Facts
For the fall 2009 semester, the non-championship segment of the softball season, the son of
Giint Myers, the head coach for the softball program, monitored some of the conditioning
sessions along with his father.
Specifically during the fall of 2009 the head coach revised the manner in which his student-
athletes engaged in strength and conditioning activities. The head coach, spilt the team into
two groups allowing half to complete the strength/weight training program and the other half to
complete a conditioning program with each group switching programs daily. This was done for
the purpose of creating smaller groups of student-athletes to work with during the
strength/weight and conditioning programs.*
The strength/weight training program was designed and conducted by an ICA sports
performance assistant coach. The conditioning program was designed by Coach Myers with the

assistance of his two sons Casey Myers and Corey Myers during the summer of 2009. Coach
Myers was present at and conducted each conditioning session during the fall 2009 semester.
However, Coach Myers's son, Corey Myers, provided instruction on conditioning activites to
student-athletes on an occasional basis during the fall 2009 semester. Corey Myers's primary
purpose for being at the conditioning session was to confer with his father about the design of
the program. Nonetheless, Corey's instruction constitutes a violation as he was not a member
of the softball coaching staff.
The instances of Corey Myers providing conditioning instruction to softball student-athletes
during the fall 2009 semester reflect an isolated occurrence that created an inadvertent rule
Violation. Head Coach Clint Myers should have designated Corey Myers as the volunteer coach
for the program during the fall semester, while the acting volunteer coach was unavailable.
Had Coach Myers initiated such a designation there would not have been a rules infraction, In
fact, Corey Myers has acted as the designated Volunteer Coach for the softball program on two
prior occasions (starting respectively on May 10, 2007 and May 26, 2008 through those
respective post-competition seasons) when he replaced his brother, Casey Myers”,
Discovery
‘After an internal review of our softball program, this infraction was discovered,
Eligibility Ramifications
This violation does not create eligibility ramifications for current or former student-athletes in
the program.
Penalties/Corrective Actions
‘The head coach and his son have been educated about NCAA bylaws pertinent to this matter
and the head coach has received a letter of admonishment. Corey Myers has not had any
involvement in the conditioning activities of student-athletes in the softball program in the
current academic year. Corey Myers is regarded as a representative of athletic interests and
thus, has been issued a letter of caution,

Casey Myers has regularly been designated as the Volunteer Coach for the program. Casey Myers is
‘employed by the Oakland A's organization. His work obligations with the organization occasionally require him to
leave the softball program in the Spring and delay his joining the program inthe Fall, During the fall 2009 semester,
Casey was stil working withthe A's and was not performing his Volunteer Coach duties.Arizona State University

SUBJECT: ‘Memorandum of Expectations
Following our recent review of the women's softball program, a number of matters came to light
regarding your leadership of that program. Those matters include your style of interaction with ASU
‘Athletics administration and various interactions by your son, Corey Myers, with the University. This
memorandum confirms our discussion today regarding my expectations, going forward, of your
performance as head coach.
You are responsible for leading and managing the women’s softball program in full compliance with all
applicable NCAA and Pacific-10 Conference legislation and Arizona Board of Regents, University and
Departmental policies and procedures. Part of this responsibility is to ensure that your coaching and
rnon-coaching staff members receive education on applicable legislation and policies. If you do not know
or are not certain whether a proposed action or activity is permissible under the foregoing standards
then itis your responsibility to contact either the Compliance staff or the Sport Administrator to review
the proposed action or activity prior to that action or activity being undertaken.
Your son, Corey, is welcome to attend athletic events that are open to the public on the same terms and
conditions as are extended to general members of the public. He is not to come onto the field or into
the facility areas that are open only to coaching staff, student-athletes and authorized ASU Athletics
staff without the prior written permission of the sport supervisor.
Corey may not serve in any paid or unpaid capacity in any role (e.g., volunteer coach, consultant, etc.)
with the women’s softball program. Nor can any business venture owned or operated by your son
provide goods or services to women's softball, whether on a paid or donated basis.
‘No expenditures can be made from the booster club account without the prior review and written
approval by either: Amy Schramm, Associate Athletics Director or Dawn Rogers, Senior Associate
Athletics Director.

