Civil Rights Center in peril
The centers
fate lies in
the hands of
the Board of
Governors

Reverend Robert Campbell was
determined to find a way to protect
his neighbors on Rogers Road.
In 1972, the Town of Chapel Hill
and Carrboro had promised paved
roads and street lamps in exchange
for permission to build a landfill
in the residential area separating
Eubanks and Homestead Roads.
Thirty-five years later, all the
community had to show for it was
contaminated water and a permeat-
ing odor.
So he set out to fix it.
In 2007, he attended the North
Carolina Environmental Justice
Summit, where he met a group
of interns from the UNC Center
for Civil Rights, a center within
UNCs law school which engages in
research, advocacy and the training
of civil rights lawyers.
Those students introduced him
to policies and laws that helped him
better understand how he could sup-
port his community, he said.
Ten years later, Campbells com-
munity has paved roads, cleaner
water and the Rogers-Eubanks
Neighborhood Association
Community Center, which opened in
December 2014.
Without the Center for Civil Rights
Centers help, Campbell said their
community would look a lot different.

Anna Nelson isnt afraid to go
against the grain.
With five votes in favor of a liti-
gation ban on the UNC Center for
Civil Rights, Nelson was the only
member of the Board of Governors
Committee on Educational
Planning, Policies and Programs to
vote against the proposal on Aug. 1.
If passed, the litigation ban would
stop law students at the Center for
Civil Rights from representing cli-
ents who pursue civil rights cases in
court. The full body of the BOG will
vote on the proposal Friday.
Nelson, the chairperson of
the Committee on Educational
Planning, said her solitary vote was
not based on the specific circum-
stances of the proposal, but rather
with a bigger picture in mind.
I feel its a risk to be having this
conversation because its a larger
issue of the universitys reputation
being at stake, she said. Were
sending a message that risks mis-
communicating our values.
She said regardless of where she
stands on the issue, she thinks the ban
would be an overreach of the board.
Ideally, matters such as this
would be handled at a campus level,
she said. I do not question the
authority of the board to take action,
but the appropriateness of the ban.

said, he said.
Now, the fate of the centers ability
to litigate which includes provid-
ing legal counsel, like in Campbells
case is in the hands of the UNC
Board of Governors, as they prepare
for Fridays vote on whether or not
to ban academic centers within the
UNC system from litigating.
It is a tragic betrayal
Though Mark Dorosin, managing
attorney at the center, might lose his
job on Friday, he is more worried
about whats at stake if the center
closes, and what will happen to the
communities who would no longer
be able to call the Center for Civil
Rights an ally.
The centers work, Dorosin said,
revolves around community-based
advocacy that fights the continued
impacts of race discrimination in the
state.
Dorosin thinks that passing the
legislation Friday would send a dan-
gerous message to the perpetrators
of discrimination.
I think the policy is exclusively
aimed at the Center for Civil Rights,
Dorosin said. I think the people
that are leading this attack and
advocacy ban are angry about the
nature of the work that we do.
Dorosin said that because the
ban would prevent the center from
acting as a legal counsel in any way,
hes unsure of how the center could
continue to exist without its power
to litigate.
Martin H. Brinkley, dean of the
UNC School of Law, said closing the
center will not only affect the law
school it will damage the entire
University.
If the UNC Center for Civil
Rights no longer has litigation as an
option, it will tarnish the reputation
of the law school for what it can do
for its students and for the people
and communities of North Carolina
who have no other options for rep-
resentation, Brinkley said. It will

When Nelson joined the BOG,
she was no stranger to the UNC sys-
tem. As the daughter of billionaire
and former UNC-system President
Dick Spangler, she grew up in the
thick of the states education system.
As I was growing up, both my
parents were committed to service in
schools, she said. They did every-
thing from playground monitoring
to serving on the school board.
Nelson said her passion for public
education blossomed first when she
attended public school, and contin-
ued when her own children began
their public education.
I was bused for integration to
West Charlotte High School, a for-
merly all-black high school, she
said. So I know how important it is
to our state that we provide quality
education to all North Carolinians
no matter where they live.
Hannah Gage, emeritus member
of the BOG, said Nelsons upbring-
ing in the university system gives her
a unique perspective on the board.
Shes an independent thinker
and makes up her own mind on
every issue, she said.
Louis Bissette, chairperson of the
BOG, said he didnt know Nelson per-
sonally when she was appointed to the
board by the N.C. General Assembly.
But I knew of her father and all
the things he had done for the uni-
versity (system) in his lifetime, he
said. So I was expecting a great deal
from his daughter.

also tarnish the reputation of the
University as a whole.
Ted Shaw, director of the center,
said the proposed policy would hurt
the reputation of not just the law
school but the University.
I think that if they do this well
I dont think, I know it is a tragic
betrayal of a commitment that the
state and the Board of Governors
made, and that the University has
engaged in to train a new genera-
tion of civil rights lawyers, and at the
same time providing legal represen-
tation to those who experience race
discrimination, Shaw said.
This is going to hurt the law
school, its reputation and the repu-
tation of the University.

