling
to work with Republicans in any capacity
to help x a system that they know is
completely awed and have publicly said
so. I think that its pretty clear, and I think the
responsibility lies on their shoulders.
Gregory Angelo, president of Log Cabin
Republicans, said contrary to expectations
that Trumpcare is dead, he wouldnt rule
out Republican eorts to reform health
care law.
I dont think weve heard the last
from the GOP on healthcare, Angelo
said. Whether its repeal, replace,
reform, or some combination thereof,
the continuing collapse of Obamacare,
spikes in premiums and insurer exits
from exchanges will necessitate that
Republicans act sooner or later.
Trump himself may take unilateral
action. On Tuesday, he told reporters
were probably in that position where well
let Obamacare fail in the aftermath of
crumbling support for the bill.
Were not going to own it. Im not going
to own it, Trump said. I can tell you the
Republicans are not going to own it. Well let
Obamacare fail and then the Democrats are
going to come to us and they are going to
say how do we x it, how do we x it or how
do we come up with a new plan?
Trumps position for some time has been
that Obamacare is a dead program, but
his remarks raise questions about whether
the Trump administration would seek to
administratively undermine the Aordable
Care Act, such as by denying subsidies to
health care recipients who qualify for them.
At the White House, Sanders wouldnt
commit the president to support the
subsidies and the executive sustenance
required under the Aordable Care Act.
As has been the case since we got
here, well continue to keep you posted
as decisions and changes are made, or if
theyre not, Sanders said.
Meanwhile, bipartisan talks on health
care are happening. Sen. Tom Carper
(D-Del.) told the Daily Beast a bipartisan
group of senators spoke Tuesday night
about possible xes to Obamacare that
dont involve repealing the law.
Democrats, Republicans, and I think one
independent slipped in as well, Carper was
quoted as saying. Im more encouraged at
this point than Ive been in quite some while
that we might somehow be able to nd a
road, a path together.
A major criticism from LGBT groups
as well as HIV/AIDS advocacy groups
was the inclusion in GOP plans to replace
Obamacare of a provision to undo the
Medicaid expansion under the Aordable
Care Act. That rose the income level to
qualify for care under that program to 133
percent of the poverty level provided the
states agreed to it.
An estimated 40 percent of people with
HIV a disease that still disproportionately
aects LGBT people received coverage
under Medicaid.
Carl Schmid, deputy executive director of
AIDS Action, said he expects Obamacare to
remain the law and is greatly relieved, but
nonetheless noted the need for change of
the health care system.
There is much that the administration
can do through regulation to alter health
care private insurance plans and Medicaid
and [we] expect them to do that, actually
they have started to make changes as
well, Schmid said. As they make changes,
we want to make sure they do not restrict
access and benets and loosen important
patient protections. Legislative xes are still
needed, premiums and patient cost-sharing
are too high, and we hope that they can
happen on a bi-partisan basis.

Gay love triangle cited in D.C. murder trial

Shana Fulton, the lead prosecutors
in the case, have pointed out that an
autopsy revealed that Young was struck
in the head by an object believed to be a
hammer at least 26 times. The two also
pointed out that instead of calling police
or an ambulance Neal carried Young into
the attic of the house and covered his
body with an air mattress before driving
to Florida in Youngs car.
A police report says two of Neals uncles
arrived at the house a short time later to do
some maintenance work and smelled an
odor that prompted them to enter the attic
where they discovered Youngs nude body
with a plastic bag placed over his head.
The uncles immediately called police,
who, along with emergency medical
services technicians determined that
Young had been dead for at least several
days or longer and his body had been
decomposing. As part of a standard
procedure when a body is found hidden
in a residence police brought in cadaver
dogs to search the property.
They soon found the nude body of the
third roommate, Delano Wingeld, 23,
buried in a shallow grave in the back yard.
Similar to Young, an autopsy found that
Wingeld had been struck in the head
numerous times with an object with a at
rounded head that was also believed to
be a hammer.
McCants noted that Neal returned
to D.C. from Florida on his own and
cooperated with police when asked to
give a statement about the murders.
The Post reported that McCants told
the jury that mutual friends and one
former roommate conrmed Neals claim
that Young had attacked him on a prior
occasion, leading Neal to believe he could
be dangerous.
A police arrest adavit says that Neal
told homicide detectives that Young told
Neal he killed Wingeld shortly before
Young attacked Neal with the knife in
the house. During the trial McCants told
the jury Neals actions were aimed at
protecting himself.
This was a ght to the death, the Post
quoted McCants as saying. Leon had
attacked him before, and my client lost
it, the Post quoted him as saying.
Prosecutors have disputed that claim,
saying drops of Wingelds blood were
found on the ceiling of Neals bedroom
and on a desk. The prosecutors also
pointed to the police investigation that
found that Youngs blood was spattered
around his room and on Neals shoes, the
Post reported.
Some of the jurors appeared startled
on Tuesday afternoon when prosecutors
projected graphic photos on a large
screen of the two victims bodies and
skulls taken during the autopsy. The
photos were shown during testimony by
former Assistant D.C. Medical Examiner
Dr. Lois Goslinoski, who participated in
the autopsy of the victims.
The photos showed holes in the
two victims skulls and face caused by
what Goslinoski said were blunt force
blows from an object that could have
been a hammer.
Prosecutors were expected to
complete their case on Wednesday, with
closing arguments expected to take place
on Thursday or early Friday after the
defense presents several witnesses. Visit

