Sides differ over school district finances
Teachers seek pay raises while officials illustrate bleak budget forecast

San Mateo-Foster City Elementary
School District teachers and parents contin-
ued to rally for higher wages while officials
laid out a bleak financial forecast showing
limited capacity to offer raises.
The two sides made their cases Thursday,
Nov. 16, during different portions of the
district Board of Trustees meeting which
hosted a flood of educators and school com-
munity members frustrated with perceived
inadequate teacher salaries.
The meeting served as the latest clash
between teachers who are growing increas-
ingly aggravated with frozen contract talks
and officials who claim inadequate funds
exist to grant the pay increases.
Samantha Gallegos, a Burlingame teacher
with children in the San Mateo-Foster City
Elementary School District, urged officials
to grant the raises sought in an effort to
avoid the potential strike threat looming
over negotiations.
I hope this is settled sooner rather than
later, she said. Our children are depending
on it.
Gallegos was one of nearly 10 teachers
and school community members who shared
their concerns about the ongoing contract
deadlock during the meeting. The two sides
recently announced they moved from unsuc-
cessful mediated discussions to fact finding,
which often can be the final phase before a
labor stoppage.

on the meeting agenda, but officials did lay
out a dire financial projection during a later
budget discussion.

Carolyn Chow suggests the district is expe-
riencing nearly a $10 million budget deficit
currently, with that shortfall to shrink to
nearly $3 million next year and the follow-
ing.

by Christmas, even as a nonpartisan tax

Coast Guard calls off
search for missing boater
The U.S. Coast Guard called off its search
Monday for a boater who went missing
south of Pillar Point Harbor in San Mateo
County on Sunday.
A 17-foot vessel was reported spinning
out of control about 8 miles south of the
harbor around noon Sunday.
One man, identified by the San Mateo
County Coroners Office as 74-year-old
Fremont resident Dung Duc Nguyen, was
found dead in the area of the boat. A second
man, Tuan Tom Tran, was also believed to
be on board but crews did not find him.
The boat was eventually recovered after it
stopped spinning.
A search for Tran continued overnight and
Monday morning before being suspended as
of midday, according to the Coast Guard.

Katz was spotted by a California Highway
Patrol officer driving the wrong way onto
southbound Highway 101. He then crashed
head-on into a Ford Escape taxi that had a

driver and two passengers inside, prosecu-
tors said.
One of the passengers, Pedro Soldevilla,
62, of Puerto Rico, was ejected and died at
the scene. The other passenger was also
ejected and suffered major injuries, while
the driver suffered a broken foot, prosecu-
tors said.
Katz was trapped in his car but was even-
tually extricated and a test at the hospital a
couple of hours later found he had a blood-
alcohol content of 0.13, according to the
District Attorneys Office.
The case was delayed for two years over
appeals regarding whether the blood test
was admissible in court, with defense attor-
ney Geoff Carr arguing that Katz did not
receive any admonition regarding his right
to refuse the test without a warrant.
Carr also argued that a U.S. Supreme Court
ruling in 2016 changed the controlling law
regarding warrant-less blood tests in DUI
cases. The state appeals court disagreed,
allowing the blood test evidence to be pre-
sented in the trial.
San Mateo County Superior Court Judge
Leland Davis remanded Katz into custody
Friday after he had been out on $250,000
bail.
He will return to court on Jan. 5 for sen-
tencing and faces up to 16 years and eight
months in prison, according to Carr.
The defense attorney said he will be filing
post-trial motions in the case, likely
including a request for a new trial.

August pleaded no contest Monday to resi-
dential burglary, according to the San

Aug. 7 with two 15-year-old males, prompt-
ing the neighbor who spotted them to call
police. Another resident noticed the males
near her neighbors home and jotted down
the license plate number of a car in which
they left, according to police.
After the crime, police contacted other
law enforcement agencies and saturated the
area looking for the suspects. The Santa
Clara County Sheriffs Office later stopped
the vehicle and found Brewster and the two
juveniles, also San Jose residents. The wit-
nesses positively identified the suspects

District Attorney Steve Wagstaffe said the
cases for Brewsters accomplices went
through juvenile hall while Brewster, who
posted $50,000 bail Sept. 8, will likely
serve just under eight months in county jail
since he will receive 68 days credit for time

Brewster will next appear in court Jan. 3
for receipt of a restitution report and is
expected to start his jail sentence Jan. 20,
according to prosecutors.

warn of phone scam
Police are urging residents in Redwood
City to be cautious of a phone scam in the
area.
According to police, residents have fallen
victim to several of the phone scams.
The scams involve a suspect who calls a
victim to request money for a loved one
who was in an accident. Other scams
involve suspects who threaten harm,
police said.
Anyone who receives similar calls is
asked to report them to Redwood City

