IV. FACTS OF THE CASE

On or about 8:30 in the morning of March 25, 2017, telephone call received
coming from security guard one (1) Norbeliza Galicia y Lopez, 22 yrs old, single,
presently resing at Brgy. Dalig II, Antipolo City, Rizal informing this office that there was
a rape incident transpired at Tomas Claudio Colleges Taghangin, Morong Rizal and the
victim was still there at the crime scene. Upon receipt of information,

elements of this office together with the undersigned investigator proceeded to the
said location to determine the veracity of the report.

Initial investigation conducted revealed that on or about 5:00: in the morning of

March 26, 2015 while the victim identified as one (1) Frychly Maye Oliveros y Dela
Rosa, 19 yrs old, born on May 5, 1997, sigle, Criminology student 3rd yr at TCC and
presently residing at 55.E. Rodriguez Ave. May-Iba Teresa, Rizal went to school early
for accomplishing their report task with her classmate one (1) John Lynter y Sanchez
19 yrs old, born on June 14, 1997, sigle, Criminology student 3rd yr at TCC and
presently Lagundi Morong, Rizal who is the primary suspect of the case and while
waiting the two have an argument while waiting for their other members at the above
mentioned place of incident. That the suspect John Lynter Sanchez forced the victim
to go to the dark place and rape the latter. After the incident the suspects fled away to
an unknown direction, elements of this office conducted follow up operation for possible
arrest of the suspect.

V. DISCUSSION

According to the witness one (1) Norbeliza Galicia y Lopez went to Tomas
Claudio Colleges at 5:00 in the morning of March 26, 2017 to finish their group task, the
victim was with John Lynter Sanchez who also arrived early they had an argument
when the former confesed to her but she rejected him thats why the suspect forced to
have an sexual intercourse with the latter.

According to the suspect she arrived at the said TDPO but he went to the comfort
room because he was having constipation thats why she was parted to Frychly Maye
O. Dela Rosa but he revealed that they have a secret affair since the victim was in a
relationship with someone else.

According to the Police who investigate the commisson of the crime they were
both arrived at the said TDPO and while waiting for others they had an argument since
they have a secret affair.

VI. CONCLUSION

Investigation revealed that since both Frychly Maye O. Dela Rosa and John
Lynter Sanchez together arrived at Tomas Claudio Colleges early gave them a chance
to talk with each other, while waiting for the others but their conversation led into an
argument as the latter tries to break up with the John Lynter Sanchez, he disaggreed
and due to intense anger of John Lynter Sanchez this led him to rape the latter.

VII. FINDINGS

The victim was Frychly Maye O. Dela Rosa and the suspect revealed as John
Lynter Sanchez arrived at Tomas Claudio Colleges on or about 5:00 in the morning of
March 26, 2017 to finished their group task and while waiting they have a conversation
that led into an argument . The suspect forcibly brought the victim in the backstage of
TCC GYM wherein no one will saw them and gave him a chance to rape the victim
brutaly .

VIII. RECOMMENDATIONS

Based on the foregoing facts, above named arrested suspect was charged for
violations of Art. 266 , Revised Penal Code (Rape) before the office of the prosecutor.

AFFIDAVIT OF COMPLAINT

I, Frank Ashley Oliveros y Dela Rosa, 42 yrs old, born on May 19, 1975,
widow, presently residing at 55.E. Rodriguez Ave. May-Iba Teresa, Rizal after having
been sworn in accordance with law do hereby deposed and state the following, to wit:

THAT, my daughter according to the witness one (1) Norbeliza Galicia y Lopez
arrived early at Tomas Claudio Colleges to finish her group task then John Lynter
Sanchez also arrived. While waiting for the other group members they proceeded to the
TCC Gym and both have conversation but it led into an an argument;

THAT, John Lynter Sanchez forced her to go inside the TCC GYM backstage
while pulling her hair and he immediately locked the door. He punched her in the
abdomen, tied her agaist the wooden object so that she cannot move. After that he
ripped her clothes and forced her to have a sexual intercourse with him. She was crying
and pleading for him to stop but he beat her with blunt object in the head and I lost my
consciousness;

