I, the undersigned, being duly sworn, state that all facts contained in this Complaint and Affidavit, known by me or told to me by other reliable persons form the basis for my
belief that the defendant committed this crime
State all facts and persons relied upon supporting elements of alleged crime
On April 24, 2017 at approximately 7:30PM, the defendant physically assaulted the victim causing bodily injury in the yard at 106 Walnut St in Lytton,
Ia. The defendant punched the victim in the head, pushed her to the ground, slapped her multiple times, kneed her in the head,

kicked her in the ribs and dragged her by the hair down an ally. The victim was taken to Stewart Memorial Hospital in Lake City and treated for her
injuries which include a swollen right eye socket and abrasions on her right elbow. A CT scan and xrays were performed. The defendant and victim
have been dating for 1 year.

Upon review of the complaint and accompanying affidavits, the court finds:

The nature of the charge(s) is that it is a:


Aggravated Misdemeanor. This charge ordinarily carries a fine of not less than $625 or greater
than $6,250 except in the case of a conviction for second offense operating while intoxicated which
carries a minimum fine of $1,875 and a maximum of $6,250. In these cases a defendant can
be sentenced to up to two years imprisonment. In the case of a conviction for operating while
intoxicated, second offense, there is a minimum seven day jail sentence, and additionally, the
defendant's driver's license shall be revoked for one year unless the revocation is for test refusal in
which case the mandatory revocation shall be for two years.
In the event that a fine is imposed there will also be a 35% surcharge added plus court costs.

RECITATION OF RIGHTS:

You have the absolute right to remain silent. Anything you say will be used against you.

You are presumed by law to be innocent of the offense(s) charged unless found guilty by proof
beyond a reasonable doubt.

You have the right to be represented by an attorney and one will be appointed for you if you

WARNINGS TO DEFENDANT:
This order shall be enforced, even without registration, by the courts of any state, the District
of Columbia, any U.S. Territory, and any tribal jurisdiction (18 U.S.C. 2265). Crossing state,
territorial, or tribal boundaries to violate this order may result in federal imprisonment
(18U.S.C. 2262).

Federal law provides penalties for possessing, transporting shipping, or receiving any firearm
or ammunition (18 U.S.C. 922(g)(8)).

Only the court can change this order.

On the basis of the complaint or affidavit(s) submitted to the court at the time of the defendant's
appearance, the court finds there is probable cause to believe that a violation of

Iowa Code section 708.2A Domestic Abuse Assualt has occurred.

the presence of the defendant in the alleged victim's residence poses a threat to the safety of the
alleged victim, persons residing with the alleged victim, or members of the alleged victim's immediate
family.

If checked, the court finds the defendant and protected party meet the definition of intimate
partners as defined in 18 U.S.C. 921(a)(32) ("'intimate partner' means, with respect to a person, the
spouse of the person, a former spouse of the person, an individual who is a parent of a child of the
person, and an individual who cohabitates or has cohabited with the person").
IF CHECKED, the court must check box 6, prohibiting the defendant from possessing
firearms.

Therefore, the court orders as follows:

1. Defendant shall not communicate with the protected party in person or through any means
including third persons. This restriction shall not prohibit communication through legal counsel.
2. Defendant shall not be in the immediate vicinity of the residence or place of employment of the
protected party. Defendant shall stay away from the protected party and shall not be in that party's
presence except in a courtroom during court hearings.
3. The defendant, personally or through a third party, shall not threaten, assault, stalk, molest,
attack, harass, or otherwise abuse the protected party, persons residing with the protected party, or
members of the protected party's family. Defendant shall not use, or attempt to use, or threaten to
use physical force against the protected party that would reasonably be expected to cause bodily
injury.
4. If checked, defendant may enter the shared residence once in the company of a peace
officer to retrieve defendant's clothing and work-related items. Defendant shall turn over to the
law enforcement agency all devices that allow access or entry to the residence or outbuildings (for
example, keys or garage openers). The law enforcement agency shall contact the protected party to
provide notice of the intent of the defendant to return to the residence and to accommodate the safety
concerns of the protected party.

3. The parties also have agreed that the companion

dismissed with costs to Defendant.

4. Also, at the request of the victim, the parties also are


requesting that the no-contact be terminated.

The defendant is charged with Domestic Abuse Assault Causing Bodily Injury, an Aggravated
Misdemeanor, in violation of Section 708.2A(1) and 708.2A(2)(b), of the Iowa Code.

CHARGE: Domestic Abuse Assault Causing Bodily Injury, a serious


misdemeanor, in violation of Iowa Code 708.2A(1) and
708.2A(2)(b)

Defendant previously entered a plea of guilty to the above charge and the Court
previously accepted Defendants guilty plea to the charge. A sentencing hearing was
scheduled for todays date. There is no Motion in Arrest of Judgment on file and no
legal cause appears to exist to show why the Court cannot now proceed to judgment
and sentencing. Due to Defendants waiver of Defendants right to be present for
sentencing and waiver of the formality of the record otherwise required by Rule 2.23
and other applicable rules of the Iowa Rules of Criminal Procedure, the Court now
proceeds to judgment and sentencing without Defendants presence.

