A BILL
To regulate assault weapons, to ensure that the right to
keep and bear arms is not unlimited, and for other purposes.
1 Be it enacted by the Senate and House of Representa-

2 tives of the United States of America in Congress assembled,
3 SECTION 1. SHORT TITLE.
4 This Act may be cited as the Assault Weapons Ban

5 of 2017.
6 SEC. 2. DEFINITIONS.
7 (a) IN GENERAL.Section 921(a) of title 18, United

8 States Code, is amended

1 (1) by inserting after paragraph (29) the fol-
2 lowing:
3 (30) The term semiautomatic pistol means any re-
4 peating pistol that
5 (A) utilizes a portion of the energy of a firing
6 cartridge to extract the fired cartridge case and
7 chamber the next round; and
8 (B) requires a separate pull of the trigger to
9 fire each cartridge.
10 (31) The term semiautomatic shotgun means any
11 repeating shotgun that
14 chamber the next round; and
16 fire each cartridge.; and
17 (2) by adding at the end the following:
18 (36) The term semiautomatic assault weapon
19 means any of the following, regardless of country of manu-
20 facture or caliber of ammunition accepted:
21 (A) A semiautomatic rifle that has the capac-
22 ity to accept a detachable magazine and any 1 of the
23 following:
24 (i) A pistol grip.
25 (ii) A forward grip.

1 (iii) A folding, telescoping, or detachable
2 stock.
3 (iv) A grenade launcher or rocket launch-
4 er.
5 (v) A barrel shroud.
6 (vi) A threaded barrel.
7 (B) A semiautomatic rifle that has a fixed
8 magazine with the capacity to accept more than 10
9 rounds, except for an attached tubular device de-
10 signed to accept, and capable of operating only with,
11 .22 caliber rimfire ammunition.
12 (C) Any part, combination of parts, compo-
13 nent, device, attachment, or accessory that is de-
14 signed or functions to accelerate the rate of fire of
15 a semiautomatic rifle but not convert the semiauto-
16 matic rifle into a machinegun.
17 (D) A semiautomatic pistol that has the ca-
18 pacity to accept a detachable magazine and any 1 of
19 the following:
20 (i) A threaded barrel.
21 (ii) A second pistol grip.
22 (iii) A barrel shroud.
23 (iv) The capacity to accept a detachable
24 magazine at some location outside of the pistol
25 grip.

1 (v) A semiautomatic version of an auto-
2 matic firearm.
3 (E) A semiautomatic pistol with a fixed maga-
4 zine that has the capacity to accept more than 10
5 rounds.
6 (F) A semiautomatic shotgun that has any 1
7 of the following:
8 (i) A folding, telescoping, or detachable
9 stock.
10 (ii) A pistol grip.
11 (iii) A fixed magazine with the capacity to
12 accept more than 5 rounds.
13 (iv) The ability to accept a detachable
14 magazine.
15 (v) A forward grip.
16 (vi) A grenade launcher or rocket launch-
17 er.
18 (G) Any shotgun with a revolving cylinder.
19 (H) All of the following rifles, copies, dupli-
20 cates, variants, or altered facsimiles with the capa-
21 bility of any such weapon thereof:
22 (i) All AK types, including the following:
23 (I) AK, AK47, AK47S, AK74,
24 AKM, AKS, ARM, MAK90, MISR,

1 (K) All belt-fed semiautomatic firearms, in-

3 (L) Any combination of parts from which a
4 firearm described in subparagraphs (A) through (K)
5 can be assembled.
6 (M) The frame or receiver of a rifle or shot-
7 gun described in subparagraph (A), (B), (C), (F),
8 (G), (H), (J), or (K).
9 (37) The term large capacity ammunition feeding
10 device
11 (A) means a magazine, belt, drum, feed strip,
12 or similar device, including any such device joined or
13 coupled with another in any manner, that has an
14 overall capacity of, or that can be readily restored,
15 changed, or converted to accept, more than 10
16 rounds of ammunition; and
17 (B) does not include an attached tubular de-
18 vice designed to accept, and capable of operating
19 only with, .22 caliber rimfire ammunition..
20 (b) RELATED DEFINITIONS.Section 921(a) of title
21 18, United States Code, as amended by this Act, is
22 amended by adding at the end the following:
23 (38) The term barrel shroud
24 (A) means a shroud that is attached to, or
25 partially or completely encircles, the barrel of a fire-