Gonorrhea epidemic hits hard in Oregon

PORTLAND, Ore. A gonorrhea epidemic has hit Oregon amid public health
concerns that the disease is becoming immune to standard treatment, the
Oregonian reports.
Since 2012, cases have nearly tripled statewide, aecting just about every part
of Oregon, including rural counties where infections have been traditionally low.
Ocials in some counties have become so concerned that theyve launched
public awareness campaigns, with ads on dating sites, Facebook and Google. In
others, specialists have gone door to door, trying to track down infected people
and their partners to get them treated, the Oregonian reports.
We came to a point where we said we have to do something, said Tanya
Phillips, health promotion manager for Jackson County.
Gonorrhea cases have risen nationwide as well, but Oregons rate has spikedin
comparison, the Oregonian reports.
The bacteria are spread through sexual intercourse or anal or oral sex. Symptoms
are often undetected in women while men can experience painful urination or a
penile discharge. Untreated, gonorrhea can cause infertility, the Oregonian reports.
In 2010, the state had 28 cases per 100,000 residents. That compared with 101
per 100,000 people nationwide. In 2016, Oregons rate rose to 107 infections per
100,000 residents, an increase that puts it on par with the U.S. rate.
Gonorrhea no longer responds to the antibiotic ciprooxacin that had been
eective in treating it, the Oregonian reports.
It tends to be a bacterium that becomes resistant much more easily than
other bacteria to antibiotics, said Kim Toevs, director of the sexually transmitted
disease program in Multnomah County.
Providers switched to other antibiotics, including ceftriaxone and cexime.
But now the latter appears to be losing its eectiveness, with resistant cases
turning up outside the United States, according to the federal Centers for
Disease Control and Prevention, the Oregonian reports.
Men, especially gay men, account for the majority of cases in Oregon and nationwide.
Public health ocials suspect thats because treatment for HIV has improved.
There are now medications that protect uninfected individuals from HIV and
suppress the virus in those who are infected. The drugs have helped lower

California followed suit in 2015, with its own Healthy Youth Act, the rst in the country
to not only require sex education in public schools cover both sexual orientation and

lessons that include information on abortion, sexual assault and sexual harassment.
Districts in these states have developed guidelines for supporting transgender and
non-conforming students, and some schools have ended gender segregation in fth-

Drip, drip, drip of
Russia revelations
How long before
this house of cards
comes tumbling down?

Its like watching a drip coeemaker
slowly ll a cup. The constant drip of infor-
mation is leading to the inescapable con-
clusion there was a cup full of collusion
between the Trump campaign and the
Russians, something many seasoned poli-
ticians really didnt want to believe at rst.
As Stephen Colbert said, Donald
Trump, Jr. may not really be the bright
one. Possibly because of the investiga-
tion of Jared Kushner, Don Jr. is start-
ing to drip out information on meetings
he was involved in. We know Jared had
nearly 100 meetings with foreign agents
conveniently left o his initial SF-86, the
form required to get a security clearance.
It requires a detailed listing, under pen-
alty of perjury every contact someone
has had with foreign government ocials
in the last seven years.
Kushner is now taking all this seriously
because of the Robert Mueller investiga-
tion. The LA Times reported the investi-
gation would lead a good Washington
counsel and Kushners lawyers, Jamie
Gorelick initially, and then suddenly on
Friday, criminal defense specialist Abbe
Lowell, are among the best to conclude
that Kushner needed to get ahead of the
story and turn over the emails (a devel-
opment the Times learned from people
familiar with Kushners application, who
requested anonymity because the ques-
tionnaire is not a public document).
So now Don Jr. admits to attending the
meeting he rst denied happened. His de-
scription of the meeting changed by the
day. First it was only a few minutes and
about Russian adoptions with three peo-
ple; now we learn it was a meeting with six
or seven people including a Russian lawyer

