8. Complaint given by the Complainant/Informant:


I live in village Betma, and I am a labourer. On 19/6/2013 I went to work
and returned home at about 3.00 pm. After about half an hour my
maternal aunt Phool Rani informed me that accused Pawan Gond and
Virendra Gond were beating my father. Then I went to the spot and saw
that Pawan and Virendra were beating my father from their legs and fists.
I did not go near to them as I thought that if I also go there, they will beat
me. When the accused persons left, I went there and saw that my father is
dead. For the last three years Pawans father has been ill. He used to say
that my father Kesh Lal has done some Jadutona on him. About 2 days
back Pawans father died. On the above suspicion the accused persons
have murdered my father .

7. Opinion and signature of police officer who obtained panchanama


with date:

Today on 20/6/2013, I Inspector A.P.Singh with panchas examined the


dead body of Kesh Lal Gond and found as under:
The dead body is on stretcher of Medical College, the head is on east and
legs are on west side. The body is identified by the son of deceased
Bishan Singh Gond who stated that it is the body of Kesh Lal Gond, his
father. There is no visible external injury on head but there are marks of

internal injury. Both eyes are closed, mouth closed, Blood is oozing from
right ear, left ear is normal. There are marks of internal injury and
swelling on right ribs. Marks of internal injury on right hand , Photograph
of the body was taken .

The body was despatched to Medical College and copy of this
Panchanama is sent to the Magistrate concerned.

POST MORTEM REPORT

P.M. No.: 106/2013 Date: 20/06/2013

Name: Kesh Lal

Age 50 years Sex: Male Resident of village Betma

Date and time of Post mortem: 20/6/2013 at 11.55 am.

Findings: Dead body of an average built adult male, of aged


about 50 years, eyes and mouth are closed, body is cold, rigor
mortis is present, bleeding from both ears , wearing underwear
and baniyan. Baniyan is torn from various places.

Injuries:-
1. Multiple redish- grey abrasions present over forehead in an
area ranging from 7 cm x 6 cm in size to 3 cm x 4 cm
2. Internal examination :-
Extravasated blood present over left perieto-temporal region,
brain was edemous and pale,
About 3.5 litres of blood was present over anterior side chest
wall in muscles and soft tissues, multiple ribs were fractured
at multiple places.Otherwise, healthy body. bBth lungs are
lacerated at multiple places with extravasated blood.

Time since death: within one day

Cause of death:-Haemorrhagic shock as a result of


antimortem injury to chest produced by blunt force impact.

Bishan Gond

Bishan Gond s/o Late Kesh Lal Gond, aged, 28 years,


occupation labourer, resident of village Betma has stated in his
statement that:
On 19/6/2013 I had gone on work and returned to home at
about 4.00 pm. After about an hour my wifes brothers wife
Sukhiya informed me that accused Pawan Gond and Virendra
Gond are beating my father. Then I went to inform the Sarpanch
but he was not in the home so I proceeded to spot and saw that
Pawan and Virendra are beating my father from their legs, fists
and stones. I did not go near them as I thought that if I also go
there, they will also beat me. I hid behind a bush. When the
accused persons left, I went there and saw that my father is
dead. From last two years Pawans father was ill. He used to say
that my father Kesh Lal has done some Jadu tona on him.
About 3-4 days back Pawans father has died. On the above
suspicion the accused persons have murdered my father from
their fists, legs and stones.

Sukhiya
I Sukhiya w/o Prahlad, aged 37 years occupation: labourer, resident of
village Betma Distt Damoh

At the time of incident I had gone towards the spot to search for my cow.
There by I had seen that the accused Pawan Gond and Virendra Gond
were beating Kesh Lal by leg and fists. I got scared and ran away from
the spot. I narrated the incident to Bishan, the son of deceased Kesh Lal
and thereafter proceeded towards my village. Thereafter I came to know
that Kesh Lal died.

I Phool Rani, aged 37 years occupation: labourer, resident of village


Betma, Distt Damoh
At the time of incident I had gone towards the spot to search for my
animals. There I saw that the accused .were beating Kesh Lal by leg
and fists. I became afraid and ran away from the spot. I narrated the
incident to Bishan, the son of the deceased, Kesh Lal and thereafter
proceeded towards my village. Thereafter I came to know that Kesh Lal
died. I dont know how he died.