North Carolina Gov. Roy Cooper
has declared a state of emergency
in preparation for Hurricane Irma,
which is predicted to affect the state
as early as Monday or Tuesday.
There is a lot we still dont know
about this storm, but we do know
that North Carolina can expect to feel
some sort of effects as soon as early
next week, and now is the time to get
prepared, Cooper said in a statement.
The state of emergency went in to
effect 8 a.m. Thursday. The gover-
nors statement said North Carolinas
Emergency Management team was
coordinating storm preparation
efforts as early as Labor Day.
UNC issued an Alert Carolina
message Thursday evening encour-
aging students to stay tuned for con-
dition changes in university opera-
tions, although no disruptions are
expected at this time.
We also remind everyone that
weather conditions such as this can
produce dangerous situations on
roadways and sidewalks, and if con-
ditions worsen, downed powerlines
and tree branches could occur, the
alert said. Be cautious of flooded
walkways and roadways and do not
approach downed powerlines.
The most recent briefing on
Hurricane Irma was published by
the National Weather Service at 5
p.m. Thursday, and describes moder-
ate to high confidence in impact for
the central part of the state.
While tracking information is
still not set, it is getting clearer as it

amendment to exclude law clinics.
According to a memo written by
Long, his reasons for seeking to ban
academic centers from litigating is
because academic centers are not
structured to operate as litigation
centers, and permitting centers to
engage in litigation creates risk that
the center will lose sight of UNCs
educational mission.
Supporters of the center say the
ban feels pointed, because the center,
which often provides pro bono legal
services to minorities and under-
served populations, is the only aca-
demic center at UNC that litigates.
Though the committee eventually
passed the policy proposal in a 5-1
vote on Aug. 1 with one abstention,

need to start preparing for some type
of impact, Cooper said.
Tropical storm level winds are
expected in the state starting Monday
morning.
Strong winds resulting in power
outages, several inches of flooding and
an increased threat of tornados are all
possible in the first part of next week,
according to the briefing.
Individuals not in an evacuation
zone are encouraged by the National
Weather Service to prepare an emer-
gency kit that includes a flashlight,
batteries, non-perishable foods,
water and first-aid supplies.
During a hurricane, remain in
a secure, indoor area, and rely on
weather services and local govern-
ment to stay informed.
Hurricane Irmas top sustained
winds on Thursday at 5 p.m. were
175mph, keeping it classified as a cat-
egory five as it heads toward Florida.
Irma made landfall in the
Caribbean on Wednesday, causing
damage on several islands and leaving
half of Puerto Rico without power.
The two other storm systems in
the Atlantic, Hurricane Jose and
Hurricane Katia, are both category
one and not expected to affect the other university leaders Tuesday

other state attorneys general
in filing a lawsuit to protect
Deferred Action for Childhood
Arrivals grantees on Wednesday.
This lawsuit comes on the
heels of the Donald Trump
administrations announcement
to end DACA Tuesday.
The suit said the Trump
administrations actions to end
DACA are illegal.
Stein said in a statement the
Trump Administrations actions
on DACA violate the Equal
Protection and Due Process
clauses of the Constitution by
discriminating against recipients
of Mexican origin in addition
to harming North Carolinas
economy and institutions.
(DACA) is a program that
has protected from deporta-
tion approximately 800,000
young people who grew up in
this country, most of whom have
known no other home than the
United States, the lawsuit said.
The lawsuit said ending DACA
will harm North Carolinas insti-
tutions and economy, as well as
its sovereign and proprietary
interests.
Ending DACA isnt just
cruel to Dreamers, against our
American values and the wrong
thing to do for our nations
economy, it also violates our
Constitution, the statement
said. I will do everything in
my power to restore DACA for
the tens of thousands of young
people in North Carolina who
rely on it including fighting
for them in court.
The Institute on Economic
and Taxation Policy found in a
study 87 percent of DACA recip-
ients nationwide are employed.
The study said continuing the
program and extending its
enrollment to all persons eligible
would increase state and local
tax revenues by $425 million.
Studies estimate that between
50 and 75 percent of all undocu-
mented immigrants file federal
income taxes. DACA recipients
are required to pay personal
income taxes using a temporary
social security number, accord-
ing to the Institute on Economic
and Taxation Policy.
Of the 800,000 DACA
recipients in the United States,
27,000 currently reside in North
Carolina, according to Steins
statement. In North Carolina,
DACA recipients pay over $63
million annually in taxes.
The governments decision to
withdraw from the DACA pro-
gram deeply disappointed UNC
administration, a message from
University leadership said.
Chancellor Carol Folt joined
in signing the Association of
American Universities letter
to Congress advocating for a
permanent solution for undocu-
mented students, which would
allow them to continue school
and eventually pursue a path to
citizenship.

