RE: Notice of Recusal

Dear Ms. Grosko,

On October 29, 2017 Justice ONeill announced his intention to become a partisan
candidate for the Office of Governor of Ohio.

In the interest of avoiding the appearance of impropriety, the Justice issued the following
blanket notice of recusal for future cases:

I will not be participating in any new matters submitted to the Court from this date
forward until February 7, 2018. I will continue to vote on and participate in the
resolution of the approximately 99 cases which have been submitted and not yet
released.

Should the Justice terminate his campaign for governor at any time or for any reason, he
will resume participating in all matters before the Court from that date through the end of
his duly elected term, which ends on January 1, 2019.