NEW YORK Charlie Rose is the latest
public figure to be felled by sexual miscon-
duct allegations, with PBS halting distribu-
tion of his nightly interview show and CBS
News suspending him Monday following a
Washington Post report with the accusa-
tions of eight women.
The women, who all worked for Rose or
tried to work for him, accused the veteran
newsman of groping them, walking naked
in front of them and telling one that he
dreamed about her swimming nude.
Rose, 75, said in a statement that he was
deeply embarrassed and apologized for
his behavior.

improper conduct, saying he put his hand on
her bottom as they posed for a picture at the
Minnesota State Fair in 2010 after he had
begun his career in the Senate.
Lindsay Menz told CNN last week for a
report broadcast Monday that the interac-
tion made her feel gross. She said she
immediately told her husband that Franken
had grabbed her bottom, and she said she
posted about it on Facebook.
Menzs allegation comes days after a Los

Mugabe ignores calls to quit, faces impeachment

mobilized Monday for a major push to oust
President Robert Mugabe, an increasingly
isolated figure who faces impeachment pro-
ceedings and more street demonstrations
even as he ignores calls to resign.
While there is a widespread consensus that
the 93-year-old president should step down
after nearly four decades in power, Mugabe
has refused. The country has known no other
leader since independence from white minor-
ity rule in 1980.
The conflicted role of the military, widely
hailed as a savior after effectively stripping
Mugabe of his authority last week, is under
scrutiny after its generals flanked him during
a televised address Sunday night in which he
asserted that he remained the commander in
chief and referred to our well-cherished
constitutional order.
The generals have been involved in talks
with him on a way out of the leadership cri-
sis. While they acted outside his authority by
sending tanks into the streets, they also pro-
jected deference in sitting by at the official
residence, State House, as Mugabe told the
nation he was still in charge.
Although Mugabes powers as a wily, ruth-
less tactician have faded with age, his

tional attacks beyond the assassina-

Trump said the designation as a
state sponsor of terror was long over-
due, and he promised a new wave of
sanctions as part of a maximum
pressure campaign over North
Koreas development of nuclear
weapons that could soon pose a direct
threat to the U.S. mainland.
North Korea will join Iran, Sudan
and Syria on the blacklist. The North
had been designated for two decades
until 2008 when it was removed in a
bid to salvage international talks
aimed at halting its nuclear efforts.
The talks collapsed soon after and
havent been revived since.
Secretary of State Rex Tillerson
said the designation was a very sym-
bolic move with limited practical
effects although it could close a few
loopholes in a tough sanctions
regime that was starting to bite in
Pyongyang. He said anecdotal evi-
dence and intelligence suggests the
North is suffering fuel shortages,
with queues at gas station, and its
revenues are down.
Still, Tillerson also acknowledged
a two-month pause in the Norths
rapid tempo of nuclear and missile
tests and said there was still hope for
diplomacy. With tougher sanctions
in the offing, he warned North Korean
leader Kim Jong Un, This is only
going to get worse until youre ready
to come and talk.
The designation is likely to exacer-
bate sour relations between
Washington and Pyongyang that
have turned uglier with name-calling
between Trump and Kim. There was
strong bipartisan support for the
move in Congress, which had passed
legislation in August requiring the
State Department to make a determi-
nation on the issue.

loosened limits on lion trophies
WASHINGTON One month before the Trump adminis-
tration sparked outrage by reversing a ban on trophies from
threatened African elephants, federal officials quietly loos-
ened restrictions on the importation of heads and hides of
lions shot for sport.
The U.S. Fish and Wildlife Service began issuing permits
Oct. 20 for lions killed in Zimbabwe and Zambia between
2016 and 2018. The agency is also currently studying
whether to add three additional countries to the list
Mozambique, Namibia and Tanzania.
Previously, only wild lions killed in South Africa were
eligible to be imported.
In a pair of recent tweets, President Donald Trump said he
will delay the new policy on allowing elephant trophies,
but he made no mention of lions. Trump, whose adult sons
are avid big-game hunters, also expressed skepticism about
his own administrations claim that killing threatened ani-
mals could help save them by helping raise money for con-
servation programs.
Big-game trophy decision will be announced next week
but will be very hard pressed to change my mind that this
horror show in any way helps conservation of Elephants or
any other animal, the president tweeted on Sunday.

Repeal of Costa-Hawkins essential to our communities The power of harmony

Madison mentioned the nega-
tive impacts of repealing the
Costa-Hawkins provisions in
California law. For those not fully
briefed, Costa-Hawkins prohibits any
sort of rent control of properties built
after 1995, as well as any single-fam-
ily structure or condominium of any
age.
It is important to look at the prob-
lem from the point of view of protect-
ing the enormous portion of our pop-
ulation who happen to be tenants
from rent gouging and arbitrary evic-
tions for those whose leases have
expired. Is there social value in pro-
tecting long-term tenants in our com-
munity? What about tenants with
children in the midst of the school
year? How about anyone who has
spent cash and sweat in moving their
worldly goods into an apartment and
dont relish having to do it all over
again at someone elses whim?
When you live in rented housing
you naturally have to be part of some-
one elses business model unless its
municipal or subsidized housing.
Unfortunately, we have severely dis-
torted markets where enormous
demand far outstrips supply. Aside
from trying to regulate building den-
sity and providing better transporta-
tion to enable folks to get from their
housing to their jobs, we need to look
at the proteering of those who have
units to rent and the inability of long-
time, elderly or just plain normal
folks who cant simply write bigger
checks to enable lucky landlords to
reap their windfalls.
Here is where we look at stepping
in to level the playing eld a bit.