Players react to coming storms

game on Saturday that has
some UNC players desper-
ately trying to convince their
families to head to Chapel Hill.
UNC junior linebacker Andre
Smith, whose mother lives in
Jacksonville, Florida, has been

n Tuesday, Attorney
General Jeff Sessions
announced that the
government would begin
the process of terminating
Deferred Action for Childhood
Arrivals, the Obama admin-
istration policy that protects
many young undocumented
immigrants.
Words cant explain how
fearful I am in this moment
not for myself, but for sev-
eral of my friends, and the
800,000 other DACA recipi-
ents who could be forced to
leave the only country theyve
ever truly known. All because
of the xenophobic beliefs
of our current presidential
administration, if you can even
call it that.
Contrary to popular belief,
DACA recipients are not crimi-
nals. They are not menaces
to society. They are young
people who are just as much
American citizens as someone
born and bred in this country.
It is a requirement that
DACA recipients complete
high school, serve and/or be
honorably discharged from
the military or be in college.
In addition, DACA recipients
cannot be found guilty of a
felony or serious misdemeanor,
or they will be deported.
Many critics of DACA,
especially those who wanted
to make America great again,
argue that DACA recipients
have a negative impact on the
economy of this country.
That argument, intrinsi-
cally, is a flat-out lie. DACA
recipients actually boost the
economy. Many DACA recipi-
ents are well educated and still
in school. Seventeen percent of
them are working towards an
advanced degree.
In some years, the pool of
DACA recipients will be com-
parable to immigrants with
H-1B visas (for highly skilled
workers). Highly skilled work-
ers boost the economy. Ending
DACA will do nothing but
worsen our economy.
Another argument made
for ending DACA is the legal-
ity of the policy, according to
Sessions. While the Supreme
Court deadlocked 4-4 last
summer on the constitution-
ality of DACA, in a letter to
the Trump Administration in
August, over 100 law profes-
sors argued for the legality of
deferred action.
Regardless of their accom-
plishments or the legality
of the policy, ending DACA
isnt just an economic or legal
wrong, its a moral wrong of
the highest degree. DACA
recipients dont just deserve
to stay in this country because
they dont commit crimes and
are working toward advanced
degrees.
They deserve to stay in
this country because theyre
humans. Theyre people with
families and friends. Theyre
people who are simply trying
to build a life for themselves
and their loved ones. Theyre
people who have no real life
outside this country.
To move forward with the
termination of DACA, the
Trump administration proves
once again that they have no
interest in doing whats mor-
ally right, or even whats best
for the economy. They simply
want to make the country
more white, more rich and
more xenophobic.

days, any question that
remotely concerns the
idea of race or ethnicity.

the first two weeks of the
semester regarding Silent

DACA, almost all of our
classes are talking about
race, immigration or
other controversial topics.
(This may be less preva-
lent in STEM classes,
though we wouldnt be
surprised to find phys-
ics students calculating
the force necessary to
topple Silent Sam while
factoring the opposing
force from the Board of
Governors.)
No matter your position
on the issues at hand, it
is the responsibility of all
students to participate in
these tough discourses in a

We recognize that voic-
ing ones opinion can
have social consequences
for both the speaker and
those listening.
Not to mention the fact
that speaking in front of a
large lecture hall is fright-
ening as hell even when
you know what youre
talking about.
That said, we would like
to offer up some guiding
points to keep in mind
mind.
1. Acknowledging the
concept of race isnt racist,
but attaching characteris-
tics or generalizations to
race can be.
To identify someone as
black or African-American
is not problematic, but say-
ing that someone is black
so they must be____ is an
issue.
2. Assume good intent.
In a classroom setting,
its safe to assume we are
entering the conversation
with a desire to share what
we know and learn what
we dont know not hurt
anyones feelings.