1 arm so that the shroud protects the user of the fire-
2 arm from heat generated by the barrel; and
3 (B) does not include
4 (i) a slide that partially or completely en-
5 closes the barrel; or
6 (ii) an extension of the stock along the
7 bottom of the barrel which does not encircle or
8 substantially encircle the barrel.
9 (39) The term detachable magazine means an am-
10 munition feeding device that can be removed from a fire-
11 arm without disassembly of the firearm action.
12 (40) The term fixed magazine means an ammuni-
13 tion feeding device that is permanently fixed to the firearm
14 in such a manner that it cannot be removed without dis-
15 assembly of the firearm.
16 (41) The term folding, telescoping, or detachable
17 stock means a stock that folds, telescopes, detaches or
18 otherwise operates to reduce the length, size, or any other
19 dimension, or otherwise enhances the concealability, of a
20 firearm.
21 (42) The term forward grip means a grip located
22 forward of the trigger that functions as a pistol grip.
23 (43) The term rocket means any simple or complex
24 tubelike device containing combustibles that on being ig-
25 nited liberate gases whose action propels the tube through

1 the air and has a propellant charge of not more than 4
2 ounces.
3 (44) The term grenade launcher or rocket launcher
4 means an attachment for use on a firearm that is designed
5 to propel a grenade, rocket, or other similar destructive
6 device.
7 (45) The term permanently inoperable means a
8 firearm which is incapable of discharging a shot by means
9 of an explosive and incapable of being readily restored to
10 a firing condition.
11 (46) The term pistol grip means a grip, a thumb-
12 hole stock, or any other characteristic that can function
13 as a grip.
14 (47) The term threaded barrel means a feature or
15 characteristic that is designed in such a manner to allow
16 for the attachment of a device such as a firearm silencer
17 or a flash suppressor.
18 (48) The term qualified law enforcement officer
19 has the meaning given the term in section 926B.
20 (49) The term grandfathered semiautomatic as-
21 sault weapon means any semiautomatic assault weapon
22 the importation, possession, sale, or transfer of which
23 would be unlawful under section 922(v) but for the excep-
24 tion under paragraph (2) of such section.

1 (50) The term belt-fed semiautomatic firearm
2 means any repeating firearm that
5 chamber the next round;
7 fire each cartridge; and
8 (C) has the capacity to accept a belt ammuni-
9 tion feeding device..
10 SEC. 3. RESTRICTIONS ON ASSAULT WEAPONS AND LARGE
11 CAPACITY AMMUNITION FEEDING DEVICES.
12 (a) IN GENERAL.Section 922 of title 18, United

13 States Code, is amended
14 (1) by inserting after subsection (u) the fol-
15 lowing:
16 (v)(1) It shall be unlawful for a person to import,
17 sell, manufacture, transfer, or possess, in or affecting
18 interstate or foreign commerce, a semiautomatic assault
19 weapon.
20 (2) Paragraph (1) shall not apply to the possession,
21 sale, or transfer of any semiautomatic assault weapon oth-
22 erwise lawfully possessed under Federal law on the date
23 of enactment of the Assault Weapons Ban of 2017.
24 (3) Paragraph (1) shall not apply to any firearm
25 that

1 (A) is manually operated by bolt, pump, lever,
2 or slide action;
3 (B) has been rendered permanently inoperable;
4 or
5 (C) is an antique firearm, as defined in section
6 921 of this title.
7 (4) Paragraph (1) shall not apply to
8 (A) the importation for, manufacture for, sale
9 to, transfer to, or possession by the United States
10 or a department or agency of the United States or
11 a State or a department, agency, or political subdivi-
12 sion of a State, or a sale or transfer to or possession
13 by a qualified law enforcement officer employed by
14 the United States or a department or agency of the
15 United States or a State or a department, agency,
16 or political subdivision of a State, for purposes of
17 law enforcement (whether on or off duty), or a sale
18 or transfer to or possession by a campus law en-
19 forcement officer for purposes of law enforcement
20 (whether on or off duty);
21 (B) the importation for, or sale or transfer to
22 a licensee under title I of the Atomic Energy Act of
23 1954 for purposes of establishing and maintaining
24 an on-site physical protection system and security
25 organization required by Federal law, or possession

