Tam filing this amended Charge of Discrimination in part to supplement my EEOC Charge, filed January 28, 2015, (EEOC charge no. 520-2015-01236, the “EEOC Charge”) and to notify the agency of additional discrimination and retaliation I have experienced. I believe I have been demoted, including removed from my diversity and inclusion position and other negative treatment as follows, in retaliation for my filing a complaints for_race discrimination with the USTA and with the EEOC. I have experienced racial discrimination at the USTA headquarters in White Plains, the Billie Jean King National Tennis Center in ‘New York City (BIK-NTC) and throughout the US by the USTA. Tam now out of work on disability due to the stress caused in large part by the discriminatory animus directed at me by USTA Management and continued retaliation by the organization. As background, part of my job description is to “Travel to USTA Events, educational programs and section offices...” and to maintain “current Officiating-badge status” with International Tennis Federation (ITF). ‘The USTA and ITF jointly control who receives Badge Certification, with Gold, Silver and Bronze being the top three certifications. Having a Gold Badge enables an umpire to officiate the best matches in tennis. Lam currently a Silver Badge official. After the USTA Director of Officials-US Open Chief Umpire referred to me as a “top chair umpire(s) in the world”, I understandably hoped that USTA Management would recommend and support me so that I could earn a Gold Badge. I understand that the USTA recommends and successfully is able to regularly promote Caucasian employees for ITF Badges, including recently. ‘Tony Nimmons Officiates the Grand Slams & Davis Cup Ties, Including Some 20 Consecutive US Open Tournaments Prior to filing the internal complaints with the USTA and the EEOC Charge of discrimination, I had worked at some of the most prestigious tournaments in the world, including all the Grand Slam tennis events and World Group, Davis Cup Ties ~ the Australian Open, French Open, Wimbledon, and 20 consecutive US Open tournaments at the BIK-NTC. I was not recommended to officiate any of these tournaments in retaliation for filing internal and EEOC complaints. Since Filing Discrimination Complaints Mr. Nimmons Banned from Officiating Grand Slams & Davis Cup Ties Since filing the EEOC Charge, I have not worked at any Grand Slam or Davis Cup tennis tournaments in 2015, including the US Open in New York City where I live. I know of several other Aftican American umpires who have similarly been demoted from a higher badge status to a lower badge status and received less work after filing complaints of discrimination against the USTA, including Chris Preston, Lonnie Gibbs, Reliford Sanders Jr. Marion Johnson, Sande French, Cecil Hollins, and Turhan Wilbon, From my understanding, these USTA workers have all have been demoted and/or received less work than their Caucasian counterparts/peers with regard to chair umpire and referee assistant both Deputy Referee/Supervisor and Associate Referee/Supervisor (DRS & ARS) designation assignments. On the other hand, Caucasian counterparts, both referees and umpires in some cases received three (3) times more work. I know of several Caucasian umpires who are no more qualified than the African American umpires and are frequently less qualified, and receive more work from the USTA. This has been @ common practice for the USTA to give Caucasian umpires the choice assignments. Please review the assignments from 2012 ~ summer of 2015. Before Complaints of Discrimination Tony iimmons Speaks on behalf of USTA Part of my job with USTA was to travel and speak at USTA events and educate officials, staff and the public about tennis. A large part of my job was also to promote diversity in tennis, focusing on minorities and ‘women. Some of the events where I often spoke included Town Halls (informal public meetings), and US Open umpire selection meetings. I would also attend the Respondent’s Annual Meeting and Conference (AMC), and other important USTA conferences and events. I am also proud of helping to create the Officials Inclusion Council (OIC) in 2009, with the support of the USTA, an organization promoting tennis officials with a focus on minority officials. While in attendance at events, I was frequently was asked to speak to the representatives ftom the USTA's 17 sections about the Officials Inclusion Council and about promoting diversity in tennis. Since filing Discrimination Complaints Mr. Nimmons is Banned from Traveling to and Speaking at USTA Events Since filing both internal complaints with the USTA and the discrimination and retaliation complaints with the EEOC, USTA Management has banned me from traveling to events. As a consequence, I no longer speak about diversity in tennis, which is significant part of my job. For example, my department attended the ‘Town Hall meetings held in March and April 2015 at the Professional Association of Tennis Professionals (ATP) and Women’s Tennis Association (WTA). These ATP and WTA events were held during the tennis tournaments known as "Indian Wells" and "Miami." Whereas, before I filed complaints for discrimination I would be expected to attend and often speak at the ATP and WTA events, after filing the complaints, I was directed by my Caucasian supervisor, Bruce Littrell, not to attend the meetings. The ongoing exclusion from national tennis events, and even routine office meetings, since filing discrimination complaints, is extremely humiliating, depressing, and compromises my ability to do my job. To add insult to injury, Queens, New York, where the US Open is held, is often referred to as the most diverse Borough in most diverse City in the world. Continued USTA Retaliation Threatens Mr. Nimmons Ability to Officiate With the ongoing retaliation against me, by USTA Management, now precludes me from traveling, 1 will lose my Silver Badge umpire status with the USTA and ITF. To maintain my status as a Silver Badge Umpire, I must chair at least 60 matches per year. Unfortunately, since I filed internal discrimination complaints and the EEOC Charge, the USTA will not allow me to work at many tennis matches and I have not worked at any Grand Slam events. If Respondent, USTA, continues to discriminate and retaliate agai me, forbidding me from officiating, I will lose my worldwide certification as a Silver Badge Chair Umpire. Given that the USTA had referred to me as one of best umpires in the world, I had hoped to receive a promotion to Gold Badge USTA Officials and Agents Make Racist Remarks, USTA Management Does Nothing Throughout my career I have endured many racist remarks, many by USTA officials. T have listed just some of the hurtful comments below. During the 2013 US Open in New York City, Fletcher Rebel Good, a Caucasian USTA umpire, said, “Hey Tony, if you were a hungry monkey and I told you there was a watermelon in the tree — go get it! How would you feel?” | immediately reported this incident to my manager Richard Kaufman. To my knowledge, nothing was done to stop the blatant racism at the US Open. In fact, Mr. Good continues to write articles for the USTA and even is a Chairperson of USTA’s Southern Section. ‘At a USTA Challenger event in Dallas, Texas in 2012, Mark (Marcos) Cook, a Caucasian umpire yelled, “Tony, you should go back to the ghetto!” | immediately reported this incident to Keith Crossland, my Supervisor of record (SRR), at above mentioned event. Again, to my knowledge, nothing was done to stop the blatant racism, As background, Mr. Cook has a long history of making racist comments. In fact, while watching a track meet on television with African American umpires present, Mr. Cook allegedly and famously yelled, "Run nigger, Run!" Ata USTA Challenger in Sacramento, CA in 2010, Tobias Kamke, a Caucasian player yelled, “Schwarze scheisse!” (translated means “Black stit’) htips://www.google.com/search?q~Schwarze+schejsse+translation+in+English&ie=utf-8&oo~utf-8 While the USTA refuses to remove or even reprimand racist players, as a result of Mr, Kamke’s racist, disrespectful, and degrading comment, I placed him on my permanent “No List!” The “No a group of players an umpire can choose not to work with. Unfortunately, rather than remove a racist player or at least address the negative and racist behavior, Management chooses to remove the Aftican American umpires. My Manager, Francis Gilbert made negative comments about to my physical appearance, referring to me as, “You're Big, You’re Bald... You have a Booming Voice!” I know of no Caucasian who was referred to by their looks. This treatment by a member of USTA Management was and is hurtful to me. In addition, as mentioned in part above, after complaining, USTA Manager Gilbert stripped me of my duties and made very real threats against me. At a later date, Mr. Gilbert actually complained to me for filing the discrimination complaints. ‘After each one of these incidents and on numerous other occasions, I filed complaints, To my knowledge, USTA Management did nothing to stop the racist comments and behavior. No one from USTA Management ever contacted me with regard to the above referenced complaints. The ongoing inaction and retaliation against me, by the USTA Management, sends a clear message, that African Americans are not to speak out against racism, USTA Management Makes Negative Comments to Nimmons ‘When Francis Gilbert became my supervisor in or about April of 2014, he became openly hostile toward me because I am an African American. In fact, while I had been a celebrated employee, soon after Mr. Gilbert became my manager, he threatened my job on numerous occasions, including when he stated on June 2, 2014, "we will look at you in 12 months and determine if we (USTA and Tony) are a fit!" This comment caused me great anxiety and a sleepless night. However, just the next moming, on June 3, 2014, Mr. Gilbert took his threats further, stating, "let's look at us in 6 months." Again on June 24, 2014, Mr. Gilbert then stated to me that, “management asked me [Mr. Gilbert], should we get rid of him [meaning Mr. Nimmons}?" Continuing the harassment, on July 3, 2014, Mr. Gilbert threatened and weighed out loud, "should I let you