Suman Bai w/o Bishan Gond s/o , aged, 31 years, occupation labourer,
resident of village Betma has stated in his statement that:

On 19/6/2013 I was at my home at about 5.00 pm. Kesh Lal is my father


in law. He had gone to another village. I had seen that Pawan and
Virendra Gond are beating my father-in-law by fists , legs and lathi. Then
with my husband Bishan Gond, I went to Thana Gondia. In Thana Gondia
I came to know that my father-in-law was dead. I do not know why they
have beaten my father-in law.

13. Particulars of the incident in short


The facts of the case in short are that on 19/06/2013 the complainant
Bishan Gond, aged 28 years, Resident of Betma came to Thana Gondia
and informed that on the said date, place and time the accused persons
Pawan Gond and Virendra Gond were saying by way of Jadu tona his
father has been killed and by beating his father Kesh Lal Gond by legs
and fists had killed him. On his report offence crime no 195/13 u/s 302/34
of IPC was registered., Panchayatnama was prepared, post mortem of
dead body was done, statements of witnesses u/s 161 of crpc were
recorded, spot map was prepared. On the basis of the material gathered
during investigation accused persons Pawan Gond and Virendra Gond
were arrested and sent to judicial custody. After completion of
investigation it was found that the above mentioned accused persons have
committed the alleged offence, hence this challan is being filed.

Case in Brief.: On 19/06/2013 accused persons have murdered
Kesh Lal Gond under the suspicion that he did Jadu-tona on
their father who has expired some days back.
Copies of challan have been given to accused.
The accused persons are in judicial custody.
Since the offence is u/s 302 /34 of IPC, it is exclusively triable
by the Court of Sesssion, and the accused persons are committed
for trial.
Notice of committal has been given to Public Prosecutor.
The Jailor Central Jail has been ordered to produce the accused
persons before the Sessions Court on next date.

I, Sajal Awasthi Sessions Judge, Damoh charge you Pawan Gond s/o late
Narendra Singh Gond, resident of village Betma as under:-

That you on or about 19/06/2013 at 6.00 p.m. at village Betma District


Damoh (Madhya Pradesh) along with co accused Virendra Gond in
furtherance of your common intention committed murder by causing the
death of Kesh Lal Gond and thereby have committed an offence
punishable u/s 302 read with s. 34 of Indian Penal Code, 1860 and within
the cognizance of my Court.

I hereby direct that you be tried by this court on the said charge.

DEFENCE WITNESS 1
Panji Gond

I Panji Gond , aged about 35 years, occupation: farmer state as under

That on 04/06/2013, at about 5.00 pm when I was returning from my field


on my motor cycle, Kesh Lal asked for a lift. Since I had to go for an
urgent work in another village, I refused. Kesh Lal became angry and
started abusing me. When I objected, he started quarrelling with me,
thinking that he is Purohit of Gond Adivasis. I did not complaint to
anybody but instead Kesh Lal lodged a false report against me that I had
abused, assaulted and threatened of dire consequences. A criminal case is
also pending against me on the above report u/s 294,323 and 506 B of
IPC in the Court of Chief Judicial Magistrate Damoh.
Pawan Gond and Virendra Gond are my near relatives. Kesh Lal used to
do jadu-tona. Due to this a large number of villagers were angry with
him. Kesh Lal was beaten by some other persons of the village, but his
son Bishan Gond, due to previous enmity with me has falsely involved
them. Pawan and Virendra at the time of Kesh Lals death had gone to
Mandla, to attend their maternal uncles last ceremony rites, who has
recently expired. They are innocent.

DEFENCE WITNESS 2
RAMU GOND

I Ramu Gond, aged about 25 years, occupation: Mistri, resident of


Mandala state as under:
That my father died due to Malaria on 13/06/1993. Pawan Gond and
Virendra Gond are my cousin brothers. On 19/06/2013, there was at my
home for the last ceremonial rites of my fathers death. In which Pawan
Gond and Virendra Gond were invited and they reached here from
Damoh to Mandla by bus at 10.00 am in the morning and attended the
puja. They stayed in the night with us at Mandla and returned back next
morning to their village.
When I heard about their arrest in the case, I went to thana and requested
the Thanedar that they are innocent and they were with us on that date.
But being poor our voice was not heard. Pawan and Virendra are falsely
implicated in the case due to enmity.