1 by an employee or contractor of such licensee on-site
2 for such purposes or off-site for purposes of licensee-
3 authorized training or transportation of nuclear ma-
4 terials;
5 (C) the possession, by an individual who is re-
6 tired in good standing from service with a law en-
7 forcement agency and is not otherwise prohibited
8 from receiving a firearm, of a semiautomatic assault
9 weapon
10 (i) sold or transferred to the individual by
11 the agency upon such retirement; or
12 (ii) that the individual purchased, or oth-
13 erwise obtained, for official use before such re-
14 tirement;
15 (D) the importation, sale, manufacture, trans-
16 fer, or possession of a semiautomatic assault weapon
17 by a licensed manufacturer or licensed importer for
18 the purposes of testing or experimentation author-
19 ized by the Attorney General; or
20 (E) the importation, sale, manufacture, trans-
21 fer, or possession of a firearm specified in Appendix
22 A to this section, as such firearm was manufactured
23 on the date of introduction of the Assault Weapons
24 Ban of 2017.

1 (5) For purposes of paragraph (4)(A), the term
2 campus law enforcement officer means an individual who
3 is
4 (A) employed by a private institution of higher
5 education that is eligible for funding under title IV
6 of the Higher Education Act of 1965 (20 U.S.C.
7 1070 et seq.);
8 (B) responsible for the prevention or investiga-
9 tion of crime involving injury to persons or property,
10 including apprehension or detention of persons for
11 such crimes;
12 (C) authorized by Federal, State, or local law
13 to carry a firearm, execute search warrants, and
14 make arrests; and
15 (D) recognized, commissioned, or certified by
16 a government entity as a law enforcement officer.
17 (6) The Attorney General shall establish and main-
18 tain, in a timely manner, a record of the make, model,
19 and, if available, date of manufacture of any semiauto-
20 matic assault weapon which the Attorney General is made
21 aware has been used in relation to a crime under Federal
22 or State law, and the nature and circumstances of the
23 crime involved, including the outcome of relevant criminal
24 investigations and proceedings. The Attorney General
25 shall annually submit a copy of the record established

1 under this paragraph to the Congress and make the record
2 available to the general public.
3 (w)(1) It shall be unlawful for a person to import,
4 sell, manufacture, transfer, or possess, in or affecting
5 interstate or foreign commerce, a large capacity ammuni-
6 tion feeding device.
7 (2) Paragraph (1) shall not apply to the possession
8 of any large capacity ammunition feeding device otherwise
9 lawfully possessed on or before the date of enactment of
10 the Assault Weapons Ban of 2017.
11 (3) Paragraph (1) shall not apply to
12 (A) the importation for, manufacture for, sale
13 to, transfer to, or possession by the United States
14 or a department or agency of the United States or
15 a State or a department, agency, or political subdivi-
16 sion of a State, or a sale or transfer to or possession
17 by a qualified law enforcement officer employed by
18 the United States or a department or agency of the
19 United States or a State or a department, agency,
20 or political subdivision of a State for purposes of law
21 enforcement (whether on or off duty), or a sale or
22 transfer to or possession by a campus law enforce-
23 ment officer for purposes of law enforcement (wheth-
24 er on or off duty);

1 (B) the importation for, or sale or transfer to
2 a licensee under title I of the Atomic Energy Act of
3 1954 for purposes of establishing and maintaining
4 an on-site physical protection system and security
5 organization required by Federal law, or possession
6 by an employee or contractor of such licensee on-site
7 for such purposes or off-site for purposes of licensee-
8 authorized training or transportation of nuclear ma-

10 (C) the possession, by an individual who is re-

12 forcement agency and is not otherwise prohibited
13 from receiving ammunition, of a large capacity am-
14 munition feeding device
15 (i) sold or transferred to the individual by
16 the agency upon such retirement; or
17 (ii) that the individual purchased, or oth-
18 erwise obtained, for official use before such re-
19 tirement; or
20 (D) the importation, sale, manufacture, trans-
21 fer, or possession of any large capacity ammunition
22 feeding device by a licensed manufacturer or licensed
23 importer for the purposes of testing or experimen-
24 tation authorized by the Attorney General.

