SUBJECT
SECURITY FIGHT WITH SUBJECT

R/C to listed location on a report of a disturbance involving security and

a subject. When I arrived, I observed FOSTER, Westley sitting on the
sidewalk in handcuffs.

I first spoke with TEMPLETON, Michael. He is a security guard at the

Safeway. He told me he got some complaints from customers about a male
outside asking them for money. TEMPLETON said he went outside and FOSTER
was standing on the sidewalk. TEMPLETON said he talked to FOSTER for a
while and FOSTER refused to leave. He said the conversation got a little
heated and FOSTER was getting in his face. TEMPLETON said SERAPHIN came
out to assist him and SERAPHIN pushed FOSTER in the chest. TEMPLETON said
FOSTER responded by punching SERAPHIN once in the face. After he was
punched, TEMPLETON said SERAPHIN pulled out his baton and struck FOSTER
twice with it. At this time, the altercation was out in the parking spaces
on the street. TEMPLETON said he assisted SERAPHIN in placing FOSTER in
handcuffs and brought him to the sidewalk where he was sitting now.

I then talked to FOSTER. He told me he was asking customers for money. He

said he asked about ten people for money. He said that is when security
came out to talk to him. He also said TEMPLETON just talked to him.
FOSTER denied getting in his face. FOSTER said SERAPHIN pushed him and he
reacted by punching him once. He said SERAPHIN responded by hitting him
multiple times with the baton. FOSTER had a scrape on his shin and was
complaining of some pain in his chest. Ofc. Hastings requested AMR to come
to our location. FOSTER told me he did not want to press charges. He said
he just wanted it to go away. But he said if SERAPHIN pressed charges he
wanted to as well. FOSTER felt he was defending himself.

I then spoke with SERAPHIN. He told me he had come outside when he saw
TEMPLETON talking to FOSTER. SERAPHIN said he felt FOSTER was being too
aggressive so he pushed FOSTER back. He said FOSTER then punched him and
he responded by striking him with his baton twice. After which, he placed
FOSTER into handcuffs with TEMPLETON's assistance.

FOSTER was transported to the hospital by AMR.

I did not feel I had PC to arrest either and am referring this to DA for
charges.