IT IS THE ORDER OF THE COURT AS FOLLOWS:


1. Defendant is adjudicated guilty of the above-described crime and
pursuant to Iowa Code Section 903.1.
2. Defendant is hereby sentenced as follows:
a. Defendant shall pay financial obligations as follows:
(1) a fine in the sum of $315.00;
(2) a 35% surcharge;
(3) court-appointed attorney fees. The Court has
determined, by information presented by the parties, that
Defendant is able to pay court-appointed attorney fees;
(4) restitution in an amount to be determined at a later time.
The State shall file a statement of pecuniary damages within
30 days of todays date, or no restitution shall be ordered.
Upon filing of such a statement, the amount claimed in the
statement shall be considered to be ordered to be paid
unless Defendant objects to the claimed amount by filing an
objection within 10 days of the filing of the statement. In

that event, the Court shall issue an order establishing the


restitution amount, with or without a hearing as the Court
deems appropriate; and
(5) the court costs of this action.

The fine and 35% surcharge are suspended. Defendant shall pay
all financial obligations owed to the Clerk of Court of this county or
online at www.iowacourts.gov. All such financial obligations shall
be paid in full on or before the 30th day following the filing of this
Order. If the financial obligations are not paid in full within 30 days
of filing of this Order, it may be considered a violation of this Order
and the terms of Defendants probation. In addition, pursuant to
Iowa Code Section 602.8107, a failure to pay in full within 30 days
may result in this case being assigned to the Centralized Collection
Unit of the Iowa Department of Revenue or its designee to collect
the debts owed to the Clerk of Court. In the event this matter is
assigned for collection, additional fees may be imposed pursuant to
law;

b. Defendant shall serve 365 days in the county jail, with all but 30
days of the sentence suspended. Defendant shall be given credit
for time previously served. The County Sheriff shall designate the
appropriate county jail facility. Defendant shall contact the Sheriff's
Office of this county within seven (7) days of the filing of this Order
to determine the appropriate county jail facility and make the
necessary arrangements to complete the unsuspended portion of
the jail sentence by December 31, 2017. This sentence shall
be served consecutively commencing November 1, 2017. If
Defendant does not serve the unsuspended portion of the jail
sentence by that date, in addition to Defendant being subject to
contempt of court or probation revocation proceedings, upon
written request from the Sheriff, the Clerk of Court shall issue a
warrant for mittimus of the unsuspended portion of the sentence
and such warrant shall issue without further court order.
In compliance with Iowa Code Section 356.7, Defendant
shall pay fees as later assessed for the room and board provided to
Defendant while in the custody of the Sheriff as a result of
Defendants criminal conviction in this matter. The actual amount
assessed will be as set forth in the Room & Board Reimbursement
Claim filed with the Clerk by the Sheriff. The amount assessed
shall have the force and effect of a judgment for purposes of
enforcement. Should Defendant dispute the amount assessed,
Defendant has the right to request a hearing on that issue; and

c. As a condition of a portion of Defendants sentence being


suspended, Defendant is placed on informal probation for a period
of one (1) year to the Sac County Probation Office (the Probation
Supervisor) under the terms and conditions the Probation
Supervisor deems appropriate. In addition to any terms the
Probation Supervisor imposes, the Court specifically imposes all of
the following terms of probation:
(1) Defendant shall make in-person contact with the Probation
Supervisor within seven (7) days of the filing of this Order to
sign up for probation and sign any probation supervision
agreement requested by the Probation Supervisor.
Telephone contact is not sufficient;

(2) Defendant shall obey all laws;

(3) Defendant shall be employed full-time, attending school full-


time, or engaged in a full-time combination of employment
and school attendance during the period of probation;

(4) Defendant shall comply with all terms of this Order,


including paying all financial obligations and completing all
required tasks in a timely manner; and

(5) Defendant shall successfully complete the Batterers


Education Program facilitated by the Second Judicial District
Department of Correctional Services.

3. The Court grants this sentence because it provides for Defendants


rehabilitation and the protection of the community. The Court has considered the
sentencing recommendation of the parties.
4. Defendant has a statutory right to appeal by filing written notice of appeal
with the Clerk of Court of this county within 30 days of the date of these proceedings.
If Defendant is unable to pay the costs of appeal, Defendant may apply to the Court for
appointment of counsel and the furnishing of a transcript of the evidence as provided in
Iowa Code Sections 814.9 and 814.11. Filing a notice of appeal within the time and in
the manner specified in Iowa Rule of Appellate Procedure 6.101 is jurisdictional and

5. Appeal Bond is set in the sum of $5,000.00, cash or surety.