1 (4) For purposes of paragraph (3)(A), the term
2 campus law enforcement officer means an individual who
3 is
4 (A) employed by a private institution of higher
5 education that is eligible for funding under title IV
6 of the Higher Education Act of 1965 (20 U.S.C.
7 1070 et seq.);
8 (B) responsible for the prevention or investiga-
9 tion of crime involving injury to persons or property,
10 including apprehension or detention of persons for
11 such crimes;
12 (C) authorized by Federal, State, or local law
13 to carry a firearm, execute search warrants, and
14 make arrests; and
15 (D) recognized, commissioned, or certified by
16 a government entity as a law enforcement officer.;
17 and
18 (2) by adding at the end the following:
19 (aa) SECURE STORAGE OR SAFETY DEVICE RE-
20 QUIREMENT FOR GRANDFATHERED SEMIAUTOMATIC AS-
21 SAULT WEAPONS.It shall be unlawful for any person,
22 other than a licensed importer, licensed manufacturer, or
23 licensed dealer, to store or keep under the dominion or
24 control of that person any grandfathered semiautomatic
25 assault weapon that the person knows, or has reasonable

1 cause to believe, will be accessible to an individual prohib-
2 ited from receiving or possessing a firearm under sub-
3 section (g), (n), or (x), or any provision of State law, un-
4 less the grandfathered semiautomatic assault weapon is
5 (1) carried on the person, or within such close
6 proximity that the person can readily retrieve and
7 use the grandfathered semiautomatic assault weapon
8 as if the grandfathered semiautomatic assault weap-
9 on were carried on the person; or
10 (2) locked by a secure gun storage or safety
11 device that the prohibited individual has no ability to
12 access..
13 (b) IDENTIFICATION MARKINGS FOR SEMIAUTO-
14 MATIC ASSAULT WEAPONS.Section 923(i) of title 18,
15 United States Code, is amended by adding at the end the
16 following: The serial number of any semiautomatic as-
17 sault weapon manufactured after the date of enactment
18 of the Assault Weapons Ban of 2017 shall clearly show
19 the date on which the weapon was manufactured or made,
20 legibly and conspicuously engraved or cast on the weapon,
21 and such other identification as the Attorney General shall
22 by regulations prescribe..
23 (c) IDENTIFICATION MARKINGS FOR LARGE CAPAC-
24 ITY AMMUNITION FEEDING DEVICES.Section 923(i) of
25 title 18, United States Code, as amended by this Act, is

1 amended by adding at the end the following: A large ca-
2 pacity ammunition feeding device manufactured after the
3 date of enactment of the Assault Weapons Ban of 2017
4 shall be identified by a serial number and the date on
5 which the device was manufactured or made, legibly and
6 conspicuously engraved or cast on the device, and such
7 other identification as the Attorney General shall by regu-
8 lations prescribe..
9 (d) SEIZURE AND FORFEITURE OF LARGE CAPACITY
10 AMMUNITION FEEDING DEVICES.Subsection (d) of sec-
11 tion 924 of title 18, United States Code, is amended
12 (1) in paragraph (1)
13 (A) by inserting or large capacity ammu-
14 nition feeding device after firearm or ammu-
15 nition each time it appears;
16 (B) by inserting or large capacity ammu-
17 nition feeding device after firearms or ammu-
18 nition each time it appears; and
19 (C) by striking or (k) and inserting
20 (k), (r), (v), or (w);
22 (A) in subparagraph (C), by inserting or
23 large capacity ammunition feeding devices

8 is amended by striking or (q) of section 922 and insert-
9 ing (q), (r), (v), (w), or (aa) of section 922.
10 SEC. 5. BACKGROUND CHECKS FOR TRANSFERS OF GRAND-
11 FATHERED SEMIAUTOMATIC ASSAULT WEAP-
12 ONS.
13 (a) IN GENERAL.Section 922 of title 18, United

