ORDER:-

In the letter 1st read above, the Engineer-in-Chief, Panchayat Raj,


Hyderabad has stated that Sri P. Kumar, worker, Allwyn redeployed employee
expired on 7.3.2007 while in service and his wife Smt. P. Krishnaveni submitted
an application dt.29.6.2009 requesting to sanction death benefits such as
Gratuity, family pension etc., and to provide appointment to her on
compassionate grounds. She was paid an exgratia amount of Rs.50,000/- as
per the orders issued in G.O.Ms.No.36, PE (III) Department, Dated:5.9.2001. In
G.O.Ms.No.77, Industries & Commerce (IFR.II) Department, dated: 26.2.2009,
Government have issued orders for regularization of services of erstwhile
Hyderabad Allwyn Limited redeployed employees into Government Departments
considering the qualification, eligibility for holding the respective equivalent
post/cadre in the departments, on par with the regular Government servants
with all consequential benefits from the date of deployment where they are
presently positioned. As per these orders, Sri P. Kumar, Worker, Allwyn
redeployed employee (expired) was absorbed as Office Subordinate in the Office
of the Engineer-in-Chief, Panchayat Raj, Hyderabad and allowed all
consequential benefits w.e.f. 3.5.1993 i.e., the date of joining in the Department
in terms of A.P. Last Grade Service Rules along with other redeployed workers of
erstwhile Hyderabad Allwyn Limited; vide Proceedings dt.19.4.2010 of the
Engineer-in-Chief, Panchayat Raj, Hyderabad. While further stating that Smt. P.
Krishnaveni, W/o. late P.Kumar has passed 7th class and applied for
compassionate appointment, the Engineer-in-Chief, Panchayat Raj, Hyderabad
has requested to issue suitable orders on compassionate appointment to the
dependent personnel of erstwhile Allwyn employees and release of pensionary
benefits to the family pensioner.

2. Smt. P. Krishnaveni has filed O.A.No.7953/2010 before the Honble A.P.


Administrative Tribunal seeking direction for compassionate appointment and the
Honble A.P. Administrative Tribunal, in its interim order dt.18.11.2010 in
O.A.No.7953/2010, has observed that in view of the absorption of the applicants
husband as Office Subordinate and granting of consequential benefits of the
applicants husband, the applicant is entitled to be considered for compassionate
appointment. The APAT has therefore directed to reconsider the case of the
applicant for appointment on compassionate grounds keeping in view the above
circumstances and also as was done in the case of Smt. D. Amrutha, W/o. late
Sri D. Narsinga Rao, Allwyn Worker under G.O.Ms.No.74, I&CAD (Ser.III.2)
Dept., Dt.21.6.2010 and pass appropriate orders within a period of two weeks.

3. Government have examined the matter and observed that Smt. P.


Krishnaveni, W/o. late Sri P. Kumar was paid exgratia immediately after the
death of her husband in 2007, who was working as Worker in the O/o Engineer-
in-Chief, Panchayat Raj as redeployed employee of HAL. At that time Sri P.
Kumar was not absorbed into State Government Service. Hence, he was treated
only as employee of PSU and exgratia was paid in lieu of compassionate
appointment. Subsequently, vide G.O.Ms.No.77, Industries & Commerce (IFR.II)
Department, dated: 26.2.2009, Government have absorbed all the redeployed
employees of erstwhile Hyderabad Allwyn Limited into State Government
Services with retrospective effect i.e., w.e.f. 3.5.1993. After issue of these
orders, Smt. P. Krishnaveni has submitted an application on 29.6.2009 i.e., with
a delay of five months, for compassionate appointment. Government have
further observed that since the services of late P.Kumar were absorbed as Office
Subordinate in the Office of ENC, PR and all consequential benefits were granted
as per G.O.Ms.No.77, Industries & Commerce (IFR.II) Department,
dated:26.2.2009, he is deemed to be a Government employee w.e.f.3.5.1993
for all purposes.

4. Government, after careful examination of the matter, hereby permit the


Engineer-in-Chief, Panchayat Raj to appoint Smt. P. Krishnaveni, W/o. Late P.
Kumar, a redeployed employee of Hyderabad Allwyn Limited on compassionate
grounds as per her eligibility in relaxation of the condition stipulated in
G.O.Ms.No.687, GA (Ser.A) Dept., Dt.3.10.1977 that the applications for
compassionate appointment shall be entertained within a period of one year
from the date of occurrence of the death of Government servant.

5. The Engineer-in-Chief, Panchayat Raj, Hyderabad shall take further action


accordingly.