Effective immediately, the director of operations for women’s softball will report directly to the Sport
‘Administrator and shall have a dotted reporting line to you as head coach.
‘Thank you for completing and submitting the Disclosure of Substantial Interest form on June 10, 2010
as required under the University’s Conflict of interest policy (ACD 204-08), with respect to GraphX LLC, a
company owned by Corey Myers. As specified in the policy, following your disclosure of a substantial
interest you must refrain from participating in any manner in the contract, sale, purchase, or decision by
the University to engage in business with GraphX LLC. This includes soliciting for business whether for
softball or any other sports program or any non-athletic unit of the University. In practice, this means
that you cannot participate in any manner for either the Women’s softball program or the program's
booster club, should either program solicit bids or otherwise engage companies in the business of
printing signs, banners or other graphic art. Additionally, itis my expectation that any business
providing signs, banners or other graphic art to the Women’s softball program will have a written license
‘agreement in place which enables them to use the protected trademarks and dress of ASU Athletics
consistent with institutional policies PUR 701: Trademark Licensing and PUR 402-05: ASU Graphic
Standards.
‘The University makes certain of its facilities available to Sun Devil Softball Camps, LLC under the terms.
‘and conditions of the Camp Agreement renewed as of August 8, 2008 and of the terms and conditions of
individual Rental Event Agreements. Sun Devil Softball Camps, LLC does not have authorization from
‘ASU to make any assignment or sublease of the use of the facilities to any third party, including but not
limited to CM Baseball and Softball Academy, a company owned by your son, Corey Myers. When using
‘ASU Athletic facilities, Sun Devil Softball Camps, LLC must operate separately and independently of CM
Baseball and Softball Academy. Please update the Disclosure of Substantial Interest form to reflect this
additional business interest of your son. Again, you must refrain from participating in any manner in the
contract, sale, purchase, or decision to engage in business with CM Baseball & Softball Academy.
‘You do not have authority to approve or permit any form of advertising or signage In Farrington Stadium
‘or any other facilities within ASU Athletics, You cannot facilitate the promotion or sponsorship of any
business owned by your family members or any other third party while utilizing university facilities.
Sponsorship matters are handled by Steve Hank, Associate Athletic Director.
‘Asecond son, Casey Myers, does serve as a volunteer coach for the women’s softball program. With
respect to the University’s policy on Nepotism (SPP 205), | am confirming that the sport administrator is
the designated alternate administrator who shall make any and all key decisions as that term is defined
inthe policy. You cannot participate in any aspect of the hiring process nor can you participate in any
key decisions involving a relative who is or wishes to become a university employee. This extends to any
family member who currently serves or may serve as a volunteer coach in the Women’s softball
program. Where a relative has been approved to be hired or to serve as a volunteer for the UniversityClint Myers

by the sport administrator, only then are you allowed to handle supervision of day-to-day assignments,
as defined in the policy.
Itis my further expectation that you will ensure that each of your family members who have any contact,
with student-athletes or prospective student-athletes, are knowledgeable of all applicable NCAA
legislation, including but not limited to provisions related to the prohibition of extra benefits and.
student employment. Additionally, effective July 1, 2011, departmental policy will provide that:
= Absent the express written prior approval of the Vice President for University Athletics, no
student-athlete may reside in any property owned, leased or managed by any ASU Athletics
employee or family member at anytime while that student-athlete retains eligibility.
= Absent the express written prior approval of the Vice President for University Athletics, no
student-athlete may be employed by any ASU Athletics employee or family member at anytime
‘while that student-athlete retains eligibility. The sole standing exception will be student-
athletes employed in head coach camps which are operated under the review of the
department.