and a former Russian military intelligence
ocer, maybe an interpreter, based on an
invitation oering Russian government in-
formation on Hillary Clinton.
Donald Trump and I grew up at the same
time. People were building bomb shelters
in their backyards because we were afraid
of the Russians. We had drills in school,
hiding under our desks or going into the
hall, to get away from potential breaking
glass and radiation. There was never any
doubt the Russians were our enemy.
So Donald Trump, who said in Paris he
has only been in politics for a couple of
years, is again lying. He has been involved
with politics and politicians for decades.
He bragged about how he would give
politicians money for favors and how he
loved getting together with them and
supported ones he liked. His tutor was
Roy Cohen, the infamous sleazy lawyer.
He clearly understood what opposition
research is and how it impacts cam-
paigns. Surely he himself provided dirt to
politicians he liked about others he knew.
So did he school his son and son-in-law
as to what was legal? Who knows?
Pretending to be nave about politics
is just another game to Trump. The sad
part is it got him to the White House. Now
lets hope his house of cards comes falling
down. My fear is he already asked his law-
yers about his ability to pardon his son,
son-in-law, and others. He will likely con-
vince himself its just like another bank-
ruptcy. You clear the deck with pardons,
get it over with, and move on.
Meanwhile, the American people and
the reputation of the United States con-
tinues to suer. It will take decades to re-
pair the damage.
Based on the information dripping out
we have likely only seen the tip of the ice-
berg when it comes to what we will learn
about Trumps campaign and his Russian
connections. We will surely hear about
more meetings, more collusion, more
sleazy people involved. As with any mob in-
vestigation, and the Trump family is looking
more and more like a mob, we will prob-
ably nd out the most by following the
money. Maybe we will even see his tax re-
turn. Going to jail for tax evasion is still go-
ing to jail and its likely thats where the lot
of them belong.

Resist Trump efforts to erase LGBT people
Removal from aging survey
hurts the community

For the past four months, I have been
questioning my visibility in the world.
This past March, the Trump administra-
tion surreptitiously acted to erase LGBTQ
people from a major, national aging sur-
vey that determines how our tax dollars,
budgeted under the Older Americans Act,
will be allocated.
Using the delete key on a government
computer, we LGBTQ seniors had our
identities wiped out and thus lost the op-
portunity to self-identify so that we might
receive the appropriate and respectful
services that other non-LGBTQ folks enjoy.
The stunning eect of all of this was
that our lives, skills and talents were to be
ignored, and our needs unaddressed.

The bustling commercial junction at
14th and S streets in northwest D.C., two
blocks south of U Street in the amenity-
laden MidCity area, is blighted by a bar-
ren vacant lot and streetscape eyesore.
Its a jarringly unattractive and incon-
gruous corner spot, one of the few re-
maining undeveloped parcels along the
mid-town thoroughfare and currently
used for commercial parking. Nestled
amid an array of retail stores and pleth-
ora of restaurant, bar and nightlife estab-
lishments, this void is a paved pockmark.
That empty space has been an ugly sight
If we are not counted, we dont exist.
Now, however, in an action almost as
furtive as the original erasure, LGB folks
have been returned to the Older Ameri-
cans Act survey. While there was no ex-
planation for the position change, there
was plenty of pressure from a variety of

LGBT groups like SAGE and the National
LGBTQ Task Force as well as from our
allies to remedy our exclusion.
Note, however, that the T in the LGBT
acronym has not been included.
So, lesbian, gay, and bisexual commu-
nity members served under the Older
Americans Act will have the chance to
for as long as anyone can recall and, due
to zoning rules limiting development op-
tions, is unlikely to change anytime soon.
Unlikely, that is, unless the city ap-
proves a planned $3 million investment
by a local small business to transform the
location with a brand-new building.