The Progressive Faculty
Network and colleagues
from across the UNC-CH
campus stand with stu-
dents and other members
of the community in oppo-
sition to the presence of
Silent Sam.
The statue celebrates
people who defended slav-
ery, a violation of the most
basic of human rights.
Installed 48 years after
this country made owning
another human being illegal,
the monument also implicit-
ly honors the system of racial
apartheid that propped up
white supremacy after the
U.S. Civil War and influ-
enced white nationalists in
South Africa and Nazis in
Western Europe.
Beginning in the 1950s,
in response to African
American-led civil rights
activism, some compo-
nents of legal segregation,
particularly in public edu-
cation, were dismantled.
Today, however, racial
inequality in this country
is maintained by physical,
economic, electoral, legal,
and cultural violence com-
mitted by and on behalf of
white people against people
of color.
Sam, the gun-toting
image of white, masculine
power, is neither harm-
less historical speech nor
silent. Decades of protest
and the current student-
led demand to take the
monument down demon-
strate that we hear Sams
anthem to racism loudly
and clearly.
Remove the statue now
and you can be on the right
side of history.

ters to engage in litigation
opens the door to center per-
sonnel using the litigation to
further their personal agen-
das, Long says in the memo.
Instead, if the center oper-
ated as a clinic, no full-time
attorneys would litigate; it
would be left up to students,
with faculty oversight.
The idea of transforming
the center into a clinic was one
of the several points the com-
mittee asked Chancellor Folt
to consider. In a five-page let-
ter to Nelson, Folt said though
a clinic could be established,
the University does not cur-
rently have the funding, staff
or space for this effort.
Although the new policy
does not mention the Center
for Civil Rights directly, it is

take particular positions on

UNC hasnt played a reigning
Heisman Trophy winner since 1975,
when the team traveled to Columbus
and faced Archie Griffin and the
Ohio State Buckeyes. In a 32-7 loss,
UNC allowed Griffin to rush for 157
yards on 22 carries.
As a quarterback, Jackson com-
mands even more attention. And its
all warranted.
He threw for 378 yards and two
touchdowns and rushed for 107
more in a 35-28 win over Purdue
last week. In terms of usage, he
dominated. With 46 pass attempts
and 21 rushes, Jackson had the ball
on almost 85 percent of Louisvilles

Even if Brandon Harris had
played well in North Carolinas
season-opening 35-30 loss
to California, the following
would still be true: hes a one-
year rental, and UNC will have
a new starting quarterback at
this time next season.
That reason alone should be
enough to warrant somebody
other than Harris, a gradu-
ate transfer from LSU, get-
ting extensive playing time at
quarterback for the Tar Heels
this season. And after the way
things played out against the
Golden Bears, that somebody
is clearly Chazz Surratt, who
is far from a finished product,
but a candidate deserving of
the opportunity to earn the
distinction as possibly UNCs
quarterback of the future.
UNCs performance against
Cal also showed he might be
the Tar Heels quarterback for
right now, too.
After UNCs offense sput-
tered out of the gate with
Harris in charge, Surratt
entered on UNCs third drive.
While he struggled with some
miscues of his own the deci-
sion to try to thread the needle
on a fourth and three with
UNC down by four midway
through the fourth quarter
wasnt the best Surratt more
or less managed the game well.
Four of the Tar Heels five
scoring drives came with
Surratt in, and the redshirt
first-year completed 18 of 28
passes for 161 yards and a
touchdown. On the ground,
he provided a score and fin-
ished with 66 yards on 16
rushing attempts.
Even with Surratt in, UNC
lacked the explosiveness its
had in bunches in recent sea-
sons, but that could mainly be
the result of the recent exodus
of talent at the skill posi-
tions over the offseason. Still,
Surratt did his job. He came
in, didnt try to do too much
and didnt turn the ball over.
The same cant be said
about Harris. Up to now, the
narrative has been that he
was never utilized correctly as
a dual-threat quarterback in
Les Miles I-formation offense
at LSU. That may be true, but
in his first start as the opera-
tor of UNCs spread offense,
Harris experienced the same
troubles that led to him being
benched in favor of Danny
Etling two games into LSUs