14 States Code, as amended by this Act, is amended
15 (1) by repealing subsection (s);
16 (2) by redesignating subsection (t) as sub-
17 section (s);
18 (3) in subsection (s), as redesignated
19 (A) in paragraph (3)(C)(ii), by striking
20 (as defined in subsection (s)(8)); and
21 (B) by adding at the end the following:
22 (7) In this subsection, the term chief law en-
23 forcement officer means the chief of police, the
24 sheriff, or an equivalent officer or the designee of
25 any such individual.; and

1 (4) by inserting after subsection (s), as redesig-
2 nated, the following:
3 (t)(1) Beginning on the date that is 90 days after
4 the date of enactment of the Assault Weapons Ban of
5 2017, it shall be unlawful for any person who is not li-
6 censed under this chapter to transfer a grandfathered
7 semiautomatic assault weapon to any other person who is
8 not licensed under this chapter, unless a licensed importer,
9 licensed manufacturer, or licensed dealer has first taken
10 custody of the grandfathered semiautomatic assault weap-
11 on for the purpose of complying with subsection (s). Upon
12 taking custody of the grandfathered semiautomatic assault
13 weapon, the licensee shall comply with all requirements of
14 this chapter as if the licensee were transferring the grand-
15 fathered semiautomatic assault weapon from the licensees
16 inventory to the unlicensed transferee.
17 (2) Paragraph (1) shall not apply to a temporary
18 transfer of possession for the purpose of participating in
19 target shooting in a licensed target facility or established
20 range if
21 (A) the grandfathered semiautomatic assault
22 weapon is, at all times, kept within the premises of
23 the target facility or range; and

1 (B) the transferee is not known to be prohib-
2 ited from possessing or receiving a grandfathered
3 semiautomatic assault weapon.
4 (3) For purposes of this subsection, the term trans-
5 fer
6 (A) shall include a sale, gift, or loan; and
7 (B) does not include temporary custody of the
8 grandfathered semiautomatic assault weapon for
9 purposes of examination or evaluation by a prospec-
10 tive transferee.
11 (4)(A) Notwithstanding any other provision of this
12 chapter, the Attorney General may implement this sub-
13 section with regulations.
14 (B) Regulations promulgated under this para-
15 graph
16 (i) shall include a provision setting a max-
17 imum fee that may be charged by licensees for serv-
18 ices provided in accordance with paragraph (1); and
19 (ii) shall not include any provision imposing
20 recordkeeping requirements on any unlicensed trans-
21 feror or requiring licensees to facilitate transfers in
22 accordance with paragraph (1)..
23 (b) TECHNICAL AND CONFORMING AMENDMENTS.
24 (1) SECTION 922.Section 922(y)(2) of title
25 18, United States Code, is amended, in the matter

1 preceding subparagraph (A), by striking ,
2 (g)(5)(B), and (s)(3)(B)(v)(II) and inserting and
3 (g)(5)(B).
4 (2) SECTION 925A.Section 925A of title 18,
5 United States Code, is amended, in the matter pre-
6 ceding paragraph (1), by striking subsection (s) or
7 (t) of section 922 and inserting section 922(s).
8 (c) EFFECTIVE DATE.The amendments made by
9 this section shall take effect 90 days after the date of en-
10 actment of this Act.
11 SEC. 6. USE OF BYRNE GRANTS FOR BUY-BACK PROGRAMS
12 FOR SEMIAUTOMATIC ASSAULT WEAPONS
13 AND LARGE CAPACITY AMMUNITION FEED-
14 ING DEVICES.
15 Section 501(a)(1) of the Omnibus Crime Control and

16 Safe Streets Act of 1968 (42 U.S.C. 3751(a)(1)) is
17 amended by adding at the end the following:
18 (H) Compensation for surrendered semi-
19 automatic assault weapons and large capacity
20 ammunition feeding devices, as those terms are
21 defined in section 921 of title 18, United States
22 Code, under buy-back programs for semiauto-
23 matic assault weapons and large capacity am-
24 munition feeding devices..

1 SEC. 7. SEVERABILITY.
2 If any provision of this Act, an amendment made by

3 this Act, or the application of such provision or amend-
4 ment to any person or circumstance is held to be unconsti-
5 tutional, the remainder of this Act, the amendments made
6 by this Act, and the application of such provision or
7 amendment to any person or circumstance shall not be af-
8 fected thereby.