g0, should I keep you, should I let you go, should I keep you?" Mr. Gilbert’s comments were clearly ended to harass me due to my race. On October 6, 2014, in a bragging tone, Mr. Gilbert announced to Officiating Department, including Julio Echavarria, Bruce Littrell, Andrew Walker, and Alyse DiGaetano, “Just an FYI...I’ve been with our attorneys...and the Attorney General issue is dead.” Mr. Gilbert was no doubt referring to the terms of a settlement agreement between the Attorney General of the State of New York and the USTA, whereby the USTA agreed to institute policies to end discrimination within the USTA. I understand Mr. Gilbert’s comments to mean that he would not honor the agreement with the Attorney General and that he could continue to discriminate and retaliate against me and other African Americans. In August 2014, after I filed complaints of discrimination, Mr. Gilbert said to me, “I know that your reported me to HR and Gordon (Gordon Smith Chief Executive Officer), Whatever, it is what it is!” In fact, my new, supervisor, Bruce Littrell told me during a meeting in February 27, 2015, that Mr. Gilbert was mad at me because I had filed the discrimination complaints. He further revealed that he was very fortunate and relieved to be able to conceal and hide his minority status, From my understanding and I believe he is open about it, Mr. Littrell is gay. T have never seen this type of negative behavior by UST‘A Management directed at Caucasian workers. These are just some of the examples of how I have been discriminated and retaliated against by USTA ‘management because of my race. Instead of Contacting Authorities, USTA Initiates a “Cover Up” of Hangman’s Noose near African American Employee Most disturbing, a noose was found hanging near the work area of a female African American employee. To me, a hangman’s noose is the most vile and intimidating symbol of white oppression against African Americans. Because I am a diversity professional with the USTA and even for my own safety, I should have been alerted to the presence of a noose at the Billie Jean King National Tennis Center. From my understanding, it is a crime to display a noose in New York State. I never heard that the USTA notified the police, the EEOC or the Attomey General about such a racist symbol or to protect African American workers. Instead, by ignoring or covering up the overt racist image, the USTA appeared to us to be continuing to condone racist behavior at our National Tennis Center In addition, rather than investigate the many claims of racism and other discrimination against members of Management, the USTA is believed to have solicited and initiated negative feedback about me. The recent negative claims about me by USTA Management, do not even make sense, On one hand, the USTA refers to me as a“top chair umpire in the world...” and on the other hand, it continues to solicit negative comments about me. Moreover, in response to my complaints of discrimination and the continued refusal of the USTA to investigate complaints, the USTA finally agreed to launch an investigation, Unfortunately, instead of hiring someone with experience in confronting and combating discrimination by the UST, or asking for help from the EEOC or the Attorney General, USTA Management hired nationally recognized employment litigator and counselor Jill Rosenburg, a Caucasian defense attorney. The purported investigator, or conspirator, served only to cover up or rubber stamp the racist behavior by USTA Management. Based on my conversation with the investigator, it was clear that she was not interested in what I had to say but rather wanted to discredit me. She cut me off when I tried to provide information. She tried to put words in my mouth or inaccurately restate what I had said. The investigator has not even provided the terms contract she has with the USTA and refuses to provide the methodology she purportedly used in investigating my claims. It appeared to me that she as only hired to defend the USTA against more claims of racism. While she would not share information with me, I don’t believe she interviewed the many witnesses I suggested she speak with about the discrimination but rather handpicked employees worried about keeping their jobs and ‘who would therefore be supportive of the false claims she wanted to promote. She even promised to provide me information about a specific and discriminatory practices directed at me. Neither the investigator nor any one from the USTA ever got back to me. While USTA Management initially agreed that a coach would be a good idea and authorized coaching, without explaination, USTA Management later denied my request after I filed complaints for discrimination. Prior to going out on disability, the USTA had demoted me to working as a video editor. While I will do whatever I have to do to work, my training and background is not in video editing. T have been demoted from my former positions with the USTA because I complained about discrimination and retaliation within the organization, There are now several additional race and gender complaints filed against the USTA.