life changed 25 years ago after a
drunken driver hit me. I was 16 then. I
urge all to have a sober driver if they
plan on drinking, and people some
are listening. Thank you.

safe and sober drivers on the roads.
A new threat is quickly taking the
place of drunk driving: cellphones. I
see people on them everywhere; in
stores, restaurants and even vehicles.
Drivers of all ages are distracted in
numerous ways, but cellphone usage
takes the cake.
Driving with a cellphone is like
driving drunk, if not worse. Who
wants to drive a vehicle and not pay
attention to the road just to text a

That means folks
with children in
school and roots in
a neighborhood
have absolutely no
right to remain in their home regard-
less of their willingness to pay. Most
people would say no. Again, in a mar-
ket in balance there would be no moti-
vation for a landlord to lose a paying
tenant if they had to then try to nd
another one for similar rent. This is
not the case in our distorted situation.
Renters are lining up to nd homes in
our area.
Critics say they have property
rights that should enable them to do
as they wish and charge what the mar-
ket will bear. Nice try. Anyone who
owns property has many responsibil-
ities that go with living in society.
They cant build a reworks factory
next to a school. Thats an infringe-
ment of their property rights to which
most folks would agree. What about
telling them how much prot they can
expect from their investment? We
look at the situation of some drug
companies that charge whatever they
can with no oversight. Most people
arent happy with that situation, as
no free market is available to counter
their unlimited greed. Not a happy
place for a society that likes to have
healthy people.
Another observation by critics of
control is that no one will build rental
housing in the future, certainly not
affordable housing. If a reasonable
return was assured with a just rental
rate escalator, why would the market
then shrivel up? The climate is still
petty message? Is this distraction
worth the risk of injuring or killing
others?
People travel on roads and high-
ways in beautiful California for the
upcoming holidays. Drivers need to
place undivided attention on the road
for safety. Navigating or texting on
the phone prevents them from that.
Using the phone for just ve sec-
onds is similar to driving the length
of a football eld at 55 mph blind-
folded. Clearly, that is irresponsible
and unsafe.
Please stop your vehicle when
using the phone and do not drive
drunk. This brings more safety to the
roads every day.

So now were back to deciding how
to regulate our society for the general
good. Reasonable provisions for
rents to reect the cost of doing busi-
ness in a particular location has to
gure into any formula; however, no
one should have to live at the whim
of their landlord. Only a just cause
should be grounds for non-renewal of
a lease or eviction. We recently had
an effort with measures Q, R and C to
nd a reasonable approach to these
issues. While they may not have been
perfect, they would have helped to
stabilize our communities without
any severe effects on our landlord
population, as home values keep sky-
rocketing and the desirability of liv-
ing here just increases. Unfortunately,
huge money bombs and ash mobs
were dropped on these communities
by nationwide organizations to defeat
any effort to moderate the distorted
and arbitrary rent-gouging situation.
Repealing Costa-Hawkins would be
a good place to start so communities
can look at stabilizing the rental situ-
ation for their populations which, in
many cases, is about half their resi-
dents. Not a small number. Landlords
number far fewer but still need to be
considered if we are to be just and rea-
sonable. A statewide rental regulation
protocol would be the best way for-
ward.

other instruments such as a saxophone, a trumpet, a gui-
tar or a drum. Remove just one of an instruments major
components and it will no longer possess the capacity
to create beautiful music, and may very well produce a
sound of great discord. Likewise, if a composer plays an
instrument with disregard or lack of skill, the sound
produced is likely to be subpar
at best.
I learned this lesson early in
my childhood as I took piano
lessons to prepare for a church
recital. In my first lesson, I
quickly realized how poorly
the instrument sounded as I
banged on the keys with my
untrained hands. Believe me,
my teacher and parents were
just as annoyed as I was to hear
the sounds of an instrument

