On or about the above stated date and time, the Defendant did
assault Erin Bellcock, (causing bodily injury) having a prior conviction for Domestic Abuse Assault on the _25th__ day of _August__, 201 6, in
Calhoun County, Iowa, Criminal No. AGCR505252, an Aggravated misdemeanor

kicked her in the ribs and dragged her by the hair down an ally. The victim was taken to Stewart Memorial Hospital in Lake City and treated for her
injuries which include a swollen right eye socket and abrasions on her right elbow. A CT scan and xrays were performed. The defendant and victim
have been dating for 1 year.

This order shall remain in effect until modified or terminated by further written order of the court, until
the case is dismissed, or until sentencing.
WARNINGS TO DEFENDANT:
This order shall be enforced, even without registration, by the courts of any state, the District
of Columbia, any U.S. Territory, and any tribal jurisdiction (18 U.S.C. 2265). Crossing state,
territorial, or tribal boundaries to violate this order may result in federal imprisonment
(18U.S.C. 2262).
Federal law provides penalties for possessing, transporting shipping, or receiving any firearm
or ammunition (18 U.S.C. 922(g)(8)).
On the basis of the complaint or affidavit(s) submitted to the court at the time of the defendant's
appearance, the court finds there is probable cause to believe that a violation of
the presence of the defendant in the alleged victim's residence poses a threat to the safety of the
alleged victim, persons residing with the alleged victim, or members of the alleged victim's immediate
family.
If checked, the court finds the defendant and protected party meet the definition of intimate
partners as defined in 18 U.S.C. 921(a)(32) ("'intimate partner' means, with respect to a person, the
spouse of the person, a former spouse of the person, an individual who is a parent of a child of the
person, and an individual who cohabitates or has cohabited with the person").
IF CHECKED, the court must check box 6, prohibiting the defendant from possessing
firearms.
1. Defendant shall not communicate with the protected party in person or through any means
including third persons. This restriction shall not prohibit communication through legal counsel.
2. Defendant shall not be in the immediate vicinity of the residence or place of employment of the
protected party. Defendant shall stay away from the protected party and shall not be in that party's
presence except in a courtroom during court hearings.
3. The defendant, personally or through a third party, shall not threaten, assault, stalk, molest,
attack, harass, or otherwise abuse the protected party, persons residing with the protected party, or
members of the protected party's family. Defendant shall not use, or attempt to use, or threaten to
use physical force against the protected party that would reasonably be expected to cause bodily
injury.
4. If checked, defendant may enter the shared residence once in the company of a peace
officer to retrieve defendant's clothing and work-related items. Defendant shall turn over to the
law enforcement agency all devices that allow access or entry to the residence or outbuildings (for
example, keys or garage openers). The law enforcement agency shall contact the protected party to
provide notice of the intent of the defendant to return to the residence and to accommodate the safety
concerns of the protected party.

Defendant.
NOW on this 17th day of July, 2017, the defendant submits a verified Written Plea of guilty.
The defendant is charged with Domestic Abuse Assault Causing Bodily Injury, an Aggravated
Misdemeanor, in violation of Section 708.2A(1) and 708.2A(2)(b), of the Iowa Code.
The defendant states that defendant is ready to plead and enters a plea of guilty. The written
plea of guilty shows that the defendant's plea is voluntary, being freely and intelligently made, with
an understanding of the charge, with knowledge of the penal consequences of the plea, with full
knowledge of the defendant's constitutional rights, and that said rights are waived by a plea of guilty,
without any threats, improper inducements or persuasion, and the Court finds there is a factual basis
for the defendant's plea of guilty.
The written plea indicates the defendant's informed understanding of defendant's rights
contemplated in the cases of State v. Sisco, 169 N.W.2d 542; Brainard v. State, 222 N.W.2d 711; and
State v. Reaves, 254 N.W.2d 488, all as shown in the defendant's written plea of guilty, which plea is
made a part hereof by this reference.
The Court, therefore, accepts the defendant's plea of guilty, and it is entered of record.

Defendant previously entered a plea of guilty to the above charge and the Court
previously accepted Defendants guilty plea to the charge. A sentencing hearing was
scheduled for todays date. There is no Motion in Arrest of Judgment on file and no
legal cause appears to exist to show why the Court cannot now proceed to judgment
and sentencing. Due to Defendants waiver of Defendants right to be present for

of filing of this Order, it may be considered a violation of this Order
and the terms of Defendants probation. In addition, pursuant to
Iowa Code Section 602.8107, a failure to pay in full within 30 days
may result in this case being assigned to the Centralized Collection
Unit of the Iowa Department of Revenue or its designee to collect
the debts owed to the Clerk of Court. In the event this matter is
assigned for collection, additional fees may be imposed pursuant to
law;
b. Defendant shall serve 365 days in the county jail, with all but 30
days of the sentence suspended. Defendant shall be given credit
for time previously served. The County Sheriff shall designate the
appropriate county jail facility. Defendant shall contact the Sheriff's
Office of this county within seven (7) days of the filing of this Order
to determine the appropriate county jail facility and make the
necessary arrangements to complete the unsuspended portion of
the jail sentence by December 31, 2017. This sentence shall
be served consecutively commencing November 1, 2017. If
Defendant does not serve the unsuspended portion of the jail
sentence by that date, in addition to Defendant being subject to
contempt of court or probation revocation proceedings, upon
written request from the Sheriff, the Clerk of Court shall issue a
warrant for mittimus of the unsuspended portion of the sentence
and such warrant shall issue without further court order.
In compliance with Iowa Code Section 356.7, Defendant
shall pay fees as later assessed for the room and board provided to
Defendant while in the custody of the Sheriff as a result of
Defendants criminal conviction in this matter. The actual amount
assessed will be as set forth in the Room & Board Reimbursement
Claim filed with the Clerk by the Sheriff. The amount assessed
shall have the force and effect of a judgment for purposes of
enforcement. Should Defendant dispute the amount assessed,
Defendant has the right to request a hearing on that issue; and

agreed that the money posted can be applied toward Defendants financial obligations
is hereby exonerated and shall be returned to the person posting the cash bail. All non-
cash bail bonds posted, if any, are hereby exonerated.
7. Case Number SMCR013367 is dismissed with costs and fees taxed to the
Defendant.