There was the overthrow
of Anthony Ratliff-Williams,
who was ready to haul in the
first touchdown of his career.
Then came the first of two
interceptions, this one right
before the end of the first half,
as UNC looked poised to at
least attempt a field goal right
before the break. Eventually,
a third-quarter tip-drill pick,
the result of a poor decision
on Harris part, ended his day.
His performance as a
whole might have also damp-
ened the notion that he, as
a seasoned player with SEC
experience, could provide
a shot in the arm of a UNC
offense in the process of
retooling this season.
No, a one-game sample
size should not serve as a
referendum on Harris abil-
ity, nor can it predict how he
will fare from here on out.
But clearly, this situation is
not akin to Russell Wilson
immediately stepping in
without missing a beat at
Wisconsin after leaving N.C.
State, or more recent trans-
fer stories involving players
such as Trevor Knight leaving
Oklahoma for Texas A&M
and Everett Golson going to
Florida State after starting at
Notre Dame.

Four things to know before the Cardinals face the Tar Heels

Larry Fedora said this week that
the North Carolina football team has
moved on from its season-opening
loss to California. With Louisville
and its junior quarterback Lamar
Jackson the reigning Heisman
Trophy winner coming to town
this Saturday, the Tar Heels have
had to refocus quickly.
Here are four things to know about
the Cardinals besides the fact that
Lamar Jackson is still really good.
Louisvilles offensive line had
10 false starts last week

Well, Louisville did the opposite
against Purdue and still managed
to win. The fact that Louisville com-
mitted 10 false starts speaks volumes
about its talent throughout the roster.
Playmakers at the skill positions have
acted as the teams deodorant, mask-
ing its real flaws present on the line.
Louisville head coach Bobby
Petrino told The Courier-Journals Jeff
Greer that those mistakes are correct-
able, and he said redshirt first-year
center Robbie Bell is still working on
his communication with Jackson.
The Cardinals will most likely not
repeat their error-riddled perfor-
mance up front against UNC. But
perhaps the Tar Heels can exploit a
position group that clearly has not
gelled yet.
In general, Louisvilles offensive line
has struggled to protect its valuable
quarterback. Part of the units troubles
stem from the fact that Jackson fre-
quently puts himself in vulnerable
positions. Either way, the Cardinals
still allowed an average of 3.62 sacks a
game in 2016 which ranked 124 out
of 128 teams nationally.
Cornerback Jaire Alexander is
banged up

probably all wondering how they
let Alexander attend school out of
North Carolina.
Eschewed by his nearby ACC pro-
grams, Alexander picked Louisville
and has blossomed into one of the
leagues top defensive backs and a
valuable punt returner.
Unfortunately for Alexander, his
special teams ambitions led to him
suffering an injury in the second
quarter last week when he returned a
blocked field goal. He did not return
to the game, and Louisville has not
announced his status for Saturday.
Alexanders absence would
undoubtedly prove to be a relief for
the Tar Heels, who are still trying to
develop their passing game.
Cardinals still working on run-
ning game
Louisville has experienced a fair
amount of attrition at the skill posi-
tions offensively, namely at wide
receiver. But the Cardinals are also
replacing running back Brandon
Radcliff, who had 903 rushing yards
and six touchdowns a year ago.
Against Purdue, Reggie
Bonnafon, a converted quarterback,
and Jeremy Smith combined for just
41 yards on 11 carries. Smith also
fumbled deep in red-zone territory.
Jackson clearly can work magic with
his feet, but the Tar Heels might be
able to hone in on him a bit more if
the Cardinals running backs dont
prove to be too much of a threat.
Big-play capability
Any offense with Jackson in
charge will probably enjoy its fair
share of big plays. A year ago,
Louisville ranked seventh in SB
Nation writer Bill Connellys IsoPPP
ranking, a metric that measures
offensive explosiveness by tracking
points per play on successful plays.
Against Purdue, the Cardinals
had 17 chunk plays passing
plays of 15-plus yards and rushing
plays of 10-plus yards. Theyre prob-
ably expecting to exploit a UNC
defense that struggled to tackle in
the open field against California.
The Tar Heels will have to keep
tabs on big-play wide receivers
Jaylen Smith and Dez Fitzpatrick,
who combined for 12 catches and
212 receiving yards last week. Of
course, in the end, reducing big
plays starts with containing Jackson.