without talent or skill.
Nevertheless, with time and effort, I learned to play
the piano in a way that produced a resonating harmony.
By the time my recital came along, I had learned to play
the keys with a pace, depth and rhythm that captivated
the audience just enough to disregard the subtle mistakes
I made.
I reflect on that experience when I consider the forces
that comprise our vast universe. Like the hundreds of
requisite components for the piano to produce a harmo-
nious sound, scientists believe that more than 200
known conditions must exist for a planet to support
life. Take away just one of those conditions and life on
that planet cannot exist. Nevertheless, human life has
continued to survive and regenerate throughout the test
of time.
I consider these factors an orchestra of instruments
that, together, produce the world we inhabit. From the
oxygen we breath to the rhythmic drum beat of our
hearts producing blood through our veins, each of us are
instruments of our universe.
World-renowned theoretical physicists such as Michio
Kaku suggest that our universe is comprised of a sym-
phony of vibrating strings. Kaku suggests that the laws
of harmony govern both physics and chemistry, which
are melodies of vibrating strings. Moreover, Kaku
believes that you and I are cosmic music orchestrated
on vibrating strings.
Kaku is certainly not the first scientist to suggest that
our universe is a vibrant symphony. Albert Einstein
once said that his single greatest reason for believing
in Gods existence was the cosmic harmony, order and
beauty commanding the laws of our vast universe.
Einstein recognized that the cosmos certainly could
have been chaotic and volatile, thus negating the possi-
bility of our very existence. To Einstein, this evidenced
a divine presence within our vast universe.
Some physicists see the same harmony evidenced in
the constructal law, a scientific principle fathered by
experimental physicist Adrian Bejan. According to this
principle, every living thing manifests through the best
possible channels for the greatest flow of energy.
Likewise, harmony is nothing more than the manifesta-
tion of vibrations through proper channels.
The greatest vibrations on planet Earth flow through-
out each and every one of us. We know this because our
very existence is merely borrowed from the vast compo-
nents of the universe. That is why scientists confirm
that our own actions often dictate the health of our
physical bodies. Positive thinking and speaking has
the capacity to create harmony in the physical vibra-
tions in our bodies, enabling a healthier existence. By
contrast, negative thoughts triggered by fear, stress and
anger often produce volatile vibrations in the body, cre-
ating conditions for immune deficiencies and disease in
both the mind and body.
Perhaps our existence should follow the laws of cos-
mic harmony. Let us embrace our temporary existence
with a peaceful means and appreciation. Let us acknowl-
edge our interdependence not only on nature, but on one
another. History tells us that humanity fails time and
again to find peace and harmony in our existence, but
that certainly should never stop us from trying. Let us
remember that we are instruments of our universe, and
should value our short time here on Earth as such.

Miles Conrad has had an up-and-down var-
sity career. So, weathering an up-and-down
game is just a day in the life of Menlo-
Athertons senior quarterback.
Even under the white, hot spotlight of last

Benito, Conrad didnt let a dicey first quarter
get him down. The senior threw two inter-
ceptions through the opening period, but
bounced back to lead the Bears to a 37-21
comeback victory.
I was really excited for [the game],
Conrad said, because we played San Benito
two years ago in CCS and we ended up
losing that game, and I got injured in the
fourth quarter. So I wanted revenge. And if
we lost, this could have been my last foot-
ball game ever.
Conrad exacted his vengeance with an
inspired performance, chewing up yards all
night long. He accounted for 421 of M-As
544 total yards of offense, passing at a 13-
for-21 clip for 357 yards and four touch-
downs; he also rushed three times for 64
yards. Such totals alone have earned him
Daily Journal Athlete of the Week honors.
But it wasnt just the numbers that
impressed. It was the way he manufactured
them. With M-A facing a 21-14 deficit going
into the fourth quarter, Conrad marched his
squad to 23 unanswered points over the final
12 minutes.
He was on fire in the fourth quarter, M-A
head coach Adhir Ravipati said.
Conrad knows a thing or two about come-
backs. As a sophomore in 2015, he served
as the starting varsity quarterback. But, last
year, he was passed over when eventual

Of the nine county teams that qualied,
seven came out victorious: Aragon, Half
Moon Bay, Hillsdale, Menlo-Atherton,
Menlo School, Serra and Terra Nova. The
only two losses Burlingame and
Jefferson came at the hands of other
PAL teams.
For the PAL, it is certainly a feather in
the cap.
This game speaks to the strength of our
league, to have four Bay teams (Aragon,
Half Moon Bay, M-A and Terra Nova) in
the Open semis,

The seven wins
were by an average
score of 36-14,

Division V and so far hes turned out to
be correct. Last year, the rst using the
tiered Open Division, the PAL had three
of the four teams in the Division V semi-

with a 25-yard reception from Luke Bottari
midway through the first quarter Saturday,
Villaroman earned his 92nd career reception,
officially breaking the previous mark set by
Lynn Swann in the late 1960s.

EUGENE, Ore. Center Bol Bol, son of the late Manute
Bol, has signed a letter of intent to play at Oregon.
Bol is considered a five-star recruit and is the highest-
ranked prospect ever signed by the Ducks. The nearly 7-foot-
2 Bol announced his decision on the Players Tribune website.
Bol selected Oregon over Kentucky. He said he had thought
about his father in recent days as he was
making the decision. Manute Bol was a 7-
foot-7 center who played 12 seasons in the
NBA. He passed away in 2010.

line, Ravipati said he thought the
Bears could wear down a San Benito
team that relies on mostly two-way
linemen. But, also, Conrad has proven
more effective when working at a faster
tempo, something he showed in M-As
regular-season finale against Aragon.
Despite a 21-18 loss to the Dons,
the Bears brought a lot of pressure
inside the final two minutes of each the
first half, and the game. In the no-hud-
dle offense at the end of the first half,
he went 4 for 4 passing including a 31-
yard touchdown chuck. At the end of
the game, working at an even more
furious tempo, he connected on his
final four passes, including a 48-yard
scoring strike.
I definitely think I perform better
when were moving the ball faster,
Conrad said. When we go slow, I
think I think too much. If were
moving fast I dont have time to think.