THAT, I am complaining because he raped my daughter and this is to inform the

public and the law enforcement as a citizen of the Philippines to be alert and to
apprehend the suspect and also to file a case against him;

THAT, Is to attest the truth of my statement that I am ready to face the court of
Justice, whatever; This incident that transpired on March 18, 2017 on or about 5:00 in
the morning at Tomas Claudio Colleges;

We, SPO1 Celine Carla Evangelista and SPO1 Melissa P. Nieva presently
residing at Tanay, Rizal, 27 yrs old and 28 yrs old respectively, both Police Officers of
Morong Police Station, after having been duly sworn to in accordance wit the law, do
hereby deposed and state the following, to wit;

THAT, we are among member of Morong Police who conducted the arrest of (1)
JOHN LYNTER SANCHEZ at 1234 Lagundi, Morong, Rizal.

THAT, said operation stemmed from the complaint of FRANK ASHLEY O. DELA
ROSA for Article 266 (Rape) of RPC, which was referred to our office by the
complainant against JOHN LYNTER SANCHEZ, 19 yrs. Old, student of Tomas Claudio
Memorial College, resident of 1234 Lagundi, Morong, Rizal.

We executed this joint affidavit to attest the truthfulness of the foregoing facts
and to support the filing of Criminal Cases against JOHN LYNTER SANCHEZ for Art.
266 (Rape) of Revised Penal Code.

05. T : Maari mo bang isalaysay kung paano mo naisagawa ang nasabing krimen?
S : Kami po ay patungo sa likod ng entablado ng aming TCC court para pag usapan
ang aming problema ng kami lamang dalawa, nang bigla nyang sinabing siyay
makikipag hiwalay na sa akin, ako ay biglang nagalit dahil di man lang niya na isip
ang aming mga pinagsamahan bago niya sabihin iyon. Nag dilim po ang aking
paningin kaya hinila ko siya patungo sa isang silid at siyay aking iginapos, sa
kanyang pag pupumiglas, nainis ako kaya pinalo ko sa ulo niya ang matigas na
bagay na aking nadampot at doon ko na isinagawa ang pag hahalay, ibinalik ko
po ang damit nya sa kanyang katawan upang di mahalata ang ginawa kong pang
hahalay, at ako poy medyo nakadroga ng mga oras na iyon.

06. T :Ano ang iyong motibo sa nasabing krimen?

S : Dahil po sa pag sasabi niyang hihiwalayan nya ko at sa matinding katigangan ko sa
kanya.
07. T :Nakakasigurado ka ba sa lahat ng iyong isinalaysay?
S : Opo sigurado po ako.

08. T :Pansamantala ay wala na muna akong itatanong sa iyo, mayroon ka gustong

idagdag sa salaysay mong ito?
S : Wala na po muna at kung mayroon namay sa hukuman ko na lang po sasabihin.

PURPOSE OF LABORATORY EXAMINATION:

To determine if the semen fluid and fingerprint taken from the suspect is
match on the evidences found in the crime scene.

FINDINGS:

1. Qualitative examination conducted on the Semen fluid taken from the

living person of one (1) JOHN LYNTER y SANCHEZ and a semen fluid
swab from the vaginal area of the cadaver of one (1) FRYCHLY MAYE
OLIVEROS y DELA ROSA gave POSITIVE result to the test for
matching of standard and questioned specimen.

2. Qualitative examination conducted on the One (1) Blunt Object from the
crime scene and a fingerprint taken from living person of one (1) JOHN
LYNTER y SANCHEZ gave NEGATIVE result to the test for
matching of standard and questioned fingerprint.

C O N C L U S I O N:

1. Both semen specimen taken from the living person JOHN LYNTER y
SANCHEZ and FRYCHLY MAYE OLIVEROS y DELA ROSA are
match and the victim was therfore raped by the suspect.

2. Both fingerprint taken form the blunt object found aat the crime scene
and from living person JOHN LYNTER y SANCHEZ are match and
therefore the suspect used that object against the victim.

REMARKS:

The original copy of this report and the specimens submitted are retaned
in this laboratory for future reference.
