TheComplainantstatesthatthefollowingfactsestablishprobablecause:

OnSeptember21,2017,justbefore6:30a.m.,theDuluthPoliceDepartmentreceiveda911callfromthe
BridgeOperatoroftheArielLiftBridge(anationallyregistered,historicspan-driveconfigurationmovable
liftbridgewhichspanstheDuluthShipCanalentrance).TheBridgeOperator,whohadbeennotifiedby
anotherboat,inturninformedauthoritiesthatthe92foot,threedeckmodifiedyachtstylevesselnamedthe
VistaStarandthe66footlong,twodeckyachtstylevesselnamedtheVistaQueenweredeadinthe
waterbothwereadriftinthenorthernsectionoftheDuluthHarborneartheDuluthShipCanal.

AcombinedemergencyresponsefromtheUnitedStatesCoastGuardandtheDuluthFireDepartment
beganferryingtwoVistaFleetemployeeswhowereableseamen,capableofpilotingtheemptyvessels.
Astheboardingpartysetout,the730footJohnD.Leich(atraditionalstyledGreatLakes,self-unloading
bulkcarriersailingundertheCanadianflag)waspreparingtomakeentryintotheDuluthShipCanal.The
Leich(namedaftertheformerUpperLakesShippingChairmanoftheBoard)wasnotifiedbytheBridge
Operatoroftheadriftvessels.TheLeichattemptedtoslow,butgivenhersize,shecontinuedthroughthe
DuluthShipCanal,wheretheVistaQueenlayinherpath.AstheQueenwasboarded,theLeich,unableto
stopordivertcourse,boredownontheabandonvessel,narrowlymissingtheQueen,endangeringthe
rescuersandcrewoftheLeich.TheVistaFleetwerereturnedtodockandmooredonceagain.

Thecrimeoccurringinsuchahistoric,iconic,andimportantarea,lawenforcementwasabletoobtaina
plethoraofvideo.OnevideodepictstheQueenbeingunmooredbyasoleactor,leadoutoftheslip,and
thenguidedoutintotheharbor.Lawenforcementquicklysoughtsuspectsbasedonthisvideoevidence,
andalsobasedonthefactthatunmooringandsettingthefleetadriftclearlyrequiresadvancednautical
knowledge.

Astheinvestigationadvanced,oneofficerspecificallyremembereddealingwithGREGORYMARK
SULLWOLD,DOB:10/09/1969,hereinafterDefendant,whowascausingdamagetopropertyand
threateningtoblowuptheClubSaratoga,alllocatedintheCanalParkarea,neartheareawheretheVista
Fleetwasmoored.Uponarrest,onanunrelatedwarrantoutofHennepinCounty,Defendantwas
particularlyinterestedin,asheputit,theboatsfloatingontheharbor.Healsoseemedtoboastofhis
knowledgeinboats.

Defendantwasinterviewedandconfessed.