Despite the early turnovers, the up-
tempo offense served Conrad well from

running back, sticking his free arm
straight into the helmet of a would-be tack-
ler. And when done effectively, it can be
downright demoralizing for the defender.
I saw a number of sick stiff arms this past
weekend. It started with Hillsdale running
back Nick Hulman during Fridays nights
win over Sobrato. Hulman, who rushed for
173 yards and three of the four Knights
touchdowns, fended off a Bulldog with his
right arm. The tackler tried to go up high
on Hulman, but he stuck that arm right to
the crown of the defenders helmet, eventu-
ally sending the defender airborne and leav-
ing him in his wake.
Saturday, Aragons Camron Grant and
Paul Lautaimi both planted Westmont play-
ers in the turf. First it was the human bat-
tering ram who is Grant. His left arm
looked more like a boxers jab as he quick-
ly thrust it, again, to the crown of the
defenders helmet and simply drove him
into the ground before leveling his pads
and bowling over two more Warriors.
Grant also showed that the stiff arm can
work on defense as well. Late in the rst
I knew once I got to the ball I just had a
feeling, Marquez said.
As a senior at El Camino in 2016-17,
Marquez earned Peninsula Athletic League
Ocean Division Forward of the Year honors,
and has been in the regular rotation for the
Trojans, though he lost his starting spot mid-
way through the season. He entered
Saturdays playoff opener with three goals
and one assist on the year.
Weve played so many different systems
and have different formations weve asked our
players to play, Saucedo said. And its
taken him awhile to learn different positions
but hes adjusted well and hes playing well.
Hes really figuring it out so Im really
happy for him.

The best play I saw all weekend came
courtesy of Grant in the Dons 41-23 win
over Westmont. Midway though the third
quarter, the Warriors ran a sweep toward the
left, sending a double-team of offensive
linemen at the Aragon defensive end.
Initially driven backward, Grant eventu-
ally shed both lineman and tackled the ball
carrier for a 4-yard loss.

The magic playoff moment would not have

(Marshall-SF), who headed it to the back post

We havent scored a ton of goals (this sea-
son) but weve scored some big goals on set
pieces, corners included, Saucedo said. I felt
it was coming. We had the momentum in our

Chaika couldnt gure out what was going

SEATTLE Matt Ryan and the Atlanta
Falcons did enough through 3 1/2 quarters
that even the best comeback attempt by
Russell Wilson fell short this time.
A couple of yards short to be exact.
Ryan threw a pair of touchdown passes,
Adrian Clayborn returned a fumble 10 yards
for a score and the Falcons watched Blair
Walshs 52-yard field goal attempt in the final
seconds fall short, holding off the Seattle
Seahawks for a 34-31 win on Monday night.
Atlanta won its second straight to stay on
the heels of New Orleans and Carolina in the
NFC South, and handed Seattle a second con-
secutive home loss.
What an absolute team win from the guys
tonight, Atlanta coach Dan Quinn said.
Coming here, in this environment, with the
crowd, we thought it would be two competi-
tive, tough teams that were going to battle for
it in the biggest way.
Ryan threw TDs to Mohamed Sanu and
Levine Toilolo, while Tevin Coleman added
a 1-yard TD run on Atlantas opening pos-
session.
But it was Clayborns fumble return that
helped break the game open early in the sec-
ond quarter and gave Atlanta a 21-7 lead. He
scooped up a loose ball after Wilson was
crunched by Takk McKinley and Courtney
Upshaw.
I think were moving in the right direc-
tion. We keep proving we can finish games
and beat guys. We have to take the momentum
and keep rolling with it, Clayborn said.
With Seattle down 11 points, Wilson hit
Doug Baldwin on a 29-yard TD with 3 min-
utes left and then threw to Jimmy Graham
for the two-point conversion. Seattle got
the ball back and moved in range for Walsh,
whose attempt was on line but landed short
of the crossbar.
Wilson again was the entirety of Seattles
offense, throwing for 258 yards and two
touchdowns, and running for another 86 yards
and a TD.
But it was an awful night for the Seahawks,
filled with more injuries and questionable
decisions by coach Pete Carroll. He called for
a fake field goal late in the first half rather
than attempting a 35-yard kick. He also made
a questionable challenge in the fourth quarter
that didnt go his way and left Seattle with just
one timeout.
That lack of timeouts came back to haunt
Seattle on the final drive when seconds ticked
away and rather than running one more play,
Walsh was sent out to attempt the 52-yard
kick. His long for the season is 49 yards.
The conclusion only amplified Carrolls
baffling decision at the end of the first half,
when Seattle ran a fake field goal rather than
having Walsh attempt a 35-yarder that would
have pulled Seattle within 24-20. Holder Jon
Ryan completed his shovel pass to Luke
Willson, but Grady Jarrett read the play and
tackled Willson for a 4-yard loss.

