AFFIDAVIT
I, ELMA EMO ABELLA, married, of legal age, Filipino, and a resident of
Davao City, after having been sworn to in accordance with law, hereby depose and say
that:

1. I am the Project Engineer of NEWCON BUILDERS CONST. & SUPPLY, INC

(Establishment of Standard Banana Packing House @ Barangay Sirib,
Calinan, District) under contract with the Department of Agriculture-
Region XI said project involving the construction of a banana packing
house to qualified recipients.

2. The company was under contract to construct a packing house at the

property owned by recipient, RAMON CASTILLO.

3. At site, it was necessary to demolish a one-story residential building made

of light materials for the project to commence, as it was located in the
proposed building site.

4. Upon instructions by the owner-recipient, Ramon Castillo, the company

laborers proceeded to demolish the subject building with the agreement
that Ramon Castillo will finance the labor and other expenses connected
with the demolition, on or around June 17, 2017.

5. However, shortly afterwards, the alleged brother of the owner of the

building, had the demolition stopped, as the building is still under
contention.

6. By this affidavit, I therefore avow that the Department of Agriculture has no

participation whatsoever in the abovecited circumstances and in no case
had any knowledge or involvement in the matter of the demolition.

7. I am stating that all of the above for the reason of establishing such facts
and not to perpetuate any fraudulent intent nor to the commission of the
same and forever discharge any person, public or private, natural or
juridical from any liability that may arise from this. I am executing this
affidavit to attest the truth of all the foregoing and for any other legal
purposes this may serve.