gay business partners Dmitri Chekaldin
and Ilya Alter hope to contribute a com-
munity enterprise oering an innovative
neighborhood socializing option. They
have operated the popular outdoor sea-
sonal Dacha Beer Garden in the adjacent
Shaw neighborhood, at 7th and Q streets,
for the past four years.
It would be one of less than a handful
of new-construction dedicated-use full-
service D.C. restaurant-bar structures
built from the ground up during the past
ve decades.
The business duos plan for an addition-
al venue with both indoor and outdoor
space enabling year-round operation has
been laboriously winding its way through
the citys convoluted liquor-licensing sys-
tem for months.
Alter and Chekaldin face opposition
from both an ad-hoc license protest by
a small group of ve or more and two
long-notorious inter-related civic asso-
ciations with few members and even less
community support.

question, you obviously dont know us
trans and gender non-conforming elders.
Until we are included, you wont know
our aspirations for the later years of our
lives. And you wont understand how our

Bar along Duponts 17th Street commer-

Five years ago, both of these symbiotic
naysayer gaggles pushed to impose a to-
tal moratorium on all new liquor licenses
throughout the entire MidCity area of
Logan, Shaw, 14th and U streets and all
nearby business zones.
Overwhelming numbers of area resi-
dents, however, fought back and success-
fully derailed the attempted prohibition.
Had the community not done so, none of

fears and concerns, or the needs and ex-
pectations we have for this last part of
our life journey, dier from those of cis-
gender older adults.
Age Out Loud was the theme of this
past Mays Older Americans Month, with
the federal governments stated goal for
that celebration being to give aging a new
voice. Well, the voice of this old transgender
activist is loud and proud but deeply angry
about the way LGBTQ elders are being treat-
ed under the Trump administration.
The best way to pay tribute to our el-
ders is to assure that all older Americans
are recognized, celebrated, and have
their unique needs met. That calls for
putting the T back in the LGBT acronym
and including us in the Older Americans
Act survey and other important, fact-nd-
ing research eorts around aging issues.

In 2015, news that Barry Manilow was
married to Garry Kief, his manager and
partner of now 40 years, broke in several
publications, and any fears the singer
had about what it would mean to his
career and how his fans would react were
quickly put to rest.
With performances scheduled at the
Theater at MGM National Harbor, July
24-25, Manilow took some time out of his
busy schedule to talk about his shows,
his storied career and the headlines
asserting that he was gay.
WASHINGTON BLADE: What were the
emotions you felt once you decided to
come out? Was there a sense of relief
once you saw how your fans reacted?
BARRY MANILOW: Over the years, they
have told me and showed me how much
they care about me, not just the music. Ive
felt that from the very beginning. I have
been in a loving relationship for 40 years
and I would have been very surprised if
they didnt cheer and werent happy for
me, and of course they did. They reacted
just as I had hoped they would. I never
saw one negative response. Everyone
was very happy for me.
BLADE: You and Garry have been
together for almost four decades now.
At a time when many couples dont
last, especially those in the public eye,
whats the secret to your long-lasting
relationship?
MANILOW: Respect and privacy. Weve
been together going on 40 years and its a
great relationship, just like any marriage.
I grew up around people who were not
really in love, with lots of arguing and
screaming and I never really saw people
respect and love people. Surprisingly
enough, this worked out. Garry manages
me and I do my work, he does his work,
and were in great shape. Weve both
handled ourselves as gentlemen and
were very proud of each other.
BLADE: Last year you announced
your One Last Time tour, retiring
from touring but promising not to
give up on performing. Youre sticking
to your word by playing gigs here and
there, including your shows next week
at National Harbor.
MANILOW: I always said I would do
one-nighters. I have no plans to retire.
Im doing weekends now and then. I had
to get o the road. It keeps me away
from home for weeks and sometimes
months at a time and Ill never do that