Health nominee Alex Azar reaped big

earnings from drug industry tenure

WASHINGTON Newly disclosed
financial records show that President
Donald Trumps nominee to become
Health and Human Services secretary
reaped big earnings during his tenure as a
top pharmaceutical executive.
As a top drug industry veteran from 2007
to 2017, former Eli Lilly and Co. execu-
tive Alex Azar built a substantial financial
portfolio now worth $9. 5 million to
$20.6 million, and he was paid nearly $2
million in his final year at the company.
Azar was a former general counsel and
deputy secretary at HHS during President
George W. Bushs administration. If con-
firmed, he would replace Tom Price, who
resigned under pressure after using private
charter flights at taxpayer expense.
In remarks Monday before a Cabinet
meeting at the White House, Trump said he
was proud of Azars nomination and
urged the Senate to swiftly confirm him,
citing the nominee just before a discus-
sion of the national opioid epidemic.
Azar oversaw Eli Lillys lobbying of the
federal government during a sensitive
two-year period when the pharmaceutical
firm was under investigation by the
Justice Department for improperly mar-
keting a medication used for schizophre-
nia.
From 2007 to 2009, when Azar worked
as a senior vice president in charge of cor-
porate affairs and communications, Eli
Lillys lobbying of federal officials and
Congress surged. The firms payments for
internal and outside lobbying rose from

2008 and $11. 2 million in 2009 as

In January 2009, the Indianapolis-based
Eli Lilly settled with the Justice
Department, agreeing to pay $1.4 billion
to the government and to several states for
improper marketing of Zyprexa, a schizo-

Department officials as part of their work
on behalf of the pharmaceutical firm.
Congressional lobbying disclosures do
not indicate whether the contacts included
any discussions of the then-pending feder-
al investigation.
Azars compensation at Lilly during that
period was not provided in the 22-page
financial disclosure filed Friday with the
U.S. Office of Government Ethics. But his
final years earnings showed how far his
drug industry work had catapulted Azars
financial worth far beyond the $160,000
annual salary he earned as HHS general
counsel in the early 2000s.
In addition to the $2 million he earned
in 2016, Azar also was given a $1.6 mil-
lion severance and sold off more than $3.4
million in Eli Lilly stock, noting in his
disclosure: I no longer hold any Eli Lilly
& Co. stock. He also declared between
$100,000 and $1 million in capital gains
from the sales along with millions more
in stock and bond holdings.

executive data firm, he held $292,000 in
equity ownership.
Azar left Eli Lilly in December and start-
ed up a private health care consulting firm,
Seraphim Strategies, LLC. He listed its
value as between $15,000 and $50,000.

in the world, but where 70 percent of com-
muters drive solo.
But unlike traditional highway widening,
engineers have pored over every inch of San
Mateo Countys 15-mile stretch from
Whipple Avenue to State Route 380 to cre-
ate a new lane in each direction. Now, offi-
cials are pleased to announce the project
will primarily stay within existing Caltrans
right-of-way.
The reason the environmental impacts
and right-of-way impacts are minimal, is
because we designed it that way to save time
and money, said Caltrans spokesman Jeff
Weiss. We were very motivated to work
within the existing right-of-way.
The proposal is still in the relatively
early stages, with the environmental review
a key component before design work can
begin. Plus, funding for the $534 million
project has yet to be secured. The goal if all
goes to plan, however, is to begin construc-
tion in 2020 and open lanes by 2024,
according to the report.
The general plan involves realigning
constrained portions of the highway to add
LOCAL
a new managed lane in each direction. That
can be accomplished by narrowing far left
lanes, reducing the width of shoulders and
eliminating auxiliary lanes where possible.
But the project is not without impacts.
Certain auxiliary lanes, which are
reserved for merging on or off the freeway,
will be eliminated while heavily trafficked
ones will be replaced. The report also out-
lines several sound walls that will need to
be relocated and the replacement of a pedes-
trian overcrossing along Monte Diablo
Avenue in San Mateo. There would also be a
range of impacts during construction and
requires approvals from a litany of local,
state as well as federal agencies, according
to the report.
The project also necessitates some right-
of-way acquisition in constrained areas,
particularly near the San Mateo-Burlingame
border. About a 6-foot-wide strip of frontage
road primarily around the Poplar Avenue
ramp and Department of Motor Vehicles
office in San Mateo may need to be
acquired to make room for the project. Small
swaths of road may need to be acquired from
the cities of Burlingame and San Mateo, and
other right-of-way acquisitions may be
needed in various areas along the corridor
for the installation of tolling equipment,
according to the report.
The express lanes would be free to buses
or shuttles, carpoolers with at least three
people and, per state law, clean air vehicles.
The lane would be available to solo drivers
for a fee, with a discounted rate available to
two people carpooling. Rates and who is
able to use the lane would be adjusted
depending on congestion as laws require
carpool or express lanes to operate at a min-
imum 45 mph, according to the report.
Theres not enough incentive to take a
bus or carpool on San Mateo 101 because
there is no carpool lane, Weiss said. If
were asking people to carpool, we cant
expect too much because were not giving
them enough benefit to get in someone
elses car or get on the bus. So the idea is
were moving away from vehicle through-
put and moving toward throughput. Were
trying to get more people in each vehicle
rather than move more vehicles through the
corridor.
The end goal is to create a larger, inter-
connected Bay Area system of express
lanes, he explained. Tolls would be collect-
ed electronically and violating express lane
laws can cost upwards of $400, according to
Caltrans.
The local project is a collaborative effort
between Caltrans, the San Mateo County
Transportation Authority, and the
City/County Association of Governments.
C/CAG Executive Director Sandy Wong
agreed the ultimate goal is to encourage
people to carpool or take mass transit.
The project is proposing a new express
lane so it will give carpools and buses the
advantage, reliable travel time and that in
turn would relieve some congestion on the
general purpose lane, Wong said while try-
ing to assure solo drivers the project wont
exacerbate traffic projections.
Traffic analysis showed converting a gen-
eral purpose lane would worsen travel times
for solo drivers who remain the majority of

