Information Requested
I refer to your application made pursuant to the Right to Information Act 2009 (the Act), which was
received by the Department of Health and Human Services (DHHS) on 13 June 2017 and accepted on that
date.
Specifically, the information requested:
1. Did Ambulance Tasmania fail to register any of their vehicles this financial year before the registration expired?
2. If so:
a. How many vehicles?
b. How long were they unregistered for?
c. Were there any infringements recorded during this period of non-registration?
d. Were there any incidents recorded during this period of non-registration where a claim to MAIB would have
been activated?
Application Fee
The prescribed application fee was waived in accordance with section 16(2)(b) (the applicant is a is a
Member of Parliament acting in connection with his or her official duty).
Decision
The information in regard to the information requested is as follows:

1. Did Ambulance Tasmania fail to register any of their vehicles this financial year before the registration
expired?
Yes.
2. If so:
a. How many vehicles?
133 vehicles. This total includes three box trailers and one special interest display vehicle.
b. How long were they unregistered for?
Six days.
c. Were there any infringements recorded during this period of non-registration?
Yes, 14 speeding infringement notices that were also accompanied with unregistered
vehicle notices.

Where a speeding infringement is incurred during an emergency, the infringement is waived


otherwise the driver is served with the infringement.
d. Were there any incidents recorded during this period of non-registration where a claim to MAIB
would have been activated?
No.

However, if an accident had occurred during this non-registration period resulting in injury, MAIB
would have paid the scheduled benefits for a resident of Tasmania while the Crown would have
covered an interstate resident.

This decision was made by Neil Kirby, Chief Executive, Ambulance Tasmania, a delegated Right to
Information officer of the Department of Health and Human Services, appointed by an instrument of
delegation in accordance with section 24 of the Right to Information Act 2009.
Under Section 43 of the Act, you have the right to apply for a review of the decision. To seek a review, you
must apply in writing to the Secretary, Department of Health and Human Services, GPO Box 125,
HOBART TAS 7001, within 20 working days of receiving this notice.
