ORDER
The accused in this case posted bail. Trial ensued but the Decision was
promulgated in absentia on April 20, 2005, because the accused absconded and
fled away. However, the accused was arrested by the Police of Loon, Bohol on
October 8, 2010, and is now committed at the Bohol District Jail.
Relatively, the bondsmen who posted bail (either cash or property bond)
for the provisional liberty of the accused in this case, particularly Eusterio
Coritico and Necitas Formoso (wife of bondsman Manuel Formoso who is already
deceased) filed Motion to Withdraw Bonds with explanation that upon learning
that the accused failed to appear in the promulgation of judgment, they exerted
diligent efforts to look for him but they could not find him in the province Bohol
and in the province of Siquijor and in places in Mindanao where he was assumed
to be hiding.