commuters. Instead, engineers have looked
throughout the corridor to find areas where
they can pinch pennies, or in this case
inches, and create a new managed lane pri-
marily within the existing footprint of the
highway, she said.
Theyre maximizing every inch of the
freeway, she said.
The project costs range from about $505
million to $534 million when including
escalation and while no specific funding
sources have been identified, Wong said
shes hopeful Senate Bill 1 could provide
assistance. That recently approved legisla-
tion, which included gas tax increases and
hikes to vehicle registration fees, includes a
congested corridors program. She noted
managed lanes on Highway 101 were specif-
ically listed as examples in the legislation
and is hopeful the San Mateo County proj-
ect will be considered competitive for the
statewide funding source.
Weiss emphasized this corridor has a
major influence on the continued prosperity
of the region and Caltrans will aggressively
seek funding, as well as public input on the
project that affects a broad segment of the
community.

omy, 20 [percent] to 25 percent of the

comes from businesses along that corridor,
Weiss said. If people cant get to their
jobs, than its going to have a drag on the
economy.

greatly harm American consumers by hik-
ing television bills and hampering innova-
tion, particularly in online television serv-
ice. The DOJ said AT&T would be able to
charge rival distributors such as cable com-
panies hundreds of millions of dollars more
per year for Time Warners programming
payments that would ultimately get passed
down to consumers through their cable bills.
In an emailed statement Monday, AT&T
general counsel David McAtee said the law-
suit is a radical and inexplicable departure
from decades of antitrust precedent and that
the company is confident that it will prevail
in court.
AT&T runs the countrys second largest
wireless network and is the biggest provider
of traditional satellite and cable TV services.
Time Warner owns HBO, CNN, TBS and
other networks, as well as the Warner Bros.

The governments objections to the deal
surprised many on Wall Street. AT&T and
Time Warner are not direct competitors, and

vertical mergers between such companies
have typically had an easier time winning
government approval than deals that com-
bine two rivals.
The last time the U.S. government won a
court victory in a vertical merger antitrust
case was in 1972, when the Supreme Court
said Fords takeover of a spark-plug busi-
ness violated antitrust law.
Many had expected government approval
of the deal because Obama-era antitrust offi-
cials approved a similar deal Comcasts
purchase of NBCUniversal in 2011, after
imposing restrictions on Comcasts behav-
ior that were meant to protect consumers.
As a candidate, however, Trump vowed to
block the pending AT&T-Time Warner deal
because it would concentrate too much
power in the hands of too few. As presi-
dent, Trump has often blasted CNN for its
coverage of him and his administration, dis-
paraging it and its reporters as fake news.
At a press conference Monday, AT&T CEO
Randall Stephenson addressed speculation
over whether the governments lawsuit was
all about CNN, saying, Frankly, I dont
know. But Stephenson said AT&T would not
agree to anything that would result in it los-
ing control of CNN.
A person familiar with the matter, who
could not go on the record, previously told
the Associated Press that DOJ wanted the
combined company to sell either Turner
the parent of CNN, TBS and other networks
or DirecTV to satisfy its antitrust con-
cerns. A DOJ official, speaking on condition
of anonymity in order to discuss a pending
legal case, said Monday that the government
is still willing to work with AT&T on struc-
tural relief, or selling off assets.
AT&T has argued that buying Time Warner
would let it package and deliver video more
cheaply, over the internet, rather than in
expensive cable bundles. It already has a
DirecTV Now streaming service, which puts
popular live TV networks online, and costs
$35 a month and up, cheaper than tradition-
al cable bundles.
Consumer advocates and some Democratic
politicians applauded the lawsuit as a blow
against media consolidation. Consumers
Union, an advocacy group that opposes the
deal, said there were legitimate reasons to
block the deal to protect consumers, but
called reports of political pressure concern-
ing.
The consumer advocacy group Free Press
likewise praised the DOJ action, but its pres-
ident, Craig Aaron, objected to Trumps
saber-rattling against CNN and other out-
lets that air criticism of the administration.

