Dahlia Street. Denver Officers responded, searched the area, and cleared the scene when nothing was found, On November 20, 2015, at approximately 7:25 a.m., Reporting Party (@UNEEEEINMD, called 911 to report that her son had been shot. (@HINB was calling from 334 N. Dablia Street. DPD Officers and DHMC Paramedics responded end discovered the victim lying on the floor, partially in « hallway, and partially in a bedroom. Officers observed apparent bullet defects through the window in the bedroom, and ‘observed apparent bullet defects in the victim. DHMC Doctor Hemerck, pronounced the victim dead at 7:36 a.m. The victim was identified as Joel Gomez-Chavez, dob: 09/09/1995. Gomez-Chavez was not transported. Detective Martin } Smith was assigned as the Primary Detective on this case and Detective Louis Estrada ‘was assigned as the secondary Detective. The scene is located on the property of the Dahlia Street Apartments. The Dablia Street Apartment property boundaries are E. Bruce Randolph Avenue to the north, E. 33" Avenue to the south, Dexter Street to the east, and the 3300 block Dexter Street/Dahlia Street alley to the west. The Dahlia Street Apartments consist of six individual two story brick buildings tan in color. Each individual building has six units. There are three units on the top level and three units onthe bottom level ofeach building. ‘There are two scenes. The first scene is near the north end of the Dexter St Dahlia St. alley 3300 block. The second scene is inside unit 334] which is located on the lower level near the west end ofthe second building south of B. Bruce Randolph Ave. This building is labeled with the addresses 3371 thru 3381. ‘There are 12 defects in the lower level window. The window is located on the southwest comer of the ‘building on the east side of the alley. The window faces west towards the alley and is a vinyl window ‘with white colored molding. The window slides open and has a screen attached and appears to have been closed at the time of the shooting. The screen has numerous defects. AFFIDAVIT AND APPLICATION FOR ARREST WARRANT Six 40 caliber shell casings, and five 45 caliber shell casings were recovered from outside the bedroom window. ‘The DPD Crime Lab processed the entire crime scene and collected evidence. On Monday, November 23, 2015, Detective Smith received a NIBIN hit notification report. (NIBIN Hit #15-143). The report was prepared by Charles Reno, from the DPD Firearms Unit of the DPD Crime Lab. The report indicates the following; On November 19, 2015, at 10:55 p.m., shots were fired into an occupied vehicle, parked in the 3300 block of Olive Street, Denver case #2015-678038. Four 45 caliber shell casings and eight 40 caliber shell ‘casings were recovered from that scene. (A black sedan or small black SUV was described by witnesses as the suspect vehicle involved). A cigar tip was also recovered near some of the shell casings. A DNA profile was obtained and the major source is Kenneth Banks, the minor source is i. On November 19, 2015, at 11:32 p.m, a 911 call was received from 334 Dahlia Street. The caller said thore was gunfire in the alley. Officers checked the alley and cleared from the scene. At approximately 7:25 a.m., on November 20, 2015, AMMEN, returning home from work, weat into her residence ‘at 338 Dahlia Street and found her son ying on the floor bleeding. The victim Joel Gomez-Chavez died of gunshot wounds. Denver case #2015-678513, Six 40 caliber shell casings were recovered and five 45 caliber shell casings were recovered from the scene. (A black sedan or small black SUV was described by a witness as being the suspect vehicle). On November 20, 2015, at approximately 1:25 a.m, QUEEN, was shot and killed outside of a bar in Aurora located at 116i E. Montview Blvd. Aurora case #15-45722. Three 45 caliber shell casings were recovered at the scene. (A red Dodge Caliber and a silver sedan similar to a Toyota Matrix were described by witnesses as the suspect vehicles involved). On November 23, 2015, at 4:46 a.m., Deandre Mayfield was shot and killed in the 4700 block of Peoria Street. Denver case #2015-684320. fine 40 caliber shell casings were recovered from that scene. (It was determined a silver Toyota Matrix is the suspect vehicle in this homicide). ‘The report indicates that the 40 caliber shell casings recovered from case #1, case #2, and case #4, were all fired from the same gun. The report also indicates the 45 caliber shell casings recovered from case #1, case #2, and case #3, were all fired from the same gun. ‘The Deandre Mayfield case was assigned to Detective Aaron Lopez. (Denver case #15-684320) During the course of that investigation, Detective Lopez was able to identify Kenneth Banks, dob: 12/13/1994, FBI #166347WDO, and SID#2435061, as the shooter in that homicide. An arrest warrent for Kenineth Banks was signed and approved for this murder. Aurora Homicide Detective Randy Hanson was also able to identify Kenneth Banks as the suspect in the Aurora murder. (Aurora case #15-45722). An arrest warrant was signed and approved for this murder, ‘On June 14, 2016, Detective Lopez and Detective Hanson traveled to Sacramento California and interviewed Kenneth Banks, dob: 12/13/1994, Banks had just recently been arrested on both murder. Banks confessed to the murder of Deandre Mayfield, Denver case #15-684320, and to the Aurora murder, Aurora case #15-45722. Detective Lopez asked Banks about this murder at 3349 Dahlia Street. Banks said he was present for the amurder but he was not the shooter. Banks indicated that @ijINENIEB dob: @i971990 was the lone shooter, ‘On June 16, 2016, Detective Smith traveled to Sacramento California and conducted a video recorded interview with Kenneth Banks, On this occasion, Banks again said he was present and he indicated that bot ST, and GENES, dob: @aNE1990, were the shooters in this murder. Banks said he was in the back seat of the red dodge that belonged {o SS. GNP was driving and (GREER wes in the front passenger seat. Banks said SUNN and (UNEEEB got out of the car and shot {nto the window. Banks said he remained in the car, ‘The only witness to the murder at 33@9 Dahlia Strect, QUINN, said he heard shots fired, looked out the window and observed black males getting into the front passenger and back passenger seat of a car and then it drove said the driver never got out of the car. GIR said ‘he black males that got into the car were the ones involved in the shooting. On Saturday, September 3, 2016, Detective Smith responded to the Adams County Jail and met with Kenneth Banks. At 9:42 am., Detective SMITH began a video recorded interview with Banks, After completing the DPD Advisement Form with Banks, he advised he wanted to speak with Detective Smith about the murder at 33° Dahlia Steet. Banks almost immediately said he was the one that got out of the car and started “busting”. Banks said he did it. Banks said he did all of it, nobody else, just him, ‘Banks said he was really drunk, and all he remembers is getting out of the car and walking up to the ‘window and shooting. Baiks said he knocked on the window before shooting into the window. Banks said he was on drags and drinking liquor. Banks said he was “tripping” from all the alcohol and drugs ‘he was taking. Banks said he knew the victim. Banks said he had a previous altercation with the victim. Banks said he was disrespectful, so he paid him a little visit. Banks said it was a racial altercation, and the victim disrespected him at an afterhour’s club on Fox Street. Banks said he “aired it out” in the ‘window. Banks said that means he shot into the window. Banks said he found out where the victim lived ‘through “Bitched”. Banks said when they went into the alley; he could see his light was on. Banks said he knocked on the window and the victim looked out of the shades. Banks said he then blasted him. ‘Banks said he was shooting either a 45 caliber or a 40 caliber handgun. He can’t remember which one. ‘Banks does not know how many times he fired. Banks admitted that QD ond GENE were also present but he said he would not ‘say who else was shooting into the window. The recovered 45 caliber shell casings from the 33 Dahlia Street crime scene match the 45 caliber shell casings from the Aurora murder.