Revisiting Cabaret
Touring rigors dont deter
veteran stage actor

Veteran actor Scott Robertson leapt at the
chance to play Herr Shultz in the national
tour of Roundabout Theatres Cabaret.
At 63, not a lot of great parts come
your way, he says.
Cabaret is set in decadent 1930
Berlin. The Weimar Republic is breathing
its last gasps and fascism is on the rise,
but singer Sally Bowles remains blissfully
unaware working at the louche Kit Kat
Klub under the leering watch of its Emcee.
During o hours at Frulein Schneider
no-frills boarding house, Sally develops a
complicated relationship with fellow tenant
Cliord Bradford, a bisexual aspiring writer.
The secondary plot follows the sweet but ill-
fated romance between the landlady and
Jewish shopkeeper Herr Shultz.
Herr Shultz is an optimist, Robertson
says. He seems to think bad times will
blow over. But of course thats not how
things worked out. This Roundabout
production is entertaining but dark
and it resonates. Throughout the tour
theres been a lot of nervous laughter
in the audience. Some people think its
a musical written to reect Americas
current political climate.
Of course thats not the case. Cabarets
source is Christopher Isherwoods 1939
novella Goodbye to Berlin based on
the gay writers experience as an expat
in Berlin in the early 1930s where he was
free to explore his sexuality far from his
familys disapproving eye. John Kander,
Fred Ebb and Joe Masteros Tony-winning
musical premiered in 1966 introducing an
iconic score including familiar tunes like
Cabaret and Willkommen. The show
was a huge success.
The deglamorized production now
moored at the Eisenhower Theater
through early August is Sam Mendes and
Rob Marshalls 2014 Broadway revival,
a re-creation of their 1998 Broadway
revival, which was based on Mendes 1993
London production. And there have been
innumerable productions before, after
and in between including Bob Fosses
screen adaptation with Liza Minelli. So
the play has been around. And Robertson
has played Herr Shultz before.

A Stamford, Conn., native and longtime
New Yorker, Robertson has penned and
performed two autobiographical pieces
titled Buck Naked and Noises On. In
the monologues with music he reects
on the men who made the biggest impact
on his life his musically talented father
who died when he was just 15 and his late
husband of 35 years Peter Flint, drama
coach and director felled by prostate
cancer four years ago.
In these monologues, Robertson talks
about briey coming out at 15 and then
coming out again for good in his early 20s.
My mother said shed rather I was a drug
addict than gay, but she got over that. My
husband became very close with my family.
And very interestingly, he discusses being
diagnosed with Tourette syndrome in his 30s.
Mostly its some throat stu and tics.
But onstage theres a state of ow that
happens which allows me to act and sing.
Im more symptomatic ostage.
Robertsons professional theater career
began at 19 with a part in Grease. He
has worked consistently in doing cabaret,
stage and screen ever since.
Its been a combination of luck, hard
work and talent. I have extremely talented
friends who never nd work. I had
incredible desire and worked incredibly
hard always doing six, seven shows a year.
And when the big opportunities came up
like Damn Yankees with Jerry Lewis Id
bring all of myself to that moment.
When the tour ends in August,
Robertson will return to his home in
Manhattans Hells Kitchen and his new
boyfriend, also a widower.
Touring is tough, he says. I wouldnt do it
for just any part. But Herr Shultz is worth it.

Now that the dog days of summer are
here, instead of slogging through the heat
to a movie theater, you can have some of
the hottest recent LGBT releases delivered
right to your living room. Between DVDs
and a wide variety of Video On Demand
(VOD) streaming services, you dont need
to leave the house until awards season
begins to heat up in the fall.
One of the most interesting new releases
is Vegas Baby, which was an audience
favorite at the 2016 AFI Docs Film Festival
under its original title of HaveABaby.
Inspired by her own experiences with the
economic and emotional toll of infertility
treatments, Academy Award-nominated
director Amanda Micheli turns her lens on
a controversial annual contest.
A Las Vegas doctor asks people seeking
infertility treatments to submit a video to a
YouTube contest; the most popular entrant
gets a free round of treatments. One of
the most fascinating contestants is Athena
Reich, a single lesbian performer and Lady
Gaga impersonator, who reveals it was
harder to come out to her Catholic family as
infertile that it was to come out as a lesbian.
Recently out on DVD is Flatbush
Luck, the eighth feature lm by writer/
director Casper Andreas. A multiple
award winner on the festival circuit, the
lm is a romantic comedy crime caper
about two hunky cousins in Brooklyn
who stumble upon an insider trading
scheme. Things heat up when stock
tips turn into murder plots and Jimmy
and Max nd themselves dealing with
crooked businessmen, the police, sexual
confusion and an impending wedding.
Before the Fall is a modern-day gay
adaptation of Jane Austens classic novel
Pride and Prejudice set in a small town
in southern Virginia. Elisabeth Bennet has
been reimagined as Ben Bennet, a wealthy
lawyer, and the aristocratic Mr. Darcy has
become Lee Darcy, a rough-hewn welder.
Ben and Lee, of course, instantly dislike
each other, but feelings, of course, begin to
change in rst-time director Byrum Geislers
beautifully lmed, fresh take on an old tale.
Recently released on a variety of
streaming platforms, the hard-hitting
documentary Returning Citizens
follows a group of Southeast D.C.
residents as they strive to adjust to
freedom after long-term incarceration
and work to create new lives for
themselves and their families. Directed
by Toronto-based lmmaker Saron
Cassaday (Cyber-Seniors), the movie
also shows community leaders working
to end the ongoing cycle of crime and
violence and illustrates the need for