TV station owner Sinclairs proposed
takeover of rival Tribune. Sinclair is a con-
servative-leaning company.
Delrahim, the antitrust chief, has previ-
ously expressed a preference for requiring
companies to sell off assets rather than
allowing mergers to proceed with conditions
on the merged companys behavior.
Comcast has faced criticism for breaking
some promises related to the conditions on
its NBCU deal. For example, the FCC fined
Comcast $800,000 for not doing enough to
let customers know they could just get inter-
net as a standalone service. Bloomberg TV
also complained that it was exiled in
Comcasts channel lineups far from other
news and business networks. The FCC
agreed.
The DOJ official said Monday that the
AT&T merger was more harmful to con-
sumers than the Comcast-NBCU deal in part
because DirecTV has customers across the
country. Comcast only operates in certain
regions.
This isnt the first time that AT&T has
faced pushback from the government over an
acquisition. The Justice Department also
sued to block its $39 billion bid of T-
Mobile, a direct competitor, in August 2011.

Mateo County was in 1994 and Crowder
noted its more common for these pests to
appear during summer and spring. The tim-
ing and thus far having only captured a sin-
gle fly has Crowder predicting the insect was
brought on a plane or in the mail on a smug-
gled piece of fruit. The county is continuing
to work with the California Department of
Food and Agriculture to set out and regularly
check traps over 17 square miles around the
Half Moon Bay residential property where
the fly was discovered.
The Mediterranean fruit fly is known to
infest the widest range of host plants of any
pest fruit fly and is consider one of the most
important agricultural pests in the world.
The flies lay eggs inside the ripening host
fruit or vegetable. The eggs hatch into mag-
gots and bore their way out while making
the fruit inedible, according to the county.
The Mediterranean flies are uncommon in
San Mateo County, however, officials have
documented several cases of Oriental fruit
flies in the last four years, Crowder said. The
Mediterranean flies are typically found in
urban and suburban areas where fruit trees or
other host plants are grown. Early detection
and rapid response to control the fly is criti-
cal to preventing it from affecting residents
backyard fruit trees, larger agricultural oper-
ations as well as trade, Crowder said.
California produces nearly $50 billion a
year in agricultural commodities and about
$11 billion of that is at risk to
Mediterranean fruit flies, Crowder said. It
can also have a significant impact on organ-
ic growers who dont have as many treat-
ment options to combat the flies, he
explained.

Perezs comments may be weighted
by a previous lawsuit he filed to block

the public bidding process in striking a
deal with the property owners to pay
$61 million for the shopping center
and development of the campus.
Though school officials disagreed
with Perezs claims, they settled to par-
ticipate in the citys public planning
process with an understanding offi-
cials perspective would be only be
advisory.
As part of the project review process,
the Foster City Planning Commission
in September approved sending the
school district a letter illustrating a
variety of concerns, some of which are
reflected in Millers more recent dis-
patch.
Some trustees though indicated they
felt blindsided by the citys perspec-
tive, and claimed the issues were not
raised during the previous series of
meetings designed to address the pro-
posal.
Despite that frustration, Bonini said
she felt it was important officials con-
tinue to consider the reservations
shared by city officials.
There are still things we need to
work with them on, she said.
Ng though expressed a different per-
spective, while wishing to continue
talks after approving a project under an
effort to avoid increasing construction
costs by laying the groundwork on
approval.
In the spirit of cooperation I do want
to work with them on their issues, but I
do want to move forward, she said.
But after Kohn Hsieh and Bonini
showed a reluctance to sway from their
position, Rosas ultimately suggested
the best decision may be for the board
to hold off on taking action in favor of
discussing the matter again soon.
We should go ahead and move it to
the next time, said Rosas, indicating
the issue may return before the board in
December.
Superintendent Joan Rosas said the
district is currently classified as a rev-
enue limit district, funded primarily
through the state. But officials are
hopeful it may soon flip over to be
considered basic aid, which would
allow it to be funded mostly through
local property tax revenue.
Trustee Ed Coady noted the uncer-
tainty is compounded through the dis-
tricts need to ramp up payments to its
employee retirement fund, while
trustee Audrey Ng questioned whether
more money may be available through
coming state budget revisions.
Board President Chelsea Bonini
acknowledged the districts financial
challenges, while expressing opti-
mism officials and teachers can come
to an agreement on a new contract in
short order.
We can work toward a resolution on
these issues and hopefully we can do
that soon, she said.
