APPENDIX FT/A

DAYWORK SCHEDULE

1. Where work cannot be properly measured and valued the Contractor shall be allowed daywork rates at
the rates entered in Table 1, 2 and 3 of this Schedule.

2. The rates inserted by the Tenderer shall be realistic rates in conformity with those on which his tender has
been based, and shall be based on conditions prevailing at the time of tender but bearing in mind that
claims for escalation will not be entertained.

3. Daywork rates will not apply in the following cases:-

a. for jobbing or any other work carried out as a main or separate contract, or

b. daywork ordered by the Superintending Officer to be carried out after the date of commencement
of the Defects Liability Period, which may be the subject of a separate agreement, or

c. for work which can be valued in accordance with the provisions of the Conditions of

Contract. Section 1 - Labour

4. The rates for labour entered by the Contractor in Table 1 are to include for the following:-

a. The amount of wages actually paid to the employee when carrying out daywork.

b. The amount of bonuses, incentive payments and other emoluments actually paid to the employee
when carrying out daywork.

c. Overheads and profit as defined in Section Four below.

5. Notwithstanding the provisions of the Labour Enactments of Brunei, overtime working will be deemed to
be carrying out works outside the hours of 8:00 a.m. and 5:00 p.m. on Monday to Sunday inclusive.

6. Payment for overtime working will be calculated on the following basis:-

a. Monday to Sunday inclusive between the hours of 5.00 p.m. and midnight at time and a half
(i.e. 1 times the amount entered in Table 1).

b. Monday to Sunday inclusive between the hours of midnight and 8.00 a.m. at double time (i.e.
2 times the amount entered in Table 1).

Section 2 - Materials

7. The rates for materials entered in Table 2 include for the following:-

a. The cost of materials including all costs relating thereto.

b. Overheads and profit as defined in Section 4 below.

Section 3 - Plant

8. The rates for plant entered in Table 3 include for the following:-

a. Use of mechanically operated plant for the time engaged upon daywork.

b. Hire charges where applicable.

c. Fuel, grease and lubricating oil.

d. Maintenance.

e. Consumable stores.

f. Spare parts.

g. Insurance and road taxes where applicable.

h. Overheads and profit as defined in Section 4 below.

9. Costs for plant are to exclude the cost of wages in respect of drivers and operatives which are to be
included in Table 1.

10. Payment for mechanically operated plant will be made only for such time as the plant is engaged upon
daywork operations and shall exclude all standing time.

Section 4 Overheads and Profit

11. Overheads and profit are included in the rates entered in respect of labour, materials and plant in Table 1,
2 and 3 respectively.

12. The term Overheads is defined below as including:-

a. Head office charges.

b. Site supervision and site staff.

c. All Government and statutory taxes and levies.

d. Overtime other than that allowed for in Section One.

e. Time lost due to inclement weather.

f. Travelling time and expenses.

g. Subsistence allowances.

h. Safety, health and welfare facilities.

i. Third party and Employers liability insurance.

j. Holiday and sick pay.

k. Tool allowances.

l. Use, repair and sharpening of small tools.

m. All non-mechanically operated plant, erected scaffolding, staging and trestles, artificial lighting,
protective clothing, storage facilities and the like that may be in general use on the site.

n. All other liabilities and obligations whatsoever.