again. Shows like these, Im totally ne
with doing. The band and I may need to
do an extra-long sound check, but weve
worked together for so long and know all
the songs so well, its no problem.
BLADE: What can you preview
about what fans can expect from the
performance?
MANILOW: For many years, I was able
to do album cuts and special material
and little by little, as the years went by,
I could tell the audience wants the songs
they grew up with, or that their parents
played for them and whenever I tried to
do anything else, I could feel that they
werent as happy as when I did the big
hits. Im doing as many of the hits as I can
possibly squeeze into the show.
BLADE: What was the genesis behind
your latest release, This Is My Town:
Songs of New York, and as a New
Yorker yourself, how important an
album was this for you?
MANILOW: I like to make albums that
have ideas to them. The days of me doing
10 love songs that have nothing to do
with one another, I stopped doing that
years ago. I did a Big Band album, I did a
show tunes album, I did a decades series
and I always wanted to do a tribute to my
home town of New York. There were so
many great songs that I decided to do
a medley of a handful of them because
I loved them all but didnt have enough
space for everything.
BLADE: What is your songwriting
process like? What inspires you to
write?
MANILOW: If I started to chase the
trend machine, it would drive me nuts.
I do what feels good. I write a melody
and then send it to my brilliant lyricists
and then we talk it through. Or, we do it
together. Im one of these guys who work
on demand. I work when I have a project.
Ive tried the other way writing a song
for no reason at all, and I love them all,
but they wind up in my trunk and I never
use them because they dont t on the
next album. I stopped doing that.
BLADE: Your stepfather, Willie
Murphy, had a big inuence on your
music career. How did he help shape
your musical tastes?
MANILOW: He brought with him a
stack of albums that may have well been a
stack of gold, because I didnt know much
music. I was raised by my grandparents
and my mother, and my mother was into
the pop music of the day on the radio,
which didnt really turn me on, and my
grandparents were into the old Russian
folk songs. When Willie Murphy came into
my life with that stack of albums, there
was music great Broadway albums
and great classical albums, Frank Sinatra,
Nelson Riddle and for a 13-year-old kid
to hear that for the rst time, it was a life-
changing moment for me. I didnt know
music like that existed.
BLADE: Are there still musical goals
out there that you want to experiment
with and try?
MANILOW: Always. The well hasnt run
dry yet. I always have the next idea. I have

three ideas in the pipeline now. Thats
how I keep young and energetic. You will
never nd me sitting in front of the TV set.
Its my suggestion to all those people who
are getting on dont just sit and watch
TV, gure out something to do and do it.
BLADE: What is it that keeps you
coming back to the stage time and
time again?
MANILOW: Garrys told me, You cant
cure cancer but you can make them
forget about it for 90 minutes. Thats
what Im seeing out there. These people
are so happy and having such a great
time singing these songs and listening to
me do my cornball jokes and playing my
music, that they do forget the craziness
going on out there in the world. Thats the
part that keeps me coming back.

What to expect in D.C.s real estate market
Low-ball offers,
contingencies

We work with many buyers moving to the
D.C. area from other parts of the country.
While just about everyone is prepared for the
sky-high housing prices in our region, most are
not aware of some other key characteristics of
the D.C.-area real estate market. Allow us to
share these common practices that will shed
some light on the norms of our sometimes
challenging market.
BUYERS MUST PROVE THEMSELVES: Sell-
ers and their agents want to know and will
check that you can afford the house. This
means if you are financing the property, you
must have a pre-approval letter from your
lender. If you are paying cash, youll need
proof of funds in the form of a letter from your
banker or a copy of bank statements showing
a sufficient amount of cash to buy the home.
This documentation will be presented to the
listing agent on your behalf. The agent may
contact your lender or bank to confirm the in-
formation. This is normal in our area, so it is no
cause for concern.
SELLERS PREFER LOCAL LENDERS: On a
related note, sellers and listing agents typically
prefer local lenders who know the norms of
our market and are reachable on weekends
and evenings. Your lender needs to provide

you with estimates of closing costs, which can
vary greatly from one state or jurisdiction to
the next. In fact even between Virginia and
the District, closing costs and taxes vary widely.
CONVEYANCES: In the D.C. area it is stan-
dard for all appliances, light fixtures, and
anything permanently affixed to the walls or
floors to convey with the property. The only
exceptions to this practice are televisions and
audio/visual equipment. Occasionally, the
seller will want to take something that would
normally convey. In such a case, the seller will
note it in contract or in disclosures. If there is
something you would like to convey that is not
attached, we can always request it in the offer.
ITS A SELLERS MARKET. The D.C. mar-
ket is very much a sellers market at the mo-
ment, so out-of-town buyers should know
the following:
Offers must be fairly close to list - most of
the time. In many parts of the country, its pos-
sible to get houses far below list price. Not so
here we dont see low ball offers unless
there is a major issue with the property or
some extenuating circumstance. Inside the
beltway, most sellers are insulted if you offer
more than 10 percent under list price. Addi-
tionally, low offers dont get negotiations off
to the best start (though certainly, we have
gotten it done). Every negotiation is different.
Some houses in our market do go for under
that 10 percent mark, but many go 10 percent
OVER list price or more. As always, the final
sale price depends on location and condition
of the property. In hot neighborhoods, you will

very likely need to pay over full price. Some
agents even purposefully price their homes
low to encourage multiple offers.
Timelines are TIGHT! Deadlines for any
contract contingencies (home inspection, ap-
praisal, etc.) should be kept to a minimum.
Sellers do not want to have their home off the
market, tied up with contingencies for more
than 7-10 days.
Home sale contingencies are a tough sell.
Speaking of contingencies, D.C.-area sellers
rarely agree to offers contingent on the sale of
a home, especially if that home is out of the
area. Cases in which contingent offers might
be considered is if the home you are consider-
ing buying has been on the market for a while
or it is listed a higher price point. If the sellers
do agree to accept a contingent offer, their
agent would want to speak to the listing agent
of the buyers home and review the homes
pricing. Furthermore, if sellers are amenable
to a home sale contingency, they will generally
expect the offer to be close to full price and
have tight timelines as noted above.
Multiple offer scenarios are common. Its
not unusual for a D.C.-area property to receive
multiple offers soon after it is listed, especially
if it is well priced and in a hot area. Weve
seen it time and again. In fact, in one recent
case, we saw double digit offers on a home.
If youre coming from out of the area, you
most likely have not seen this situation (un-
less youre coming from Toronto, New York
City or San Francisco, perhaps). Making an
offer on a hot property in the D.C. market is

a bit different. When you know youll be in
competition, your first offer should be your
best offer. In almost every multiple offer sce-
nario, the sellers and the listing agent will re-
view all of the offers presented to them and
simply pick the best one. You should act as
though the seller will not counter your offer.
You should feel satisfied at the end of the
day that your best offer was made, even if
you are not the winning offer.
RENT TO OWN AND PRE-SETTLEMENT
OCCUPANCIES ARE NOT THE NORM: Rent-
ing to own, while common in other parts of
the country, is rarely seen in the D.C.-area
market. Pre-settlement occupancies are also
extremely rare. While we have seen it, these
agreements are used in only the most unusual
cases. Pre-settlement occupancies offer con-
venience to buyers, but come with great risk
and liability for sellers.
The bottom line: If youre moving to the D.C.
area from another part of the country, youll
find many differences in our real estate mar-
ket. In addition to steep prices, be prepared
for a sellers market. This means acting quickly
and definitively, being flexible, and keeping a
sense of humor throughout the process.
